590.650.1.Asusedinthissection"minoritygroup"meansindividualsofAfrican,

3 2.Eachtimeapeaceofficerstopsadriverofamotorvehicle,thatofficershallreport
4thefollowinginformationtothelawenforcementagencythatemploystheofficer:
5 (1)Theage,genderandraceorminoritygroupoftheindividualstopped;
6 (2)Theimmigrationstatusoftheindividualstopped;
7 (3)Thereasonsforthestop;
8 [(3)](4)Whetherasearchwasconductedasaresultofthestop;
9 [(4)](5)Ifasearchwasconducted,whethertheindividualconsentedtothesearch,
10theprobablecauseforthesearch,whetherthepersonwassearched,whethertheperson's
11propertywassearched,andthedurationofthesearch;
12 [(5)](6)Whetheranycontrabandwasdiscoveredinthecourseofthesearchandthe
13typeofanycontrabanddiscovered;
14 [(6)](7)Whetheranywarningorcitationwasissuedasaresultofthestop;
15 [(7)](8)Ifawarningorcitationwasissued,theviolationchargedorwarning

27 (3)Theattorneygeneralshalldeterminetheformatthatalllawenforcementagencies
28shallusetosubmitthereport.
29 4.(1)Theattorneygeneralshallanalyzetheannualreportsoflawenforcement
30agenciesrequiredbythissectionandsubmitareportofthefindingstothegovernor,the
31generalassemblyandeachlawenforcementagencynolaterthanJunefirstofeachyear.
32 (2)Thereportoftheattorneygeneralshallincludeatleastthefollowinginformation
33foreachagency:
34 (a)Thetotalnumberofvehiclesstoppedbypeaceofficersduringtheprevious
35calendaryear;
36 (b)Thenumberandpercentageofstoppedmotorvehiclesthatweredrivenby
37membersofeachparticularminoritygroup;
38 (c)Acomparisonofthepercentageofstoppedmotorvehiclesdrivenbyeach
39minoritygroupandthepercentageofthestate'spopulationthateachminoritygroup
40comprises;and
41 (d)Acompilationoftheinformationreportedbylawenforcementagenciespursuant
42tosubsection2ofthissection.
43 5.Eachlawenforcementagencyshalladoptapolicyonrace-basedtrafficstopsthat:
44 (1)Prohibitsthepracticeofroutinelystoppingmembersofminoritygroupsfor
45violationsofvehiclelawsasapretextforinvestigatingotherviolationsofcriminallaw;
46 (2)Providesforperiodicreviewsbythelawenforcementagencyoftheannualreport
47oftheattorneygeneralrequiredbysubsection4ofthissectionthat:
48 (a)Determinewhetheranypeaceofficersofthelawenforcementagencyhavea
49patternofstoppingmembersofminoritygroupsforviolationsofvehiclelawsinanumber
50disproportionatetothepopulationofminoritygroupsresidingortravelingwithinthe
51jurisdictionofthelawenforcementagency;and
52 (b)Ifthereviewrevealsapattern,requireaninvestigationtodeterminewhetherany
53peaceofficersofthelawenforcementagencyroutinelystopmembersofminoritygroupsfor
54violationsofvehiclelawsasapretextforinvestigatingotherviolationsofcriminallaw;and

56haveengagedinrace-basedtrafficstopswithinninetydaysofthereview.

58Thecourseorcoursesofinstructionandtheguidelinesshallstressunderstandingandrespect
59forracialandculturaldifferences,anddevelopmentofeffective,noncombativemethodsof
60carryingoutlawenforcementdutiesinaraciallyandculturallydiverseenvironment.
61 6.Ifalawenforcementagencyfailstocomplywiththeprovisionsofthissection,the
62governormaywithholdanystatefundsappropriatedtothenoncompliantlawenforcement
63agency.
64 7.Eachlawenforcementagencyinthisstatemayutilizefederalfundsfrom
65community-orientedpolicingservicesgrantsoranyotherfederalsourcestoequipeach
66vehicleusedfortrafficstopswithavideocameraandvoice-activatedmicrophone.
67 8.Apeaceofficerwhostopsadriverofamotorvehiclepursuanttoalawfully
68conductedsobrietycheckpointorroadblockshallbeexemptfromthereportingrequirements
69ofsubsection2ofthissection.
