SectionA.Section537.046,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection537.046,toreadasfollows:
537.046.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Childhoodsexualabuse",anyactcommittedbythedefendantagainstthe
3plaintiffwhichactoccurredwhentheplaintiffwasundertheageofeighteenyearsandwhich
4actwouldhavebeenaviolationofsection566.030,566.040,566.050,566.060,566.070,
5566.080,566.090,566.100,566.110,or566.120,orsection568.020;
6 (2)"Injury"or"illness",eitheraphysicalinjuryorillnessorapsychologicalinjuryor
7illness.Apsychologicalinjuryorillnessneednotbeaccompaniedbyphysicalinjuryor
8illness.
9 2.Anyactiontorecoverdamagesfrominjuryorillnesscausedbychildhoodsexual
10abuseinanactionbroughtpursuanttothissection[shallbecommencedwithintenyearsof
11theplaintiffattainingtheageoftwenty-oneorwithinthreeyearsofthedatetheplaintiff
12discovers,orreasonablyshouldhavediscovered,thattheinjuryorillnesswascausedby
13childhoodsexualabuse,whicheverlateroccurs] maybecommencedatanytime.
14 3.ThissectionshallapplytoanyactioncommencedonorafterAugust28,2004,
15includinganyactionwhichwouldhavebeenbarredbytheapplicationofthestatuteof
16limitationapplicablepriortothatdate.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. SectionB.Therepealandreenactmentofsection537.046ofsectionAofthisact
2shallbecomeeffectiveonlyuponthepassageandapprovalbythevotersofaconstitutional
3amendmentsubmittedtothembythegeneralassemblyregardingtheenactmentofa
