SectionA.Chapter319,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection319.065,toreadasfollows:
319.065.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Abandonedlinesandfacilities",anytelecommunicationorcabletelevision
3linesandfacilitiesthatarenolongerinuseormaintainedbytheowner;
4 (2)"Owner",anytelecommunicationorcabletelevisioncompanythatowns
5linesandfacilities;
6 (3)"Publicrights-of-way",theareaon,below,oraboveapublicroadway,
7highway,street,sidewalk,alley,orsimilarpropertyusedforpublictravel,butnot
8includingfederalinterstatehighways,railroadrights-of-way,orprivateeasements.
9 2.Ownersoftelecommunicationandcabletelevisionlinesandfacilitiesshall
10removeanyabandonedlinesorfacilitieslocatedinpublicrights-of-waywithinone
11hundredeightydaysofabandonment.
12 3.Ownersshallnotifytherelevantmunicipal,county,orstateagencyand
13provideaplanforremovalwithinthirtydaysofabandonment.
14 4.Ownersfailingtoremoveabandonedlinesorfacilitieswithinthespecified
15timeframeshallbesubjecttoafineoffivehundreddollarsperdayuntilremovalis
16completedandresponsibleforreimbursinganycostsincurredduetocontactwith
17abandonedlinesandfacilitiesduringotherinfrastructureprojects.
