SectionA.Chapter182,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection182.910,toreadasfollows:
182.910.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Digitallibrarymaterial"or"digitallibrarymaterials",includes,butisnot
3limitedto,digitalaudiobooks,electronicbooks,electronictextbooks,electronicjournals,
4electronicmagazinesandperiodicals,databases,digitaltestpreparationresources,
5digitalvocationalandcareerresources,digitalreferenceresources,streamingvideo,and
6academicsoftwareprogramsthataredirectlyaccessiblethroughthepubliclibraryor
7schoollibrarydatabase,excludinganyonlineordigitalcontentavailabletopatronsor
8studentsoutsideofthepubliclibraryorschoollibrarydatabaseorplatform;
9 (2)"Librarymaterial"or"librarymaterials",anyresourceinprintornonprint
10formatthatisfoundinapubliclibraryorschoollibraryandthatsupportscurricularor
11personalinformationneedsincluding,butnotlimitedto,books,magazines,newspapers,
12pamphlets,microfiche,microfilm,films,discrecords,filmstrips,slides,prints,audio
13recordings,videorecordings,compactdiscs,computersoftware,libraryprograms,and
14exhibits;
15 (3)"Reconsideration",aprocessinwhichlibrarypersonnel,publicschools,
16schooldistricts,orlibrarygoverningbodiesreviewmaterialsinthepubliclibraryor
17schoollibraryduetoaformalcomplaintfiledbyamemberofthecommunity.The

25 2.Apubliclibraryorschoollibraryshallestablishapolicythatispublicly
26availableandpostedinapubliclocationandonthewebsiteoftheschooldistrictor
27governingbodyofthepubliclibrarythatoutlinestheprocessforlibrarymaterialsand
28digitallibrarymaterialstoundergoreconsiderationbasedonacomplaintmadeabout
29librarymaterialsordigitallibrarymaterialsfromamemberofthecommunity.
30 3.Apubliclibraryorschoollibraryshallremovelibrarymaterialsfromits
31permanentcollection,relocatelibrarymaterialswithinitscollection,orremoveor
32restrictaccesstodigitallibrarymaterialswithinitscollectiononlyifthelibrary
33materialshavebeenreviewedinaccordancewithanestablishedpolicyforthe
34reconsiderationoflibrarymaterialsanddigitallibrarymaterialsthatcomplieswiththe
35requirementsofthissection.
36 4.Tomakearequestforreconsiderationoflibrarymaterialsordigitallibrary
37materials,theindividualmakingtherequestshallsignanaffidavitaffirmingthat:
38 (1)Suchindividualhasreadorconsumedtheentiretyofthechallenged
39material;and
40 (2)Suchindividualpermanentlyresidesin:
41 (a)Thetaxingdistrictofthepubliclibraryinwhichtherequestismade;or
42 (b)Theschooldistrictinwhichtherequestismade.
43 5.Eachpubliclibraryorschoollibraryshalldevelopanappealsprocessforthe
44reconsiderationpolicythatoutlinesaprocessforappealingadecisionmaderegarding
45theremovaloflibrarymaterialsordigitallibrarymaterials.Thisappealsprocessshall
46provideforafinaldecisiononeachappealtobemadebyalocalelectedofficialorgroup
47ofofficials.
48 6.Digitallibrarymaterialsthatundergoreconsiderationshallbesubjectto
49removalorrestrictedaccessatthetitle,issue,andarticlelevel.Anythirdparty
50contractedtoprovidedatabasesthatcontainorprovideaccesstodigitallibrary
51materialsshallhavetheabilitytocuratethosematerialsusingamechanismortoolthat
52allowsfortheremovalorrestrictionofaccesstochallengedcontentwithoutdisrupting
53accesstotheremainderofdigitallibrarymaterialsaccessibleinthepubliclibraryor
HB1146	2 54schoollibrary.Curationofdigitallibrarymaterialsshallnotbeappliedatanindividual
55userlevel,butshallbeappliedatthelibrarysystemorschooldistrictlevel.
56 7.Digitallibraryresourcesshallnottrackormonitortheaccessoflibrary
57materialsordigitallibrarymaterialsbyindividualusers,especiallyminors,including
58anytrackingormonitoringtopersonalizeexperienceswithinthelibraryresources.
59 8.Anindividualwhoisalibrarian,mediaspecialist,otheremployee,contractor,
60orvolunteerofapubliclibraryorschoollibraryshallnotbesubjecttotermination,
61demotion,discipline,retaliation,oranyotherpenaltyforrefusingtoremovelibrary
62materialsordigitallibrarymaterialsbeforesuchmaterialshavebeenreviewedin
63accordancewithapubliclibraryorschoollibrarypolicythatcomplieswiththe
64provisionsofthissection.
