34 (b)a.SuccessfulattainmentoftheMissouriqualifyingscoreontheexitassessment 35forteachersoradministratorsdesignatedbythestateboardofeducation; 36 b.(i)Applicantswhohavenotsuccessfullyachievedaqualifyingscoreonthe 37designatedexaminationswillbeissuedatwo-yearnonrenewableprovisionalcertificate; 110 (c)Receivesarecommendationfromtheapplicant'semployingschooldistrictthatthe 111applicantbeawardedanadditionalprofessionalsubject-areacertificationbythestateboard 112underrulesprescribedbythestateboard;and 113 (d)Completesabackgroundcheckasprescribedinsection168.133. 114 2.Allvalidteachingcertificatesissuedpursuanttolaworstateboardpoliciesand 115regulationspriortoSeptember1,1988,shallbeexemptfromtheprofessionaldevelopment 116requirementsofthissectionandshallcontinueineffectuntiltheyexpire,arerevokedor 117suspended,asprovidedbylaw.Whensuchcertificatesarerequiredtoberenewed,thestate 118boardoritsdesigneeshallgranttoeachholderofsuchacertificatethecertificatemostnearly 119equivalenttotheonesoheld.Anyonewhoholds,asofAugust28,2003,avalidPC-I,PC-II, 120orcontinuousprofessionalcertificateshall,uponexpirationofsuchperson'scurrent 121certificate,beissuedtheappropriatelevelofcertificatebasedupontheclassificationsystem 122establishedpursuanttosubsection3ofthissection. 123 3.(1)Certificatesoflicensetoteachinthepublicschoolsofthestateshallbebased 124uponminimumrequirementsprescribedbythestateboardofeducationwhichshallinclude 125completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall 126provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate 127andacareercontinuousprofessionalcertificate. HCSHB1153 4 128 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof 129requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon 130verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof 131education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate 132to: 133 (a)Participateinamentoringprogramapprovedandprovidedbythedistrictfora 134minimumoftwoyears; 135 (b)Completethirtycontacthoursofprofessionaldevelopment,whichmayinclude 136hoursspentinclassinanappropriatecollegecurriculum,orforholdersofacertificateunder 137subdivision(4)ofsubsection1ofthissection,anamountofprofessionaldevelopmentin 138proportiontothecertificateholder'shoursintheclassroom,ifthecertificateholderis 139employedlessthanfulltime;and 140 (c)Participateinabeginningteacherassistanceprogram. 141 (3)(a)Thecareercontinuousprofessionalcertificateshallbeissuedupon 142verificationofcompletionoffouryearsofteachingundertheinitialprofessionalcertificate 143anduponverificationofthecompletionoftherequirementsarticulatedinparagraphs(a)to 144(c)ofsubdivision(2)ofthissubsectionorparagraphs(a)to(d)ofsubdivision(5)of 145subsection1ofthissection. 146 (b)Thecareercontinuousprofessionalcertificateshallbecontinuousbasedupon 147verificationofactualemploymentinaneducationalpositionasprovidedforinstateboard 148guidelinesandcompletionoffifteencontacthoursofprofessionaldevelopmentperyear 149whichmayincludehoursspentinclassinanappropriatecollegecurriculum.Shouldthe 150possessorofavalidcareercontinuousprofessionalcertificatefail,inanygivenyear,tomeet 151thefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwoyears, 152makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshallfirst 153completethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursinexcess 154ofthecurrentyearrequirementasmake-uphours.Shouldthepossessorfailtomakeupthe 155missinghourswithintwoyears,thecertificateshallbecomeinactive.Inordertoreactivate 156thecertificate,thepossessorshallcompletetwenty-fourcontacthoursofprofessional 157developmentwhichmayincludehoursspentintheclassroominanappropriatecollege 158curriculumwithinthesixmonthspriortoorafterreactivatingthepossessor'scertificate.The 159requirementsofthisparagraphshallbemonitoredandverifiedbythelocalschooldistrict 160whichemploystheholderofthecareercontinuousprofessionalcertificate. 161 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe 162professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif 163suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool 164districtandmeetstwoofthethreefollowingcriteria: HCSHB1153 5 165 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation; 166 b.Possessesamaster'sdegree;or 167 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof 168education. 169 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot 170retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall 171alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin 172aneducationalpositionforthreeyearsormoretoreactivatetheteacher'slastlevelof 173certificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopmentwhich 174mayincludehoursspentintheclassroominanappropriatecollegecurriculumwithinthesix 175monthspriortoorafterreactivatingtheteacher'scertificate. 176 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin 177section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely 178alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof 179teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin 180thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification 181undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall 182annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall 183establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed 184afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein 185anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof 186licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional 187certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume 188classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection 189168.133,foranyapplicantwho: 190 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri; 191 (2)Relocatedfromanotherstatewithinoneyearofthedateofapplication; 192 (3)Underwentacriminalbackgroundcheckinordertobeissuedateaching 193certificateoflicensefromanotherstate;and 194 (4)Otherwisequalifiesunderthissection. 195 6.Thestateboardmayassesstoholdersofaninitialprofessionalcertificateafee,to 196bedepositedintotheexcellenceineducationfundestablishedpursuanttosection160.268,for 197theissuanceofthecareercontinuousprofessionalcertificate.However,suchfeeshallnot 198exceedthecombinedcostsofissuanceandanycriminalbackgroundcheckrequiredasa 199conditionofissuance.ApplicantsfortheinitialABCTEcertificateshallberesponsiblefor 200anyfeesassociatedwiththeprogramleadingtotheissuanceofthecertificate,butnothingin 201thissectionshallprohibitadistrictfromdevelopingapolicythatpermitsfeereimbursement. HCSHB1153 6 202 7.AnymemberofthepublicschoolretirementsystemofMissouriwhoentered 203coveredemploymentwithtenormoreyearsofeducationalexperienceinanotherstateor 204statesandheldacertificateissuedbyanotherstateandsubsequentlyworkedinaschool 205districtcoveredbythepublicschoolretirementsystemofMissourifortenormoreyearswho 206laterbecamecertificatedinMissourishallhavethatcertificatedatedbacktothemember's 207originaldateofemploymentinaMissouripublicschool. 208 8.Withinthirtydaysofreceivinganapplicationfromaspouseofanactiveduty 209memberoftheArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledto 210betransferredtothestateofMissouri,orwhohasbeentransferredorisscheduledtobe 211transferredtoanadjacentstateandisorwillbedomiciledinthestateofMissouri,orhas 212movedtothestateofMissourionapermanentchange-of-stationbasisandhassuccessfully 213completedthebackgroundcheckdescribedundersubsection5ofthissectionandsection 214168.133,thestateboardshallissuetosuchapplicantafullcertificateoflicensetoteach, 215providedthattheapplicanthaspaidallnecessaryfeesandhasotherwisemetallrequirements 216tobeissuedsuchacertificate. 168.036.1.Inadditiontograntingcertificatesoflicensetoteachinpublicschoolsof 2thestateundersection168.021,thestateboardofeducationshallgrantsubstituteteacher 3certificatesasprovidedinthissectiontoanyindividualseekingtosubstituteteachinany 4publicschoolinthisstate. 5 2.(1)Thestateboardshallnotgrantacertificateoflicensetoteachunderthissection 6toanyindividualwhohasnotcompletedabackgroundcheckasrequiredundersection 7168.021. 8 (2)Thestateboardmayrefusetoissueorrenew,suspend,orrevokeanycertificate 9soughtorissuedunderthissectioninthesamemannerandforthesamereasonsasunder 10section168.071. 11 3.Thestateboardmaygrantacertificateunderthissectiontoanyindividualwhohas 12completed: 13 (1)Atleastthirty-sixsemesterhoursatanaccreditedinstitutionofhighereducation; 14or 15 (2)Thetwenty-houronlinetrainingprogramrequiredinthissectionandwho 16possessesahighschooldiplomaortheequivalentthereof. 17 4.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain 18anonlinetrainingprogramforindividuals,whichshallconsistoftwentyhoursoftraining 19relatedtosubjectsappropriateforsubstituteteachersasdeterminedbythedepartment. 20 5.Thestateboardmaygrantacertificateunderthissectiontoanyhighlyqualified 21individualwithexpertiseinatechnicalorbusinessfieldorwithexperienceintheArmed 22ForcesoftheUnitedStateswhohascompletedthebackgroundcheckrequiredinthissection HCSHB1153 7 23butdoesnotmeetanyofthequalificationsundersubdivision(1)or(2)ofsubsection3ofthis 24sectionifthesuperintendentoftheschooldistrictinwhichtheindividualseekstosubstitute 25teachsponsorssuchindividualandtheschoolboardoftheschooldistrictinwhichthe 26individualseekstosubstituteteachvotestoapprovesuchindividualtosubstituteteach. 27 6.(1)Notwithstandinganyotherprovisionstocontrary,beginningonJune30,2022, 28andendingonJune30,[2025] 2030, anypersonwhoisretiredandcurrentlyreceivinga 29retirementallowanceundersections169.010to169.141orsections169.600to169.715,other 30thanfordisability,maybeemployedtosubstituteteachonapart-timeortemporarysubstitute 31basisbyanemployerincludedintheretirementsystemwithoutadiscontinuanceofthe 32person'sretirementallowance.Suchapersonshallnotcontributetotheretirementsystem,or 33tothepublicschoolretirementsystemestablishedbysections169.010to169.141ortothe 34publiceducationemployeeretirementsystemestablishedbysections169.600to169.715, 35becauseofearningsduringsuchperiodofemployment. 36 (2)Inadditiontotheconditionssetforthinsubdivision1ofthissubsection,any 37personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to 38169.141,otherthanfordisability,whoisemployedbyathirdpartyorisperformingworkas 39anindependentcontractormaybeemployedtosubstituteteachonapart-timeortemporary 40substitutebasis,ifsuchpersonisperformingworkforanemployerincludedintheretirement 41systemwithoutadiscontinuanceoftheperson'sretirementallowance. 42 (3)Ifapersonisemployedpursuanttothissubsectiononaregular,full-timebasisthe 43personshallnotbeentitledtoreceivetheperson'sretirementallowanceforanymonthduring 44whichthepersonissoemployed.Theretirementsystemmayrequiretheemployer,thethird- 45partyemployer,theindependentcontractor,andtheretireesubjecttothissubsectionto 46providedocumentationshowingcompliancewiththissubsection.Ifsuchdocumentationis 47notprovided,theretirementsystemmaydeemtheretireetohaveexceededthelimitations 48providedinthissubsection. 49 7.Acertificategrantedunderthissectionshallbevalidforfouryears.Acertificate 50grantedunderthissectionshallexpireattheendofanycalendaryearinwhichtheindividual 51failstosubstituteteachforatleastfivedaysorfortyhoursofin-seatinstruction. 52 8.(1)Anindividualtowhomthestateboardgrantsacertificateunderthissection 53maybeasubstituteteacherinapublicschoolinthestateiftheschooldistrictagreesto 54employtheindividualasasubstituteteacherandsuchindividualhascompletedabackground 55checkasrequiredinsubsection10ofthissection. 56 (2)Noindividualtowhomthestateboardgrantsacertificateunderthissectionand 57whoisundertwentyyearsofageshallbeasubstituteteacheringradesninetotwelve. 58 9.Eachschooldistrictmaydevelopanorientationforindividualstowhomthestate 59boardgrantsacertificateunderthissectionforsuchindividualsemployedbytheschool HCSHB1153 8 60districtandmayrequiresuchindividualstocompletesuchorientation.Suchorientationshall 61containatleasttwohoursofsubjectsappropriateforsubstituteteachersandshallcontain 62instructionontheschooldistrict'sbestpracticesforclassroommanagement. 63 10.BeginningJanuary1,2023,anysubstituteteachermay,atthetimesuchsubstitute 64teachersubmitsthefingerprintsandinformationrequiredforthebackgroundcheckrequired 65undersection168.021,designateuptofiveschooldistrictstowhichsuchsubstituteteacher 66hassubmittedanapplicationforsubstituteteachingtoreceivetheresultsofthesubstitute 67teacher'scriminalhistorybackgroundcheckandfingerprintcollection.Thetotalamountof 68anyfeesfordisseminatingsuchresultstouptofiveschooldistrictsunderthissubsectionshall 69notexceedfiftydollars. 70 11.Thestateboardmayexercisetheboard'sauthorityunderchapter161to 71promulgateallnecessaryrulesandregulationsnecessaryfortheadministrationofthissection. ✔ HCSHB1153 9
