168.021.1.Certificatesoflicensetoteachinthepublicschoolsofthestateshallbe
2grantedasfollows:
3 (1)Bythestateboard,underrulesandregulationsprescribedbyit:
4 (a)Uponthebasisofcollegecredit;
5 (b)Uponthebasisofexamination;
6 (2)Bythestateboard,underrulesandregulationsprescribedbythestateboardwith
7advicefromtheadvisorycouncilestablishedbysection168.015toanyindividualwho
8presentstothestateboardavaliddoctoraldegreefromanaccreditedinstitutionofhigher
9educationaccreditedbyaregionalaccreditingassociationsuchasNorthCentralAssociation.
10Suchcertificateshallbelimitedtothemajorareaofpostgraduatestudyoftheholder,shallbe
11issuedonlyaftersuccessfulcompletionoftheexaminationrequiredforgraduationpursuant
12torulesadoptedbythestateboardofeducation,andshallberestrictedtothosecertificates
13establishedpursuanttosubdivision(2)ofsubsection3ofthissection;
14 (3)Bythestateboard,whichshallissuetheprofessionalcertificateclassificationin
15boththegeneralandspecializedareasmostcloselyalignedwiththecurrentareasof
16certificationapprovedbythestateboard,commensuratewiththeyearsofteachingexperience
17oftheapplicant,andbaseduponthefollowingcriteria:

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (a)a.Recommendationofastate-approvedbaccalaureate-levelteacherpreparation
19program;
20 b.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain
21aneighteen-hour(onethousandeightyminutes)onlineteacherpreparationprogramrelatedto
22subjectsappropriateforelementaryandsecondaryeducationsettings.Anycharitable
23organizationregisteredinMissourithatisexemptfromfederaltaxationundertheInternal
24RevenueCodeof1986,asamended,maysubmitateacherpreparationprogramtothe
25departmentofelementaryandsecondaryeducationforapproval.Onceapproved,the
26charitableorganizationshallbecertifiedtodevelopandmaintainateacherpreparedness
27program.Approvedteacherpreparednessprogramscreatedbyacharitableorganizationshall
28bemadeavailablebythedepartmentofelementaryandsecondaryeducation.Anindividual
29withabachelor'sdegreemaycompleteaneighteen-houronlinetrainingprogram,either
30createdbythedepartmentorbyacharitableorganization,andreceiveateachercertificate.
31SuchcertificateshallnotbeacceptedbyMissouripublicschools,andnonpublicschoolsshall
32notberequiredtoacceptthecertificate,butshallbeacceptedbyprivateschoolsandprivate
33schoolaccreditingagencies;
34 (b)a.SuccessfulattainmentoftheMissouriqualifyingscoreontheexitassessment
35forteachersoradministratorsdesignatedbythestateboardofeducation;
36 b.(i)Applicantswhohavenotsuccessfullyachievedaqualifyingscoreonthe
37designatedexaminationswillbeissuedatwo-yearnonrenewableprovisionalcertificate;
38 (ii)Duringthetwo-yearnonrenewableprovisionalcertification,anindividualteacher
39maygainfullprofessionalcertificationby:
40 i.Achievingaqualifyingscoreonthedesignatedexam;or
41 ii.Successfullyachievinganacceptablescoreonthestate-approvedteacher
42evaluationsystemfromsevenwalk-throughevaluations,twoformativeevaluations,andone
43summativeevaluationforeachofthetwoprobationaryyearsandbeingofferedathird
44contractbytheemployingdistrict.Foranyapplicantwhohasachangeinjobstatusbecause
45ofareductionintheworkforceorachangeinlifecircumstances,thescoresrequiredunder
46thisitemmaybescoresachievedinanyschooldistrictduringthetwo-yearnonrenewable
47provisionalcertificationperiod;and
48 (iii)Theemployingschooldistrictshallrecommendtothedepartmentofelementary
49andsecondaryeducationthattheindividualteacherbeawardedafullprofessional
50certificationbythestateboardunderrulesprescribedbythestateboard;and
51 (c)Uponcompletionofabackgroundcheckasprescribedinsection168.133and
52possessionofavalidteachingcertificateinthestatefromwhichtheapplicant'steacher
53preparationprogramwascompleted;

55bachelor'sdegree,orhigherdegree,andapassingscoreforthedesignatedexitexamination,
56forindividualswhoseacademicdegreeandprofessionalexperiencearesuitabletoprovidea
57basisforinstructionsolelyinthesubjectmatterofbankingorfinancialresponsibility,atthe
58discretionofthestateboard.Suchcertificateshallbelimitedtothemajorareaofstudyofthe
59holderandshallberestrictedtothosecertificatesestablishedundersubdivision(2)of
60subsection3ofthissection.Holdersofcertificatesgrantedunderthissubdivisionshallbe
61exemptfromtheteachertenureactundersections168.102to168.130andeachschooldistrict
62shallhavethedecision-makingauthorityonwhethertohiretheholdersofsuchcertificates;
63 (5)Bythestateboard,underrulesandregulationsprescribedbyit,onthebasisof
64certificationbytheAmericanBoardforCertificationofTeacherExcellence(ABCTE)or
65TeachersofTomorrowandverificationofabilitytoworkwithchildrenasdemonstratedby
66sixtycontacthoursinanyoneofthefollowingareasasvalidatedbytheschoolprincipal:
67sixtycontacthoursintheclassroom,ofwhichatleastforty-fivemustbeteaching;sixty
68contacthoursasasubstituteteacher,withatleastthirtyconsecutivehoursinthesame
69classroom;sixtycontacthoursofteachinginaprivateschool;orsixtycontacthoursof
70teachingasaparaprofessional,foraninitialfour-yearABCTEorTeachersofTomorrow
71certificateoflicensetoteach,exceptthatsuchcertificateshallnotbegrantedfortheareasof
72earlychildhoodeducation,orspecialeducation.Forcertificationintheareaofelementary
73education,ninetycontacthoursintheclassroomshallberequired,ofwhichatleastthirty
74shallbeinanelementaryclassroom.Uponthecompletionofthefollowingrequirements,an
75applicantshallbeeligibletoapplyforacareercontinuousprofessionalcertificateunder
76subdivision(3)ofsubsection3ofthissection:
77 (a)Completionofthirtycontacthoursofprofessionaldevelopmentwithinfouryears,
78whichmayincludehoursspentinclassinanappropriatecollegecurriculum;
79 (b)ValidatedcompletionoftwoyearsofthementoringprogramoftheAmerican
80BoardforCertificationofTeacherExcellence, TeachersofTomorrow,oradistrict
81mentoringprogramapprovedbythestateboardofeducation;
82 (c)Attainmentofasuccessfulperformance-basedteacherevaluation;and
83 (d)Participationinabeginningteacherassistanceprogram;
84 (6)(a)Bythestateboard,underrulesandregulationsprescribedbytheboard,which
85shallissueaninitialvisitingscholarscertificateatthediscretionoftheboard,basedonthe
86followingcriteria:
87 a.Verificationfromthehiringschooldistrictthattheapplicantwillbeemployedas
88partofabusiness-educationpartnershipinitiativedesignedtobuildcareerpathwayssystems
89oremployedaspartofaninitiativedesignedtofillvacantpositionsinhard-to-staffpublic
90schoolsorhard-to-fillsubjectareasforstudentsinagradeorgradesnotlowerthantheninth

92applicant;
93 b.Appropriateandrelevantbachelor'sdegreeorhigher,occupationallicense,or
94industry-recognizedcredential;
95 c.Completionoftheapplicationforaone-yearvisitingscholarscertificate;and
96 d.Completionofabackgroundcheckasprescribedundersection168.133.
97 (b)Theinitialvisitingscholarscertificateshallcertifytheholderofsuchcertificateto
98teachforoneyear.Anapplicantshallbeeligibletorenewaninitialvisitingscholars
99certificateamaximumoftwotimes,baseduponthecompletionoftherequirementslisted
100undersubparagraphsa.,b.,andd.ofparagraph(a)ofthissubdivision;completionof
101professionaldevelopmentrequiredbytheschooldistrictandschool;andattainmentofa
102satisfactoryperformance-basedteacherevaluation;or
103 (7)Bythestateboard,whichshallissueanadditionalprofessionalsubject-area
104certificationforspecificcontentknowledgeorforaspecialtyareatoacertificateholderwho:
105 (a)Appliesforanadditionalprofessionalsubject-areacertification;
106 (b)Successfullyachievesanacceptablescoreonthestate-approvedteacher
107evaluationsystemfromsevenwalk-throughevaluations,twoformativeevaluations,andone
108summativeevaluationoftheapplicantteachingspecificcontentknowledgeorthespecialty
109areaforwhichtheadditionalprofessionalsubject-areacertificationissought;
110 (c)Receivesarecommendationfromtheapplicant'semployingschooldistrictthatthe
111applicantbeawardedanadditionalprofessionalsubject-areacertificationbythestateboard
112underrulesprescribedbythestateboard;and
113 (d)Completesabackgroundcheckasprescribedinsection168.133.
114 2.Allvalidteachingcertificatesissuedpursuanttolaworstateboardpoliciesand
115regulationspriortoSeptember1,1988,shallbeexemptfromtheprofessionaldevelopment
116requirementsofthissectionandshallcontinueineffectuntiltheyexpire,arerevokedor
117suspended,asprovidedbylaw.Whensuchcertificatesarerequiredtoberenewed,thestate
118boardoritsdesigneeshallgranttoeachholderofsuchacertificatethecertificatemostnearly
119equivalenttotheonesoheld.Anyonewhoholds,asofAugust28,2003,avalidPC-I,PC-II,
120orcontinuousprofessionalcertificateshall,uponexpirationofsuchperson'scurrent
121certificate,beissuedtheappropriatelevelofcertificatebasedupontheclassificationsystem
122establishedpursuanttosubsection3ofthissection.
123 3.(1)Certificatesoflicensetoteachinthepublicschoolsofthestateshallbebased
124uponminimumrequirementsprescribedbythestateboardofeducationwhichshallinclude
125completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall
126provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate
127andacareercontinuousprofessionalcertificate.
HCSHB1153	4 128 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof
129requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon
130verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof
131education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate
132to:
133 (a)Participateinamentoringprogramapprovedandprovidedbythedistrictfora
134minimumoftwoyears;
135 (b)Completethirtycontacthoursofprofessionaldevelopment,whichmayinclude
136hoursspentinclassinanappropriatecollegecurriculum,orforholdersofacertificateunder
137subdivision(4)ofsubsection1ofthissection,anamountofprofessionaldevelopmentin
138proportiontothecertificateholder'shoursintheclassroom,ifthecertificateholderis
139employedlessthanfulltime;and
140 (c)Participateinabeginningteacherassistanceprogram.
141 (3)(a)Thecareercontinuousprofessionalcertificateshallbeissuedupon
142verificationofcompletionoffouryearsofteachingundertheinitialprofessionalcertificate
143anduponverificationofthecompletionoftherequirementsarticulatedinparagraphs(a)to
144(c)ofsubdivision(2)ofthissubsectionorparagraphs(a)to(d)ofsubdivision(5)of
145subsection1ofthissection.
146 (b)Thecareercontinuousprofessionalcertificateshallbecontinuousbasedupon
147verificationofactualemploymentinaneducationalpositionasprovidedforinstateboard
148guidelinesandcompletionoffifteencontacthoursofprofessionaldevelopmentperyear
149whichmayincludehoursspentinclassinanappropriatecollegecurriculum.Shouldthe
150possessorofavalidcareercontinuousprofessionalcertificatefail,inanygivenyear,tomeet
151thefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwoyears,
152makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshallfirst
153completethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursinexcess
154ofthecurrentyearrequirementasmake-uphours.Shouldthepossessorfailtomakeupthe
155missinghourswithintwoyears,thecertificateshallbecomeinactive.Inordertoreactivate
156thecertificate,thepossessorshallcompletetwenty-fourcontacthoursofprofessional
157developmentwhichmayincludehoursspentintheclassroominanappropriatecollege
158curriculumwithinthesixmonthspriortoorafterreactivatingthepossessor'scertificate.The
159requirementsofthisparagraphshallbemonitoredandverifiedbythelocalschooldistrict
160whichemploystheholderofthecareercontinuousprofessionalcertificate.
161 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe
162professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif
163suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool
164districtandmeetstwoofthethreefollowingcriteria:
HCSHB1153	5 165 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation;
166 b.Possessesamaster'sdegree;or
167 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof
168education.
169 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot
170retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall
171alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin
172aneducationalpositionforthreeyearsormoretoreactivatetheteacher'slastlevelof
173certificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopmentwhich
174mayincludehoursspentintheclassroominanappropriatecollegecurriculumwithinthesix
175monthspriortoorafterreactivatingtheteacher'scertificate.
176 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin
177section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely
178alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof
179teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin
180thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification
181undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall
182annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall
183establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed
184afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein
185anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof
186licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional
187certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume
188classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection
189168.133,foranyapplicantwho:
190 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri;
191 (2)Relocatedfromanotherstatewithinoneyearofthedateofapplication;
192 (3)Underwentacriminalbackgroundcheckinordertobeissuedateaching
193certificateoflicensefromanotherstate;and
194 (4)Otherwisequalifiesunderthissection.
195 6.Thestateboardmayassesstoholdersofaninitialprofessionalcertificateafee,to
196bedepositedintotheexcellenceineducationfundestablishedpursuanttosection160.268,for
197theissuanceofthecareercontinuousprofessionalcertificate.However,suchfeeshallnot
198exceedthecombinedcostsofissuanceandanycriminalbackgroundcheckrequiredasa
199conditionofissuance.ApplicantsfortheinitialABCTEcertificateshallberesponsiblefor
200anyfeesassociatedwiththeprogramleadingtotheissuanceofthecertificate,butnothingin
201thissectionshallprohibitadistrictfromdevelopingapolicythatpermitsfeereimbursement.

203coveredemploymentwithtenormoreyearsofeducationalexperienceinanotherstateor
204statesandheldacertificateissuedbyanotherstateandsubsequentlyworkedinaschool
205districtcoveredbythepublicschoolretirementsystemofMissourifortenormoreyearswho
206laterbecamecertificatedinMissourishallhavethatcertificatedatedbacktothemember's
207originaldateofemploymentinaMissouripublicschool.
208 8.Withinthirtydaysofreceivinganapplicationfromaspouseofanactiveduty
209memberoftheArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledto
210betransferredtothestateofMissouri,orwhohasbeentransferredorisscheduledtobe
211transferredtoanadjacentstateandisorwillbedomiciledinthestateofMissouri,orhas
212movedtothestateofMissourionapermanentchange-of-stationbasisandhassuccessfully
213completedthebackgroundcheckdescribedundersubsection5ofthissectionandsection
214168.133,thestateboardshallissuetosuchapplicantafullcertificateoflicensetoteach,
215providedthattheapplicanthaspaidallnecessaryfeesandhasotherwisemetallrequirements

168.036.1.Inadditiontograntingcertificatesoflicensetoteachinpublicschoolsof
2thestateundersection168.021,thestateboardofeducationshallgrantsubstituteteacher
3certificatesasprovidedinthissectiontoanyindividualseekingtosubstituteteachinany
4publicschoolinthisstate.
5 2.(1)Thestateboardshallnotgrantacertificateoflicensetoteachunderthissection
6toanyindividualwhohasnotcompletedabackgroundcheckasrequiredundersection
7168.021.
8 (2)Thestateboardmayrefusetoissueorrenew,suspend,orrevokeanycertificate
9soughtorissuedunderthissectioninthesamemannerandforthesamereasonsasunder
10section168.071.
11 3.Thestateboardmaygrantacertificateunderthissectiontoanyindividualwhohas
12completed:
13 (1)Atleastthirty-sixsemesterhoursatanaccreditedinstitutionofhighereducation;
14or
15 (2)Thetwenty-houronlinetrainingprogramrequiredinthissectionandwho
16possessesahighschooldiplomaortheequivalentthereof.
17 4.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain
18anonlinetrainingprogramforindividuals,whichshallconsistoftwentyhoursoftraining
19relatedtosubjectsappropriateforsubstituteteachersasdeterminedbythedepartment.
20 5.Thestateboardmaygrantacertificateunderthissectiontoanyhighlyqualified
21individualwithexpertiseinatechnicalorbusinessfieldorwithexperienceintheArmed
22ForcesoftheUnitedStateswhohascompletedthebackgroundcheckrequiredinthissection

24sectionifthesuperintendentoftheschooldistrictinwhichtheindividualseekstosubstitute
25teachsponsorssuchindividualandtheschoolboardoftheschooldistrictinwhichthe
26individualseekstosubstituteteachvotestoapprovesuchindividualtosubstituteteach.
27 6.(1)Notwithstandinganyotherprovisionstocontrary,beginningonJune30,2022,
28andendingonJune30,[2025] 2030, anypersonwhoisretiredandcurrentlyreceivinga
29retirementallowanceundersections169.010to169.141orsections169.600to169.715,other
30thanfordisability,maybeemployedtosubstituteteachonapart-timeortemporarysubstitute
31basisbyanemployerincludedintheretirementsystemwithoutadiscontinuanceofthe
32person'sretirementallowance.Suchapersonshallnotcontributetotheretirementsystem,or
33tothepublicschoolretirementsystemestablishedbysections169.010to169.141ortothe
34publiceducationemployeeretirementsystemestablishedbysections169.600to169.715,
35becauseofearningsduringsuchperiodofemployment.
36 (2)Inadditiontotheconditionssetforthinsubdivision1ofthissubsection,any
37personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to
38169.141,otherthanfordisability,whoisemployedbyathirdpartyorisperformingworkas
39anindependentcontractormaybeemployedtosubstituteteachonapart-timeortemporary
40substitutebasis,ifsuchpersonisperformingworkforanemployerincludedintheretirement
41systemwithoutadiscontinuanceoftheperson'sretirementallowance.
42 (3)Ifapersonisemployedpursuanttothissubsectiononaregular,full-timebasisthe
43personshallnotbeentitledtoreceivetheperson'sretirementallowanceforanymonthduring
44whichthepersonissoemployed.Theretirementsystemmayrequiretheemployer,thethird-
45partyemployer,theindependentcontractor,andtheretireesubjecttothissubsectionto
46providedocumentationshowingcompliancewiththissubsection.Ifsuchdocumentationis
47notprovided,theretirementsystemmaydeemtheretireetohaveexceededthelimitations
48providedinthissubsection.
49 7.Acertificategrantedunderthissectionshallbevalidforfouryears.Acertificate
50grantedunderthissectionshallexpireattheendofanycalendaryearinwhichtheindividual
51failstosubstituteteachforatleastfivedaysorfortyhoursofin-seatinstruction.
52 8.(1)Anindividualtowhomthestateboardgrantsacertificateunderthissection
53maybeasubstituteteacherinapublicschoolinthestateiftheschooldistrictagreesto
54employtheindividualasasubstituteteacherandsuchindividualhascompletedabackground

67teacher'scriminalhistorybackgroundcheckandfingerprintcollection.Thetotalamountof
68anyfeesfordisseminatingsuchresultstouptofiveschooldistrictsunderthissubsectionshall

70 11.Thestateboardmayexercisetheboard'sauthorityunderchapter161to
71promulgateallnecessaryrulesandregulationsnecessaryfortheadministrationofthissection.
