67entitledtoapplytothecircuitcourthavingjurisdictioninhisorhercountyofresidenceto
68havetheresidentialaddressonhisorhervoterregistrationrecordsclosedtothepublicifthe
69releaseofsuchinformationcouldendangerthesafetyoftheperson.Anypersonworkingas
70anundercoveragentorinawitnessprotectionprogramshallalsosubmitastatementfromthe

27 3.Thesecretaryofstateshallpromulgaterulesandregulationstoallowtheuseofa
28computerizedvotingsystem.Theproceduresshallprovidefortheuseofacomputerized
29votingsystemwiththeabilitytoprovideapaperaudittrail.Notwithstandinganyprovisions
30ofthischaptertothecontrary,suchasystemmayallowforthestorageofprocessedballot
31materialsinanelectronicform.
32 4.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
33createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
34withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
35Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
36generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto
37disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
38rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2002,shallbeinvalid
39andvoid.
40 5.Ifanyelectionauthorityusesanytouchscreendirect-recordingelectronicvote-
41countingmachine,theelectionauthoritymaycontinuetousesuchmachine.Uponthe
42removalofsuchvotingmachinefromtheelectionauthority'sinventorybecauseof
43mechanicalmalfunction,wearandtear,oranyotherreason,themachineshallnotbereplaced
44andnoadditionaldirect-recordingelectronicvote-countingmachineshallbeaddedtothe
45electionauthority'sinventory.SuchmachinesshallnotbeusedbeginningJanuary1,2024.
46Equipmentthatisdesignedforaccessibilityshallprovideapaperballotaudittrail.
HB1156	5 47 6.(1)Eachelectionauthoritythatcontrolsitsowninformationtechnology
48departmentshall,onceeverytwoyears,allowacybersecurityreviewoftheirofficebythe
49secretaryofstateoralternativelybyanentitythatspecializesincybersecurityreviews.Each
50politicalsubdivisionthatcontrolstheinformationtechnologydepartmentforanelection
51authorityshall,onceeverytwoyears,allowacybersecurityreviewoftheinformation
52technologydepartmentbythesecretaryofstateoralternativelybyanentitythatspecializesin
53cybersecurityreviews.Thesecretaryofstateshall,onceeverytwoyears,allowacyber
54securityreviewofitsofficebyanentitythatspecializesincybersecurityreviews.For
55purposesofthissection,anentityspecializesincybersecurityreviewifitemploysoneor
56moreindividualswho:
57 (a)Haveatleastfiveyearsmanagementexperienceininformationsecurityorfive
58years'experienceasaninformationsecurityanalyst;
59 (b)Haveworkedinatleasttwoofthedomainslistedinparagraph(c)ofthis
60subdivisionthatarecoveredintheexamrequiredbysuchparagraph;and
61 (c)Haveattainedaninformationsecuritycertificationbypassinganexamthatcovers
62atleastthreeofthefollowingtopics:
63 a.Informationtechnologyriskmanagement,identification,mitigation,and
64compliance;
65 b.Informationsecurityincidentmanagement;
66 c.Informationsecurityprogramdevelopmentandmanagement;
67 d.Riskandcontrolmonitoringandreporting;
68 e.Accesscontrolsystemsandmethodology;
69 f.Businesscontinuityplanninganddisasterrecoveryplanning;
70 g.Physicalsecurityofelectionauthorityproperty;
71 h.Networkingsecurity;or
72 i.Securityarchitectureapplicationandsystemsdevelopment.
73 (2)Ifanelectionauthorityorpoliticalsubdivisionfailstohaveacybersecurity
74reviewasrequiredbythissubsection,thesecretaryofstatemaypublishanoticeof
75noncomplianceinanewspaperwithinthejurisdictionoftheelectionauthorityorinelectronic
76format.Thesecretaryofstateisalsoauthorizedtowithholdfundsfromanelectionauthority
77inviolationofthissectionunlesssuchfundingisafederalmandateorpartofafederaland
78stateagreement.
79 7.Thesecretaryofstateshallhaveauthoritytorequirecybersecuritytesting,
80includingpenetrationtesting,ofvendormachines,programs,andsystems.Failureto
81participateinsuchtestingshallresultinarevocationofvendorcertification.Uponnotice
82fromanotherjurisdictionofcybersecurityfailuresorcertificationwithholdsorrevocation,
83thesecretaryofstateshallhaveauthoritytorevokeorwithholdcertificationforvendors.The
HB1156	6 84requirementsofthissectionshallbesubjecttoappropriationforthepurposeofcybersecurity
85testing.
86 8.Thesecretaryofstatemaydesignateanorganizationofwhicheachelection
87authorityshallbeamember,providedthereisnomembershipfeeandtheorganization
88providesinformationtoincreasecybersecurityandelectionintegrityefforts.
89 9.Allauditsrequiredbysubsection6ofthissectionthatareconductedbythe
90secretaryofstateshallbesolelypaidforbystateandfederalfunding.
115.249.Novotingmachineshallbeusedunlessit:
2 (1)Permitsvotinginabsolutesecrecy;

115.279.1.Applicationforanabsenteeballotmaybemadebytheapplicantin
2person,orbymail,orfortheapplicant,inperson,byhisorherguardianorarelativewithin
3theseconddegreebyconsanguinityoraffinity.Theelectionauthorityshallaccept
4applicationsbyfacsimiletransmissionandbyelectronicmailwithinthelimitsofits
5telecommunicationscapacity.
6 2.Notwithstandingsection115.284,noindividual,group,orpartyshallsolicitavoter
7intoobtaininganabsenteeballotapplication.Absenteeballotapplicationsshallnothavethe
8informationprefilledpriorto[it]beingprovidedtoavoter.Nothinginthissectionshallbe
9interpretedtoprohibitastateorlocalelectionauthorityfromassistinganindividualvoter.
HB1156	7 10 3.Eachapplicationshallbemadetotheelectionauthorityofthejurisdictioninwhich
11thepersonisorwouldberegistered.Eachapplicationshallbeinwritingandshallstatethe
12applicant'sname,addressatwhichheorsheisorwouldberegistered,hisorherreasonfor
13votinganabsenteeballot,theaddresstowhichtheballotistobemailed,ifmailingis
14requested,andforabsentuniformedservicesandoverseasapplicants,theapplicant'semail
15addressifelectronictransmissionisrequested.Ifthereasonfortheapplicantvotingabsentee
16isduetothereasonsestablishedundersubdivision(6)ofsubsection3ofsection115.277,the
17applicantshallstatethevoter'sidentificationinformationprovidedbytheaddress
18confidentialityprograminlieuoftheapplicant'sname,addressatwhichheorsheisor
19wouldberegistered,andaddresstowhichtheballotistobemailed,ifmailingisrequested.
20[Eachapplicationtovoteinaprimaryelectionshallalsostatewhichballottheapplicant
21wishestoreceive.Ifanyapplicationfailstodesignateaballot,theelectionauthorityshall,

27 4.AllapplicationsforabsenteeballotsreceivedpriortothesixthTuesdaybeforean
28electionshallbestoredattheofficeoftheelectionauthorityuntilsuchtimeasthe
29applicationsareprocessedinaccordancewithsection115.281.Noapplicationforan
30absenteeballotreceivedintheofficeoftheelectionauthoritybymail,byfacsimile
31transmission,byelectronicmail,orbyaguardianorrelativeafter5:00p.m.onthesecond
32Wednesdayimmediatelypriortotheelectionshallbeacceptedbyanyelectionauthority.No
33applicationforanabsenteeballotsubmittedbytheapplicantinpersonafter5:00p.m.onthe
34daybeforetheelectionshallbeacceptedbyanyelectionauthority,exceptasprovidedin
35subsections7,8,and9ofthissection.
36 5.Eachapplicationforanabsenteeballotshallbesignedbytheapplicantor,ifthe
37applicationismadebyaguardianorrelativepursuanttothissection,theapplicationshallbe
38signedbytheguardianorrelative,whoshallnoteontheapplicationhisorherrelationshipto
39theapplicant.Ifanapplicant,guardianorrelativeisblind,unabletoreadorwritetheEnglish
40languageorphysicallyincapableofsigningtheapplication,heorsheshallsignbymark,
41witnessedbythesignatureofanelectionofficialorpersonofhisorherownchoosing.Any
42personwhoknowinglymakes,deliversormailsafraudulentabsenteeballotapplicationshall
43beguiltyofaclassoneelectionoffense.
44 6.(1)Notwithstandinganylawtothecontrary,anyresidentofthestateofMissouri
45whoresidesoutsidetheboundariesoftheUnitedStatesorwhoisonactivedutywiththe
46ArmedForcesoftheUnitedStatesormembersoftheirimmediatefamilylivingwiththem
HB1156	8 47mayrequestanabsenteeballotforboththeprimaryandsubsequentgeneralelectionwithone
48application.
49 (2)Theelectionauthorityshallprovideeachabsentuniformedservicesvoterand
50eachoverseasvoterwhosubmitsavoterregistrationapplicationoranabsenteeballotrequest,
51iftheelectionauthorityrejectstheapplicationorrequest,withthereasonsfortherejection.
52 (3)Notwithstandinganyotherlawtothecontrary,ifastandardoathregarding
53materialmisstatementsoffactisadoptedforuniformedandoverseasvoterspursuanttothe
54HelpAmericaVoteActof2002,theelectionauthorityshallacceptsuchoathforvoter
55registration,absenteeballot,orotherelection-relatedmaterials.
56 (4)Notlaterthansixtydaysafterthedateofeachregularlyscheduledgeneral
57electionforfederaloffice,eachelectionauthoritywhichadministeredtheelectionshall
58submittothesecretaryofstateinaformatprescribedbythesecretaryareportonthe
59combinednumberofabsenteeballotstransmittedto,andreturnedby,absentuniformed
60servicesvotersandoverseasvotersfortheelection.ThesecretaryshallsubmittotheElection
61AssistanceCommissionacombinedreportofsuchinformationnotlaterthanninetydaysafter
62thedateofeachregularlyscheduledgeneralelectionforfederalofficeandinastandardized
63formatdevelopedbythecommissionpursuanttotheHelpAmericaVoteActof2002.The
64secretaryshallmakethereportavailabletothegeneralpublic.

67 7.Anapplicationforanabsenteeballotbyanewresidentshallbesubmittedinperson
