Torepealsection67.307,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
municipalsanctuarypolicies,withapenaltyprovision.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section67.307,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection67.307,toreadasfollows:
67.307.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Lawenforcementofficer",asherifforpeaceofficerofamunicipalitywiththe
3dutyandpowerofarrestforviolationofthegeneralcriminallawsofthestateorforviolation
4ofordinancesofmunicipalities;
5 (2)"Municipality",anycounty,city,town,orvillage;
6 (3)"Municipalityofficial",anyelectedorappointedofficialoranylawenforcement
7officerservingthemunicipality;
8 (4)"Sanctuarypolicy",anymunicipality'sorderorordinance,enactedorfollowed
9that:
10 (a)Limitsorprohibitsanymunicipalityofficialorpersonemployedbythe
11municipalityfromcommunicatingorcooperatingwithfederalagenciesorofficialstoverify
12orreporttheimmigrationstatusofanyalienwithinsuchmunicipality;or
13 (b)Grantstoillegalalienstherighttolawfulpresenceorstatuswithinthe
14municipalityinviolationoffederallaw.
15 2.Nomunicipalityshallenactoradoptanysanctuarypolicy.Anymunicipalitythat
16enactsoradoptsasanctuarypolicyshallreceivenostatemoneysofanykindandshallbe
17ineligibleforanymoneysprovidedthroughgrantsadministeredbyanystateagencyor

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18departmentuntilthesanctuarypolicyisrepealedorisnolongerineffect.Uponthecomplaint
19ofanystateresidentregardingaspecificgovernmententity,agency,orpoliticalsubdivision
20ofthisstateorpriortotheprovisionoffundsorawardingofanygrantstoagovernment
21entity,agency,orpoliticalsubdivisionofthisstate,anymemberofthegeneralassemblymay
22requestthattheattorneygeneralofthestateofMissouriissueanopinionstatingwhetherthe
23governmententity,agency,orpoliticalsubdivisionhascurrentpoliciesincontraventionof
24thissection.
25 3.Thegoverningbody,sheriff,orchiefofpoliceofeachmunicipalityshallprovide
26eachlawenforcementofficerwithwrittennoticeoftheirdutytocooperatewithstateand
27federalagenciesandofficialsonmatterspertainingtoenforcementofstateandfederallaws
28governingimmigration.
29 4.[ThissectionshallbecomeeffectiveonJanuary1,2009] Amunicipalityofficial
30whovotesinfavorofenactingoradoptinganysanctuarypolicyprohibitedunderthis
31sectioncommitstheoffenseofhinderingprosecutionundersection575.030.
