Thisbilladdstotheoffenseofburglaryintheseconddegreewhen
apersonunlawfullyentersamotorvehicleoranypartofamotor
vehiclewiththeintenttocommitatheftoranyfelony.Thebill
defines"enters"asapersonintrudingwithanypartofthebodyor
anyphysicalobjectconnectedwiththebody.Ifapersonwho
commitsaviolationunderthisprovisionwasinpossessionofa
firearmatthetimeorstoleafirearmfromthemotorvehicle
duringtheviolation,heorsheisguiltyofaclassCfelony.
Thebillalsocreatestheoffenseofunlawfullygainingentryinto
amotorvehicle,whichapersoncommitsifheorsheliftsthedoor
handlesorotherwisetriesthedoorsandlocksofsuccessive
vehiclesinanattempttogainentry.Aviolationofthissection
isaclassEfelony.Apersondoesnotcommittheoffenseof
unlawfullygainingentryintoamotorvehicleifthepersonisthe
ownerofthevehicleorhastheowner'spermissiontoenterthe
vehicle.
