33financialresponsibilitywiththedepartmentofrevenue,inaccordancewithchapter303,the 34licenseanddrivingprivilegeshallbereinstated.Ifaperson,otherwisesubjecttothe 35provisionsofthissubsection,filesproofofinstallationwiththedepartmentofrevenuethat 36anyvehicleoperatedbysuchpersonisequippedwithafunctioning,certifiedignition 37interlockdevice,thereshallbenoperiodofsuspension.However,inlieuofasuspensionthe 38personshallinsteadcompleteaninety-dayperiodofrestricteddrivingprivilege.Iftheperson 51chapter303,or,ifapplicable,ifthepersonfailstomaintainproofthatanyvehicleoperatedis HCSHB117 2 52equippedwithafunctioning,certifiedignitioninterlockdeviceinstalledpursuantto 53subsection5ofthissection,theperson'sdrivingprivilegeandlicenseshallberesuspended. 54 7.Thedirectorshallrevokethelicenseanddrivingprivilegeofanypersonwhenthe 55person'sdrivingrecordshowssuchpersonhasaccumulatedtwelvepointsintwelvemonthsor 56eighteenpointsintwenty-fourmonthsortwenty-fourpointsinthirty-sixmonths.The 113courtifthepersonobjectstotherecommendations.Thepersonmayfileamotioninthe 114associatedivisionofthecircuitcourtofthecountyinwhichsuchassignmentwasgiven,ona 115printedformprovidedbythestatecourtsadministrator,tohavethecourthearanddetermine 116suchmotionpursuanttotheprovisionsofchapter517.Themotionshallnamethepersonor 129notbenecessaryunlessdirectedbythecourt. 130 15.Thefeesfortheprogramauthorizedinsubsection14ofthissection,oraportion 131thereoftobedeterminedbythedepartmentofmentalhealth,shallbepaidbytheperson 132enrolledintheprogram.Anypersonwhoisenrolledintheprogramshallpay,inadditionto 133anyfeechargedfortheprogram,asupplementalfeeinanamounttobedeterminedbythe 134departmentofmentalhealthforthepurposesoffundingthesubstanceabusetrafficoffender 135programdefinedinsection302.010oraprogramdeterminedtobecomparablebythe 145 16.Anyadministratorwhofailstoremittothedivisionofalcoholanddrugabuseof 146thedepartmentofmentalhealththesupplementalfeesandinterestforallpersonsenrolledin 147theprogrampursuanttothissectionshallbesubjecttoapenaltyequaltotheamountof 148interestaccruedonthesupplementalfeesduethedivisionpursuanttothissection.Ifthe 149supplementalfees,interest,andpenaltiesarenotremittedtothedivisionofalcoholanddrug 150abuseofthedepartmentofmentalhealthwithinsixmonthsoftheduedate,theattorney 16interlockdeviceonallvehiclesoperatedbythepersonasarequiredconditionofthelimited 17drivingprivilege,exceptasprovidedinsection302.441.Theserequirementsshallbein 18additiontoanyotherprovisionsofthischapterorchapter577requiringinstallationand HCSHB117 6 19maintenanceofanignitioninterlockdevice.Anypersonrequiredtouseanignitioninterlock 20deviceshallcomplywithsuchrequirementsubjecttothepenaltiesprovidedbysection 21577.599. 302.525.1.Thelicensesuspensionorrevocationshallbecomeeffectivefifteendays 2afterthesubjectpersonhasreceivedthenoticeofsuspensionorrevocationasprovidedin 3section302.520,orisdeemedtohavereceivedthenoticeofsuspensionorrevocationbymail 4asprovidedinsection302.515.Ifarequestforahearingisreceivedbyorpostmarkedtothe 5departmentwithinthatfifteen-dayperiod,theeffectivedateofthesuspensionorrevocation 6shallbestayeduntilafinalorderisissuedfollowingthehearing;provided,thatanydelayin 7thehearingwhichiscausedorrequestedbythesubjectpersonorcounselrepresentingthat 16drivingprivilegeshallnotbeissueduntilheorshehasfiledproofoffinancialresponsibility 17withthedepartmentofrevenue,inaccordancewithchapter303,andisotherwiseeligible. 18Therestricteddrivingprivilegeshallindicate[whether] thatafunctioning,certifiedignition 19interlockdeviceisrequiredasaconditionofoperatingamotorvehicle.Acopyofthe 20restricteddrivingprivilegeshallbegiventothepersonandsuchpersonshallcarryacopyof 21therestricteddrivingprivilegewhileoperatingamotorvehicle.Innocaseshallrestricted 22drivingprivilegesbeissuedpursuanttothissectionorsection302.535untilthepersonhas 23completedthefirstthirtydaysofasuspensionunderthissection.Ifapersonotherwise 24subjecttotheprovisionsofthissubdivisionfilesproofofinstallationwiththedepartmentof 25revenuethatanyvehiclethatheorsheoperatesisequippedwithafunctioning,certified 26ignitioninterlockdevice,thereshallbenoperiodofsuspension.However,inlieuofa 27suspensionthepersonshallinsteadcompleteaninety-dayperiodofrestricteddriving 28privilege.Uponcompletionofsuchninety-dayperiodofrestricteddrivingprivilege, 29compliancewithotherrequirementsoflaw,andfilingofproofoffinancialresponsibilitywith 30thedepartmentofrevenue,inaccordancewithchapter303,thelicenseanddrivingprivilege 31shallbereinstated.However,ifthemonthlymonitoringreportsduringsuchninety-day 32periodindicatethattheignitioninterlockdevicehasregisteredaconfirmedbloodalcohol 33concentrationlevelabovethealcoholsetpointestablishedbythedepartmentoftransportation 34orsuchreportsindicatethattheignitioninterlockdevicehasbeentamperedwithor HCSHB117 7 35circumvented,thenthelicenseanddrivingprivilegeofsuchpersonshallnotbereinstated 36untilthepersoncompletesanadditionalthirty-dayperiodofrestricteddrivingprivilege.If 37thepersonfailstomaintainsuchproofofthedevicewiththedirectorofrevenueasrequired, 53revocationenteredinthisoranyotherstateforarefusaltosubmittochemicaltestingunder 54animpliedconsentlaw,andanyconvictioninthisoranyotherstateforaviolationwhich 55involvesdrivingwhileintoxicated,drivingwhileundertheinfluenceofdrugsoralcohol,or 56drivingavehiclewhilehavinganunlawfulalcoholconcentration. 57 4.Wherealicenseissuspendedorrevokedunderthissectionandthepersonisalso 58convictedonchargesarisingoutofthesameoccurrenceforaviolationofsection577.010or 59577.012orforaviolationofanycountyormunicipalordinanceprohibitingdrivingwhile 60intoxicatedoralcohol-relatedtrafficoffense,boththesuspensionorrevocationunderthis 61sectionandanyothersuspensionorrevocationarisingfromsuchconvictionsshallbe 62imposed,buttheperiodofsuspensionorrevocationundersections302.500to302.540shall 63becreditedagainstanyothersuspensionorrevocationarisingfromsuchconvictions,andthe 64totalperiodofsuspensionorrevocationshallnotexceedthelongerofthetwosuspensionor 65revocationperiods. 66 5.Anypersonwhohashadalicensetooperateamotorvehiclerevokedunderthis 67sectionorsuspendedunderthissectionwithoneormoreprioralcohol-relatedenforcement 68contactsoraconvictionforanintoxication-relatedtrafficoffense,asdefinedunder 69section577.001,inwhichtheperson'sbloodalcoholcontentwasfoundtobefifteen- 70hundredthsofonepercentormorebyweightofalcoholinsuchperson'sbloodshowing 71ontheirdriverrecordshallberequiredtofileproofwiththedirectorofrevenuethatany HCSHB117 8 72motorvehicleoperatedbythatpersonisequippedwithafunctioning,certifiedignition 73interlockdeviceasarequiredconditionofreinstatement.Theignitioninterlockdeviceshall 74furtherberequiredtobemaintainedonallmotorvehiclesoperatedbythepersonforaperiod 75ofnotlessthansixmonthsimmediatelyfollowingthedateofreinstatement.Ifthemonthly 76monitoringreportsshowthattheignitioninterlockdevicehasregisteredanyconfirmedblood 77alcoholconcentrationreadingsabovethealcoholsetpointestablishedbythedepartmentof 78transportationorthatthepersonhastamperedwithorcircumventedtheignitioninterlock 79devicewithinthelastthreemonthsofthesix-monthperiodofrequiredinstallationofthe 80ignitioninterlockdevice,thentheperiodforwhichthepersonmustmaintaintheignition 81interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas 82completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe 83personfailstomaintainsuchproofwiththedirector,thelicenseshallbesuspendedor 84revoked,untilproofasrequiredbythissectionisfiledwiththedirector,andthepersonshall 85beguiltyofaclassAmisdemeanor. 302.574.1.Ifapersonwhowasoperatingavehiclerefusesupontherequestofthe 2officertosubmittoanychemicaltestundersection577.041,theofficershall,onbehalfofthe 3directorofrevenue,servethenoticeoflicenserevocationpersonallyuponthepersonand 4shalltakepossessionofanylicensetooperateavehicleissuedbythisstatewhichisheldby 5thatperson.Theofficershallissueatemporarypermit,onbehalfofthedirectorofrevenue, 6whichisvalidforfifteendaysandshallalsogivethepersonnoticeofhisorherrighttofilea 7petitionforreviewtocontestthelicenserevocation. 8 2.Suchofficershallmakeacertifiedreportunderpenaltiesofperjuryformakinga 9falsestatementtoapublicofficial.Thereportshallbeforwardedtothedirectorofrevenue 10andshallincludethefollowing: 11 (1)Thattheofficerhas: 12 (a)Reasonablegroundstobelievethatthearrestedpersonwasdrivingamotor 13vehiclewhileinanintoxicatedcondition;or 14 (b)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 15twenty-oneyears,wasdrivingamotorvehiclewithabloodalcoholcontentoftwo- 16hundredthsofonepercentormorebyweight;or 17 (c)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 18twenty-oneyears,wascommittingaviolationofthetrafficlawsofthestate,orpolitical 19subdivisionofthestate,andsuchofficerhasreasonablegroundstobelieve,aftermakingsuch 20stop,thatthepersonhadabloodalcoholcontentoftwo-hundredthsofonepercentorgreater; 21 (2)Thatthepersonrefusedtosubmittoachemicaltest; 22 (3)Whethertheofficersecuredthelicensetooperateamotorvehicleoftheperson; 23 (4)Whethertheofficerissuedafifteen-daytemporarypermit; HCSHB117 9 24 (5)Copiesofthenoticeofrevocation,thefifteen-daytemporarypermit,andthe 25noticeoftherighttofileapetitionforreview.Thenoticesandpermitmaybecombinedin 26onedocument;and 27 (6)Anylicense,whichtheofficerhastakenintopossession,tooperateamotor 28vehicle. 29 3.Uponreceiptoftheofficer'sreport,thedirectorshallrevokethelicenseofthe 30personrefusingtotakethetestforaperiodofoneyear;orifthepersonisanonresident,such 31person'soperatingpermitorprivilegeshallberevokedforoneyear;orifthepersonisa 32residentwithoutalicenseorpermittooperateamotorvehicleinthisstate,anordershallbe 33issueddenyingthepersontheissuanceofalicenseorpermitforaperiodofoneyear. 34 4.Ifaperson'slicensehasbeenrevokedbecauseoftheperson'srefusaltosubmittoa 35chemicaltest,suchpersonmaypetitionforahearingbeforeacircuitdivisionorassociate 36divisionofthecourtinthecountyinwhichthearrestorstopoccurred.Pursuanttolocalcourt 37rulepromulgatedpursuanttoSection15ofArticleVoftheMissouriConstitution,thecase 38mayalsobeassignedtoatrafficjudgepursuanttosection479.500.Thepersonmayrequest 39suchcourttoissueanorderstayingtherevocationuntilsuchtimeasthepetitionforreview 40canbeheard.Ifthecourt,initsdiscretion,grantssuchstay,itshallentertheorderupona 41formprescribedbythedirectorofrevenueandshallsendacopyofsuchordertothedirector. 42Suchordershallserveasproofoftheprivilegetooperateamotorvehicleinthisstateandthe 43directorshallmaintainpossessionoftheperson'slicensetooperateamotorvehicleuntil 44terminationofanyrevocationunderthissection.Upontheperson'srequest,theclerkofthe 45courtshallnotifytheprosecutingattorneyofthecountyandtheprosecutorshallappearatthe 46hearingonbehalfofthedirectorofrevenue.Atthehearing,thecourtshalldetermineonly: 47 (1)Whetherthepersonwasarrestedorstopped; 48 (2)Whethertheofficerhad: 49 (a)Reasonablegroundstobelievethatthepersonwasdrivingamotorvehiclewhile 50inanintoxicatedordruggedcondition;or 51 (b)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 52twenty-oneyears,wasdrivingamotorvehiclewithabloodalcoholcontentoftwo- 53hundredthsofonepercentormorebyweight;or 54 (c)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof 55twenty-oneyears,wascommittingaviolationofthetrafficlawsofthestate,orpolitical 56subdivisionofthestate,andsuchofficerhadreasonablegroundstobelieve,aftermakingsuch 57stop,thatthepersonhadabloodalcoholcontentoftwo-hundredthsofonepercentorgreater; 58and 59 (3)Whetherthepersonrefusedtosubmittothetest. 67insection302.010,oraprogramdeterminedtobecomparablebythedepartmentofmental 68health.Assignmentrecommendations,basedupontheneedsassessmentasdescribedin 69subdivision(24)ofsection302.010,shallbedeliveredinwritingtothepersonwithwritten 70noticethatthepersonisentitledtohavesuchassignmentrecommendationsreviewedbythe 71courtifthepersonobjectstotherecommendations.Thepersonmayfileamotioninthe 72associatedivisionofthecircuitcourtofthecountyinwhichsuchassignmentwasgiven,ona 73printedformprovidedbythestatecourtsadministrator,tohavethecourthearanddetermine 74suchmotionundertheprovisionsofchapter517.Themotionshallnamethepersonorentity 75makingtheneedsassessmentastherespondentandacopyofthemotionshallbeservedupon 76therespondentinanymannerallowedbylaw.Uponhearingthemotion,thecourtmay 77modifyorwaiveanyassignmentrecommendationthatthecourtdeterminestobeunwarranted 78baseduponareviewoftheneedsassessment,theperson'sdrivingrecord,thecircumstances 79surroundingtheoffense,andthelikelihoodofthepersoncommittingasimilaroffenseinthe 80future,exceptthatthecourtmaymodifybutshallnotwaivetheassignmenttoaneducationor 81rehabilitationprogramofapersondeterminedtobeapriororpersistentoffenderasdefinedin 82section577.001,orofapersondeterminedtohaveoperatedamotorvehiclewithablood 83alcoholcontentoffifteen-hundredthsofonepercentormorebyweight.Compliancewiththe 84courtdeterminationofthemotionshallsatisfytheprovisionsofthissectionforthepurposeof 85reinstatingsuchperson'slicensetooperateamotorvehicle.Therespondent'spersonal 86appearanceatanyhearingconductedunderthissubsectionshallnotbenecessaryunless 87directedbythecourt. 88 8.Thefeesforthesubstanceabusetrafficoffenderprogram,oraportionthereof,to 89bedeterminedbythedivisionofbehavioralhealthofthedepartmentofmentalhealth,shall 90bepaidbythepersonenrolledintheprogram.Anypersonwhoisenrolledintheprogram 91shallpay,inadditiontoanyfeechargedfortheprogram,asupplementalfeetobedetermined 92bythedepartmentofmentalhealthforthepurposesoffundingthesubstanceabusetraffic 93offenderprogramdefinedinsection302.010.Theadministratoroftheprogramshallremitto 94thedivisionofbehavioralhealthofthedepartmentofmentalhealthonorbeforethefifteenth 95dayofeachmonththesupplementalfeeforallpersonsenrolledintheprogram,lesstwo 96percentforadministrativecosts.Interestshallbechargedonanyunpaidbalanceofthe HCSHB117 11 97supplementalfeesduetothedivisionofbehavioralhealthunderthissection,andshallaccrue 98ataratenottoexceedtheannualratesestablishedundertheprovisionsofsection32.065,plus 99threepercentagepoints.Thesupplementalfeesandanyinterestreceivedbythedepartment 100ofmentalhealthunderthissectionshallbedepositedinthementalhealthearningsfund, 101whichiscreatedinsection630.053. 102 9.Anyadministratorwhofailstoremittothedivisionofbehavioralhealthofthe 103departmentofmentalhealththesupplementalfeesandinterestforallpersonsenrolledinthe 104programunderthissectionshallbesubjecttoapenaltyequaltotheamountofinterest 105accruedonthesupplementalfeesduetothedivisionunderthissection.Ifthesupplemental 106fees,interest,andpenaltiesarenotremittedtothedivisionofbehavioralhealthofthe 107departmentofmentalhealthwithinsixmonthsoftheduedate,theattorneygeneralofthe 108stateofMissourishallinitiateappropriateactionforthecollectionofsaidfeesandaccrued 109interest.Thecourtshallassessattorneys'feesandcourtcostsagainstanydelinquentprogram. 110 10.Anypersonwhohashadalicensetooperateamotorvehiclerevokedunderthis 111sectionandwhohasaprioralcohol-relatedenforcementcontact,asdefinedinsection 112302.525,orwhohasbeenconvictedofanintoxication-relatedtrafficoffense,asdefined 113undersection577.001,inwhichtheperson'sbloodalcoholcontentwasfoundtobe 114fifteen-hundredthsofonepercentormorebyweightofalcoholinsuchperson'sblood 115shallberequiredtofileproofwiththedirectorofrevenuethatanymotorvehicleoperatedby 116thepersonisequippedwithafunctioning,certifiedignitioninterlockdeviceasarequired 117conditionoflicensereinstatement.Suchignitioninterlockdeviceshallfurtherberequiredto 118bemaintainedonallmotorvehiclesoperatedbythepersonforaperiodofnotlessthansix 119monthsimmediatelyfollowingthedateofreinstatement.Ifthemonthlymonitoringreports 120showthattheignitioninterlockdevicehasregisteredanyconfirmedbloodalcohol 121concentrationreadingsabovethealcoholsetpointestablishedbythedepartmentof 122transportationorthatthepersonhastamperedwithorcircumventedtheignitioninterlock 123devicewithinthelastthreemonthsofthesix-monthperiodofrequiredinstallationofthe 124ignitioninterlockdevice,thentheperiodforwhichthepersonshallmaintaintheignition 125interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas 126completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe 127personfailstomaintainsuchproofwiththedirectorasrequiredbythissection,thelicense 128shallbererevokeduntilproofasrequiredbythissectionisfiledwiththedirector,andthe 129personshallbeguiltyofaclassAmisdemeanor. 130 11.Therevocationperiodofanypersonwhoselicenseanddrivingprivilegehasbeen 131revokedunderthissectionandwhohasfiledproofoffinancialresponsibilitywiththe 132departmentofrevenueinaccordancewithchapter303andisotherwiseeligibleshallbe 133terminatedbyanoticefromthedirectorofrevenueafteroneyearfromtheeffectivedateof HCSHB117 12 134therevocation.Unlessproofoffinancialresponsibilityisfiledwiththedepartmentof 135revenue,therevocationshallremainineffectforaperiodoftwoyearsfromitseffectivedate. 136Ifthepersonfailstomaintainproofoffinancialresponsibilityinaccordancewithchapter303, 137theperson'slicenseanddrivingprivilegeshallbererevoked. 138 12.ApersoncommitstheoffenseoffailuretomaintainproofwiththeMissouri 139departmentofrevenueif,whenrequiredtodoso,heorshefailstofileproofwiththedirector 140ofrevenuethatanyvehicleoperatedbythepersonisequippedwithafunctioning,certified 141ignitioninterlockdeviceorfailstofileproofoffinancialresponsibilitywiththedepartmentof 142revenueinaccordancewithchapter303.Theoffenseoffailuretomaintainproofwiththe 143MissouridepartmentofrevenueisaclassAmisdemeanor. 569.170.1.Apersoncommitstheoffenseofburglaryintheseconddegreewhenhe 2orsheknowingly: 3 (1)Entersunlawfullyorknowinglyremainsunlawfullyinabuildingorinhabitable 4structureforthepurposeofcommittingacrimetherein; or 5 (2)Entersunlawfullyintoamotorvehicleoranypartofamotorvehiclewiththe 6intenttocommitanyfelonyortheft.Asusedinthissubdivision,"enters"meansa 7personintrudeswith: 8 (a)Anypartofthebody;or 9 (b)Anyphysicalobjectconnectedwiththebody. 10 2.TheoffenseofburglaryintheseconddegreeisaclassDfelonyunlesscommitted 11undersubdivision(2)ofsubsection1ofthissectionandthepersonwasinpossessionofa 12firearmorstoleafirearmfromthemotorvehicleinwhichcaseitisaclassCfelony. 569.175.1.Apersoncommitstheoffenseofunlawfullygainingentryintomotor 2vehiclesifthepersonliftsthedoorhandlesorotherwisetriesthedoorsandlocksof 3successivemotorvehiclestogainentryintothemotorvehiclesunlessthepersonisthe
