SectionA.Sections302.304,302.440,302.525,302.574,and569.170,RSMo,are
2repealedandsixnewsectionsenactedinlieuthereof,tobeknownassections302.304,
3302.440,302.525,302.574,569.170,and569.175,toreadasfollows:
302.304.1.Thedirectorshallnotifybyordinarymailanyoperatorofthepointvalue
2chargedagainsttheoperator'srecordwhentherecordshowsfourormorepointshavebeen
3accumulatedinatwelve-monthperiod.
4 2.Inanactiontosuspendorrevokealicenseordrivingprivilegeunderthissection
5pointsshallbeaccumulatedonthedateofconviction.Nocasefileofanyconvictionfora
6drivingviolationforwhichpointsmaybeassessedpursuanttosection302.302maybeclosed
7untilsuchtimeasacopyoftherecordofsuchconvictionisforwardedtothedepartmentof
8revenue.
9 3.Thedirectorshallsuspendthelicenseanddrivingprivilegesofanypersonwhose
10drivingrecordshowsthedriverhasaccumulatedeightpointsineighteenmonths.
11 4.Thelicenseanddrivingprivilegeofanypersonwhoselicenseanddrivingprivilege
12havebeensuspendedundertheprovisionsofsections302.010to302.540exceptthose
13personswhoselicenseanddrivingprivilegehavebeensuspendedundertheprovisionsof
14subdivision(8)ofsubsection1ofsection302.302orhasaccumulatedsufficientpoints
15togetherwithaconvictionundersubdivision(10)ofsubsection1ofsection302.302andwho

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16hasfiledproofoffinancialresponsibilitywiththedepartmentofrevenue,inaccordancewith
17chapter303,andisotherwiseeligible,shallbereinstatedasfollows:
18 (1)Inthecaseofaninitialsuspension,thirtydaysaftertheeffectivedateofthe
19suspension;
20 (2)Inthecaseofasecondsuspension,sixtydaysaftertheeffectivedateofthe
21suspension;
22 (3)Inthecaseofthethirdandsubsequentsuspensions,ninetydaysaftertheeffective
23dateofthesuspension.

25Unlessproofoffinancialresponsibilityisfiledwiththedepartmentofrevenue,asuspension
26shallcontinueineffectfortwoyearsfromitseffectivedate.
27 5.Theperiodofsuspensionofthedriver'slicenseanddrivingprivilegeofanyperson
28undertheprovisionsofsubdivision(8)ofsubsection1ofsection302.302orwhohas
29accumulatedsufficientpointstogetherwithaconvictionundersubdivision(10)ofsubsection
301ofsection302.302shallbethirtydays,followedbyasixty-dayperiodofrestricteddriving
31privilegeasdefinedinsection302.010.Uponcompletionofsuchperiodofrestricteddriving
32privilege,uponcompliancewithotherrequirementsoflawanduponfilingofproofof
33financialresponsibilitywiththedepartmentofrevenue,inaccordancewithchapter303,the
34licenseanddrivingprivilegeshallbereinstated.Ifaperson,otherwisesubjecttothe
35provisionsofthissubsection,filesproofofinstallationwiththedepartmentofrevenuethat
36anyvehicleoperatedbysuchpersonisequippedwithafunctioning,certifiedignition
37interlockdevice,thereshallbenoperiodofsuspension.However,inlieuofasuspensionthe
38personshallinsteadcompleteaninety-dayperiodofrestricteddrivingprivilege.Iftheperson
39failstomaintainsuchproofofthedevicewiththedirectorofrevenueasrequired,the
40restricteddrivingprivilegeshallbeterminated.Uponcompletionofsuchninety-dayperiod
41ofrestricteddrivingprivilege,uponcompliancewithotherrequirementsoflaw,andupon
42filingofproofoffinancialresponsibilitywiththedepartmentofrevenue,inaccordancewith
43chapter303,thelicenseanddrivingprivilegeshallbereinstated.However,ifthemonthly
44monitoringreportsduringsuchninety-dayperiodindicatethattheignitioninterlockdevice
45hasregisteredaconfirmedbloodalcoholconcentrationlevelabovethealcoholsetpoint
46establishedbythedepartmentoftransportationorsuchreportsindicatethattheignition
47interlockdevicehasbeentamperedwithorcircumvented,thenthelicenseanddriving
48privilegeofsuchpersonshallnotbereinstateduntilthepersoncompletesanadditionalthirty-
49dayperiodofrestricteddrivingprivilege.
50 6.Ifthepersonfailstomaintainproofoffinancialresponsibilityinaccordancewith
51chapter303,or,ifapplicable,ifthepersonfailstomaintainproofthatanyvehicleoperatedis
HCSHB117	2 52equippedwithafunctioning,certifiedignitioninterlockdeviceinstalledpursuantto
53subsection5ofthissection,theperson'sdrivingprivilegeandlicenseshallberesuspended.
54 7.Thedirectorshallrevokethelicenseanddrivingprivilegeofanypersonwhenthe
55person'sdrivingrecordshowssuchpersonhasaccumulatedtwelvepointsintwelvemonthsor
56eighteenpointsintwenty-fourmonthsortwenty-fourpointsinthirty-sixmonths.The
57revocationperiodofanypersonwhoselicenseanddrivingprivilegehavebeenrevokedunder
58theprovisionsofsections302.010to302.540andwhohasfiledproofoffinancial
59responsibilitywiththedepartmentofrevenueinaccordancewithchapter303andisotherwise
60eligible,shallbeterminatedbyanoticefromthedirectorofrevenueafteroneyearfromthe
61effectivedateoftherevocation.Unlessproofoffinancialresponsibilityisfiledwiththe
62departmentofrevenue,exceptasprovidedinsubsection2ofsection302.541,therevocation
63shallremainineffectforaperiodoftwoyearsfromitseffectivedate.Ifthepersonfailsto
64maintainproofoffinancialresponsibilityinaccordancewithchapter303,theperson'slicense
65anddrivingprivilegeshallbererevoked.Anypersonwhoselicenseanddrivingprivilege
66havebeenrevokedundertheprovisionsofsections302.010to302.540shall,uponreceiptof
67thenoticeofterminationoftherevocationfromthedirector,passthecompletedriver
68examinationandapplyforanewlicensebeforeagainoperatingamotorvehicleuponthe
69highwaysofthisstate.
70 8.If,priortoconvictionforanoffensethatwouldrequiresuspensionorrevocationof
71aperson'slicenseundertheprovisionsofthissection,theperson'stotalpointsaccumulated
72arereduced,pursuanttotheprovisionsofsection302.306,belowthenumberofpoints
73requiredforsuspensionorrevocationpursuanttotheprovisionsofthissection,thenthe
74person'slicenseshallnotbesuspendedorrevokeduntilthenecessarypointsareagain
75obtainedandaccumulated.
76 9.Ifanypersonshallneglectorrefusetosurrendertheperson'slicense,asprovided
77herein,thedirectorshalldirectthestatehighwaypatroloranypeaceorpoliceofficerto
78securepossessionthereofandreturnittothedirector.
79 10.Upontheissuanceofareinstatementorterminationnoticeafterasuspensionor
80revocationofanyperson'slicenseanddrivingprivilegeundertheprovisionsofsections
81302.010to302.540,theaccumulatedpointvalueshallbereducedtofourpoints,exceptthat
82thepointsofanypersonservingasamemberoftheArmedForcesoftheUnitedStates
83outsidethelimitsoftheUnitedStatesduringaperiodofsuspensionorrevocationshallbe
84reducedtozerouponthedateofthereinstatementorterminationofnotice.Itshallbethe
85responsibilityofsuchmemberoftheArmedForcestosubmitcopiesofofficialorderstothe
86directorofrevenuetosubstantiatesuchoverseasservice.Anyotherprovisionofsections
87302.010to302.540tothecontrarynotwithstanding,theeffectivedateofthefourpoints

90 11.Nocredittowardreductionofpointsshallbegivenduringperiodsofsuspension
91orrevocationoranyperiodofdrivingunderalimiteddrivingprivilegegrantedbyacourtor
92thedirectorofrevenue.
93 12.Anypersonornonresidentwhoselicenseorprivilegetooperateamotorvehicle
94inthisstatehasbeensuspendedorrevokedunderthisoranyotherlawshall,beforehaving
95thelicenseorprivilegetooperateamotorvehiclereinstated,paytothedirectora
96reinstatementfeeoftwentydollarswhichshallbeinadditiontoallotherfeesprovidedby
97law.
98 13.Notwithstandinganyotherprovisionoflawtothecontrary,ifaftertwoyearsfrom
99theeffectivedateofanysuspensionorrevocationissuedunderthischapter,exceptany
100suspensionorrevocationissuedundersection302.410,302.462,or302.574,thepersonor
101nonresidenthasnotpaidthereinstatementfeeoftwentydollars,thedirectorshallreinstate
102suchlicenseorprivilegetooperateamotorvehicleinthisstate.Anypersonwhohashadhis
103orherlicensesuspendedorrevokedundersection302.410,302.462,or302.574,shallbe
104requiredtopaythereinstatementfee.
105 14.Nopersonwhohashadalicensetooperateamotorvehiclesuspendedorrevoked
106asaresultofanassessmentofpointsforaviolationundersubdivision(8),(9)or(10)of
107subsection1ofsection302.302shallhavethatlicensereinstateduntilsuchpersonhas
108participatedinandsuccessfullycompletedasubstanceabusetrafficoffenderprogramdefined
109insection302.010,oraprogramdeterminedtobecomparablebythedepartmentofmental
110health.Assignmentrecommendations,basedupontheneedsassessmentasdescribedin
111subdivision(24)ofsection302.010,shallbedeliveredinwritingtothepersonwithwritten
112noticethatthepersonisentitledtohavesuchassignmentrecommendationsreviewedbythe
113courtifthepersonobjectstotherecommendations.Thepersonmayfileamotioninthe
114associatedivisionofthecircuitcourtofthecountyinwhichsuchassignmentwasgiven,ona
115printedformprovidedbythestatecourtsadministrator,tohavethecourthearanddetermine
116suchmotionpursuanttotheprovisionsofchapter517.Themotionshallnamethepersonor
117entitymakingtheneedsassessmentastherespondentandacopyofthemotionshallbe
118servedupontherespondentinanymannerallowedbylaw.Uponhearingthemotion,the
119courtmaymodifyorwaiveanyassignmentrecommendationthatthecourtdeterminestobe
120unwarrantedbaseduponareviewoftheneedsassessment,theperson'sdrivingrecord,the
121circumstancessurroundingtheoffense,andthelikelihoodofthepersoncommittingalike
122offenseinthefuture,exceptthatthecourtmaymodifybutmaynotwaivetheassignmentto
123aneducationorrehabilitationprogramofapersondeterminedtobeapriororpersistent
124offenderasdefinedinsection577.001orofapersondeterminedtohaveoperatedamotor

126Compliancewiththecourtdeterminationofthemotionshallsatisfytheprovisionsofthis
127sectionforthepurposeofreinstatingsuchperson'slicensetooperateamotorvehicle.The
128respondent'spersonalappearanceatanyhearingconductedpursuanttothissubsectionshall
129notbenecessaryunlessdirectedbythecourt.
130 15.Thefeesfortheprogramauthorizedinsubsection14ofthissection,oraportion
131thereoftobedeterminedbythedepartmentofmentalhealth,shallbepaidbytheperson
132enrolledintheprogram.Anypersonwhoisenrolledintheprogramshallpay,inadditionto
133anyfeechargedfortheprogram,asupplementalfeeinanamounttobedeterminedbythe
134departmentofmentalhealthforthepurposesoffundingthesubstanceabusetrafficoffender
135programdefinedinsection302.010oraprogramdeterminedtobecomparablebythe
136departmentofmentalhealth.Theadministratoroftheprogramshallremittothedivisionof
137alcoholanddrugabuseofthedepartmentofmentalhealthonorbeforethefifteenthdayof
138eachmonththesupplementalfeeforallpersonsenrolledintheprogram,lesstwopercentfor
139administrativecosts.Interestshallbechargedonanyunpaidbalanceofthesupplementalfees
140duethedivisionofalcoholanddrugabusepursuanttothissectionandshallaccrueatarate
141nottoexceedtheannualrateestablishedpursuanttotheprovisionsofsection32.065,plus
142threepercentagepoints.Thesupplementalfeesandanyinterestreceivedbythedepartment
143ofmentalhealthpursuanttothissectionshallbedepositedinthementalhealthearningsfund
144whichiscreatedinsection630.053.
145 16.Anyadministratorwhofailstoremittothedivisionofalcoholanddrugabuseof
146thedepartmentofmentalhealththesupplementalfeesandinterestforallpersonsenrolledin
147theprogrampursuanttothissectionshallbesubjecttoapenaltyequaltotheamountof
148interestaccruedonthesupplementalfeesduethedivisionpursuanttothissection.Ifthe
149supplementalfees,interest,andpenaltiesarenotremittedtothedivisionofalcoholanddrug
150abuseofthedepartmentofmentalhealthwithinsixmonthsoftheduedate,theattorney
151generalofthestateofMissourishallinitiateappropriateactionofthecollectionofsaidfees
152andinterestaccrued.Thecourtshallassessattorneyfeesandcourtcostsagainstany
153delinquentprogram.
154 17.Anypersonwhohashadalicensetooperateamotorvehiclesuspendedor

175ignitioninterlockdevice,thentheperiodforwhichthepersonmustmaintaintheignition
176interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas
177completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe
178personfailstomaintainsuchproofwiththedirector,thelicenseshallberesuspendedor
179revokedandthepersonshallbeguiltyofaclassAmisdemeanor.
302.440.Inadditiontoanyotherprovisionsoflaw,acourtmayrequirethatany
2personwhoisfoundguiltyofafirstintoxication-relatedtrafficoffense,asdefinedinsection
3577.001,andacourtshallrequirethatanypersonwhoisfoundguiltyofasecondor
4subsequentintoxication-relatedtrafficoffense,asdefinedinsection577.001,oranyperson
5whoisfoundguiltyofanintoxication-relatedtrafficoffense,asdefinedundersection
6577.001,inwhichtheperson'sbloodalcoholcontentwasfoundtobefifteen-hundredths
7ofonepercentormorebyweightofalcoholinsuchperson'sbloodshallnotoperateany
8motorvehicleunlessthatvehicleisequippedwithafunctioning,certifiedignitioninterlock
9devicethatthepersonmustuseforaperiodofnotlessthansixmonthsfromthedateof
10reinstatementoftheperson'sdriver'slicense.Inaddition,anycourtauthorizedtogranta
11limiteddrivingprivilegeundersection302.309toanypersonwhoisfoundguiltyofasecond
12orsubsequentintoxication-relatedtrafficoffenseortoanypersonwhoisfoundguiltyofan
13intoxication-relatedtrafficoffense,asdefinedundersection577.001,inwhichthe
14person'sbloodalcoholcontentwasfoundtobefifteen-hundredthsofonepercentor
15morebyweightofalcoholinsuchperson'sbloodshallrequiretheuseofanignition
16interlockdeviceonallvehiclesoperatedbythepersonasarequiredconditionofthelimited
17drivingprivilege,exceptasprovidedinsection302.441.Theserequirementsshallbein
18additiontoanyotherprovisionsofthischapterorchapter577requiringinstallationand

20deviceshallcomplywithsuchrequirementsubjecttothepenaltiesprovidedbysection
21577.599.
302.525.1.Thelicensesuspensionorrevocationshallbecomeeffectivefifteendays
2afterthesubjectpersonhasreceivedthenoticeofsuspensionorrevocationasprovidedin
3section302.520,orisdeemedtohavereceivedthenoticeofsuspensionorrevocationbymail
4asprovidedinsection302.515.Ifarequestforahearingisreceivedbyorpostmarkedtothe
5departmentwithinthatfifteen-dayperiod,theeffectivedateofthesuspensionorrevocation
6shallbestayeduntilafinalorderisissuedfollowingthehearing;provided,thatanydelayin
7thehearingwhichiscausedorrequestedbythesubjectpersonorcounselrepresentingthat
8personwithoutgoodcauseshownshallnotresultinastayofthesuspensionorrevocation
9duringtheperiodofdelay.
10 2.Theperiodoflicensesuspensionorrevocationunderthissectionshallbeas
11follows:
12 (1)Iftheperson'sdrivingrecordshowsnoprioralcohol-relatedenforcementcontacts
13duringtheimmediatelyprecedingfiveyears,theperiodofsuspensionshallbethirtydays
14aftertheeffectivedateofsuspension,followedbyasixty-dayperiodofrestricteddriving
15privilegeasdefinedinsection302.010andissuedbythedirectorofrevenue.Therestricted
16drivingprivilegeshallnotbeissueduntilheorshehasfiledproofoffinancialresponsibility
17withthedepartmentofrevenue,inaccordancewithchapter303,andisotherwiseeligible.
18Therestricteddrivingprivilegeshallindicate[whether] thatafunctioning,certifiedignition
19interlockdeviceisrequiredasaconditionofoperatingamotorvehicle.Acopyofthe
20restricteddrivingprivilegeshallbegiventothepersonandsuchpersonshallcarryacopyof
21therestricteddrivingprivilegewhileoperatingamotorvehicle.Innocaseshallrestricted
22drivingprivilegesbeissuedpursuanttothissectionorsection302.535untilthepersonhas
23completedthefirstthirtydaysofasuspensionunderthissection.Ifapersonotherwise
24subjecttotheprovisionsofthissubdivisionfilesproofofinstallationwiththedepartmentof
25revenuethatanyvehiclethatheorsheoperatesisequippedwithafunctioning,certified
26ignitioninterlockdevice,thereshallbenoperiodofsuspension.However,inlieuofa
27suspensionthepersonshallinsteadcompleteaninety-dayperiodofrestricteddriving
28privilege.Uponcompletionofsuchninety-dayperiodofrestricteddrivingprivilege,
29compliancewithotherrequirementsoflaw,andfilingofproofoffinancialresponsibilitywith
30thedepartmentofrevenue,inaccordancewithchapter303,thelicenseanddrivingprivilege
31shallbereinstated.However,ifthemonthlymonitoringreportsduringsuchninety-day
32periodindicatethattheignitioninterlockdevicehasregisteredaconfirmedbloodalcohol
33concentrationlevelabovethealcoholsetpointestablishedbythedepartmentoftransportation
34orsuchreportsindicatethattheignitioninterlockdevicehasbeentamperedwithor
HCSHB117	7 35circumvented,thenthelicenseanddrivingprivilegeofsuchpersonshallnotbereinstated
36untilthepersoncompletesanadditionalthirty-dayperiodofrestricteddrivingprivilege.If
37thepersonfailstomaintainsuchproofofthedevicewiththedirectorofrevenueasrequired,
38therestricteddrivingprivilegeshallbeterminated;
39 (2)Theperiodofrevocationshallbeoneyeariftheperson'sdrivingrecordshows
40oneormoreprioralcohol-relatedenforcementcontactsduringtheimmediatelyprecedingfive
41years;
42 (3)Innocaseshallrestricteddrivingprivilegesbeissuedunderthissectiontoany
43personwhosedrivingrecordshowsoneormoreprioralcohol-relatedenforcementcontactsor
44toanypersonwhosedrivingrecordshowsaconvictionofanintoxication-relatedtraffic
45offense,asdefinedundersection577.001,inwhichtheperson'sbloodalcoholcontent
46wasfoundtobefifteen-hundredthsofonepercentormorebyweightofalcoholinsuch
47person'sblooduntilthepersonhasfiledproofwiththedepartmentofrevenuethatanymotor
48vehicleoperatedbythepersonisequippedwithafunctioning,certifiedignitioninterlock
49deviceasarequiredconditionoftherestricteddrivingprivilege.Ifthepersonfailsto
50maintainsuchprooftherestricteddrivingprivilegeshallbeterminated.
51 3.Forpurposesofthissection,"alcohol-relatedenforcementcontacts"shallinclude
52anysuspensionorrevocationundersections302.500to302.540,anysuspensionor
53revocationenteredinthisoranyotherstateforarefusaltosubmittochemicaltestingunder
54animpliedconsentlaw,andanyconvictioninthisoranyotherstateforaviolationwhich
55involvesdrivingwhileintoxicated,drivingwhileundertheinfluenceofdrugsoralcohol,or
56drivingavehiclewhilehavinganunlawfulalcoholconcentration.
57 4.Wherealicenseissuspendedorrevokedunderthissectionandthepersonisalso
58convictedonchargesarisingoutofthesameoccurrenceforaviolationofsection577.010or
59577.012orforaviolationofanycountyormunicipalordinanceprohibitingdrivingwhile
60intoxicatedoralcohol-relatedtrafficoffense,boththesuspensionorrevocationunderthis
61sectionandanyothersuspensionorrevocationarisingfromsuchconvictionsshallbe
62imposed,buttheperiodofsuspensionorrevocationundersections302.500to302.540shall
63becreditedagainstanyothersuspensionorrevocationarisingfromsuchconvictions,andthe
64totalperiodofsuspensionorrevocationshallnotexceedthelongerofthetwosuspensionor
65revocationperiods.
66 5.Anypersonwhohashadalicensetooperateamotorvehiclerevokedunderthis
67sectionorsuspendedunderthissectionwithoneormoreprioralcohol-relatedenforcement
68contactsoraconvictionforanintoxication-relatedtrafficoffense,asdefinedunder
69section577.001,inwhichtheperson'sbloodalcoholcontentwasfoundtobefifteen-
70hundredthsofonepercentormorebyweightofalcoholinsuchperson'sbloodshowing
71ontheirdriverrecordshallberequiredtofileproofwiththedirectorofrevenuethatany

73interlockdeviceasarequiredconditionofreinstatement.Theignitioninterlockdeviceshall

80ignitioninterlockdevice,thentheperiodforwhichthepersonmustmaintaintheignition
81interlockdevicefollowingthedateofreinstatementshallbeextendeduntilthepersonhas
82completedthreeconsecutivemonthswithnoviolationsasdescribedinthissection.Ifthe
83personfailstomaintainsuchproofwiththedirector,thelicenseshallbesuspendedor

5thatperson.Theofficershallissueatemporarypermit,onbehalfofthedirectorofrevenue,
6whichisvalidforfifteendaysandshallalsogivethepersonnoticeofhisorherrighttofilea
7petitionforreviewtocontestthelicenserevocation.
8 2.Suchofficershallmakeacertifiedreportunderpenaltiesofperjuryformakinga
9falsestatementtoapublicofficial.Thereportshallbeforwardedtothedirectorofrevenue

35chemicaltest,suchpersonmaypetitionforahearingbeforeacircuitdivisionorassociate
36divisionofthecourtinthecountyinwhichthearrestorstopoccurred.Pursuanttolocalcourt
37rulepromulgatedpursuanttoSection15ofArticleVoftheMissouriConstitution,thecase
38mayalsobeassignedtoatrafficjudgepursuanttosection479.500.Thepersonmayrequest
39suchcourttoissueanorderstayingtherevocationuntilsuchtimeasthepetitionforreview

47 (1)Whetherthepersonwasarrestedorstopped;
48 (2)Whethertheofficerhad:
49 (a)Reasonablegroundstobelievethatthepersonwasdrivingamotorvehiclewhile
50inanintoxicatedordruggedcondition;or
51 (b)Reasonablegroundstobelievethatthepersonstopped,beingundertheageof
52twenty-oneyears,wasdrivingamotorvehiclewithabloodalcoholcontentoftwo-
