135.1670.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Kansasbordercounty",Johnson,Miami,orWyandotteCountyinKansas;
3 (2)"Missouribordercounty",anycountywithacharterformofgovernmentandwith
4morethansixhundredthousandbutfewerthansevenhundredthousandinhabitants,any
5countyofthefirstclassificationwithmorethaneighty-threethousandbutfewerthanninety-
6twothousandinhabitantsandwithacityofthefourthclassificationwithmorethanfour
7thousandfivehundredbutfewerthanfivethousandinhabitantsasthecountyseat,anycounty
8ofthefirstclassificationwithmorethantwohundredthousandbutfewerthantwohundred
9sixtythousandinhabitants,oranycountyofthefirstclassificationwithmorethanninety-two
10thousandbutfewerthanonehundredonethousandinhabitantsinMissouri.

14MissouribordercountyfromaKansasbordercounty,notaxcreditsshallbeissued,funding
15provided,orretentionofwithholdingtaxesauthorizedforsuchjobundersuchsections.
16 3.IfthedirectoroftheMissouridepartmentofeconomicdevelopmentdetermines
17thatthestateofKansashasenactedlegislationorthegovernorofKansasissuedanexecutive

21delivertothegovernor,thespeakerofthehouseofrepresentatives,andthepresidentpro
22temporeofthesenateawrittencertificationofsuchdetermination.Upontheexecutionand
23deliveryofsuchwrittencertificationandthepartiesreceivingsuchcertificationprovidinga
24unanimouswrittenaffirmation,theprovisionsofsubsection2ofthissectionshallbeeffective
25unlessotherwiseprovidedinthissection.Theprovisionsofsubsection2ofthissectionshall
26notapplytoincentivesreservedonbehalfofandawardedtoMissouriemployerspriortothe
27provisionsofsubsection2ofthissectiontakingeffect.
28 4.IfthedirectoroftheMissouridepartmentofeconomicdevelopmentdetermines
29thattheKansasDepartmentofCommerceoranyotherKansasexecutivedepartmentis
30providingeconomicincentivesforjobsthatrelocatefromaMissouribordercountytoa
31Kansasbordercounty,thenthedirectorshallexecuteanddelivertothegovernor,thespeaker
32ofthehouseofrepresentatives,andthepresidentprotemporeofthesenateawritten
33certificationofsuchdetermination.Upontheexecutionanddeliveryofsuchwritten
34certificationandthepartiesreceivingsuchcertificationprovidingaunanimouswritten
35affirmation,theprovisionsofsubsection2ofthissectionshallnotbeeffectiveuntilsuchtime
36asthedirectordeterminesthattheKansasDepartmentofCommerceoranyotherKansas
37executivedepartmentisnotprovidingeconomicincentivesforjobsthatrelocatefroma
38MissouribordercountytoaKansasbordercounty,andthedirectorhasexecutedand
39deliveredtothegovernor,thespeakerofthehouseofrepresentatives,andthepresidentpro
40temporeofthesenateawrittencertificationofsuchdeterminationandthepartiesreceiving
41suchcertificationprovideanunanimouswrittenaffirmation.
42 5.ThedirectoroftheMissouridepartmentofeconomicdevelopmentshallnotifythe
43revisorofstatutesofallchangesinwhethersubsection2ofthissectioniseffective.
44 [6.TheprovisionsofthissectionshallexpireAugust28,2021,unlessatsuchtimethe
45provisionsofsubsection2ofthissectionareineffect.Iftheprovisionsofthissectiondonot
