8candidatesfortheofficeofschooldirectorinurbanschooldistrictsthatdonotcontainthe 9greaterpartofacityofoverthreehundredthousandinhabitants. 10 3.Adirectorforanyurbanschooldistrictcontainingacityofgreaterthanone 11hundredthirtythousandinhabitantsandlessthanthreehundredthousandinhabitantsmaybe 12nominatedasanindependentcandidatebyfilingwiththe[secretaryoftheboard] 13appropriateelectionauthorityapetitionsignedbyfivehundredregisteredvotersofsuch 14schooldistrict. 15 4.Inanyurbanschooldistrictlocatedinacountyofthefirstclassificationwithmore 16thaneighty-threethousandbutfewerthanninety-twothousandinhabitantsandwithahome 17rulecitywithmorethanseventy-sixthousandbutfewerthanninety-onethousandinhabitants 18asthecountyseat,acandidatefordirectorshallfileadeclarationofcandidacywiththe 19[secretaryoftheboard] appropriateelectionauthorityandshallnotberequiredtosubmita 20petition. 21 5.Nocandidateforelectionasaschoolboarddirectorrepresentingasubdistrictas 22providedinsection162.563shallberequiredtofileadeclarationofcandidacyasprovidedin 23thissectionasthesolemethodoffilingforcandidacy. 162.492.1.Inallurbandistrictscontainingthegreaterpartofthepopulationofacity 2whichhasmorethanthreehundredthousandinhabitants,theelectionauthorityofthecityin 3whichthegreaterportionoftheschooldistrictlies,andofthecountyifthedistrictincludes 4territorynotwithinthecitylimits,shallserveexofficioasaredistrictingcommission.The 5commissionshallonorbeforeNovember1,2018,dividetheschooldistrictintofive 6subdistricts,allsubdistrictsbeingofcompactandcontiguousterritoryandasnearlyequalin 7thenumberofinhabitantsaspracticableandthereaftertheboardshallredistrictthedistrict HB1174 3 8intosubdivisionsassoonaspracticableaftereachUnitedStatesdecennialcensus.In 9establishingthesubdistrictseachmembershallhaveonevoteandamajorityvoteofthetotal 10membershipofthecommissionisrequiredtomakeeffectiveanyactionofthecommission. 11 2.Schoolelectionsfortheelectionofdirectorsshallbeheldonmunicipalelection 12daysin2014and2016.Attheelectionin2014,directorsshallbeelectedtoholdofficeuntil 132019anduntiltheirsuccessorsareelectedandqualified.Attheelectionin2016,directors 14shallbeelecteduntil2019anduntiltheirsuccessorsareelectedandqualified.Beginningin 152019,schoolelectionsfortheelectionofdirectorsshallbeheldonthelocalelectiondateas 16specifiedinthecharterofahomerulecitywithmorethanfourhundredthousandinhabitants 17andlocatedinmorethanonecounty.Beginningattheelectionforschooldirectorsin2019, 18thenumberofdirectorsontheboardshallbereducedfromninetoseven.Twodirectorsshall 19beat-largedirectorsandfivedirectorsshallrepresentthesubdistricts,withonedirectorfrom 20eachofthesubdistricts.Atthe2019election,oneoftheat-largedirectorsandthedirectors 21fromsubdistrictsone,three,andfiveshallbeelectedforatwo-yearterm,andtheotherat- 22largedirectorandthedirectorsfromsubdistrictstwoandfourshallbeelectedforafour-year 23term.Thereafter,allsevendirectorsshallserveafour-yearterm.Directorsshallserveuntil 24thenextelectionanduntiltheirsuccessors,thenelected,aredulyqualifiedasprovidedinthis 25section.Inadditiontootherqualificationsprescribedbylaw,eachmemberelectedfroma 26subdistrictshallbearesidentofthesubdistrictfromwhichheorsheiselected.The 27subdistrictsshallbenumberedfromonetofive. 28 3.Thefivecandidates,onefromeachofthesubdistricts,whoreceiveapluralityof 29thevotescastbythevotersofthatsubdistrictandtheat-largecandidatesreceivingaplurality 30oftheat-largevotesshallbeelected.Thenameofnocandidatefornominationshallbe 31printedontheballotunlessthecandidatehasatleastsixtydayspriortotheelectionfileda 32declarationofcandidacywiththe[secretaryoftheboardofdirectors] appropriateelection 33authoritycontainingthesignaturesofatleasttwohundredfiftyregisteredvoterswhoare 34residentsofthesubdistrictwithinwhichthecandidatefornominationtoasubdistrictoffice 35resides,andincaseofat-largecandidatesthesignaturesofatleastfivehundredregistered 23trusteestobeselectedtherefromsubstantiallyequalsthepopulationofanyothersubdistrict 24dividedbythenumberoftrusteestobeselectedtherefrom.Theredistrictingplanreferredto 25herein,inlieuofrequiringalltrusteestobeelectedfromsubdistricts,mayprovideforthe 26electionofoneormoretrusteesatlargeandtheremainderfromsubdistricts,orforthe 29Notwithstandingtheabove,theboardoftrusteesofanycommunitycollegedistrictwhich 30containsmorethanfourhundredfiftythousandresidentsshall,atthefirstdulycalledmeeting 31followingAugust13,1972,andthereafterwithinninetydaysfollowingthepublicationofthe 32decennialcensusfigures,adoptaresolutioncallingfortheformationofaredistricting 33committee;andtheredistrictingcommitteeshalladoptaredistrictingplanspecifyingthe 34establishmentofnotlessthanfournormorethansixsubdistrictscompactandcontiguousin 35territoryandapportionedasprovidedabove. 36 3.Inanydistrictwhichshallcontainacitynotwithinacounty,iffoursubdistrictsare 37established,thenatleastonesubdistrictshallbewithinsaidcity,andiffiveorsixsubdistricts 38areestablished,thenatleasttwosubdistrictsshallbewithinsaidcity. 39 4.Anypersonrunningforelectionasatrusteeofasubdistrictshallbedomiciledand 40aresidenttherein.Anyplanproposedtobeadoptedmustreceiveapprovalofamajorityof 41thewholeredistrictingcommittee.Uponadoptiontheredistrictingcommitteeshallforwarda 42copyoftheplancertifiedbythesecretarytothecoordinatingboardforhighereducationfor 43itsapprovalordisapproval.Thecoordinatingboardforhighereducationshallapproveany 44redistrictingplaninwhichthepopulationofanysubdistrictdividedbythenumberoftrustees 45tobeselectedtherefromsubstantiallyequalsthepopulationofanyothersubdistrictdivided 46bythenumberoftrusteestobeelectedtherefrom.Uponapproval,theredistrictingplanshall 47becomeeffectiveandalltrusteeselectedthereaftershallberequiredtobeelectedfrom 48subdistrictsinwhichtheyareresident.Iftheplanisnotapproved,thenitshallbereturnedto 49theredistrictingcommitteeforrevisionandresubmission.Untilapprovalofaplanbythe 50coordinatingboardforhighereducation,trusteesofadistrictshallcontinuetorunatlarge. 51Uponapprovalofanyplan,theboardoftrusteesshalldeterminebyresolutiontheassignment 52oftrusteestosubdistricts.Anysuchassignmentshallnotaffectthetermofofficeofanysuch 53trustee.Onceadistricthasbeendividedintosubdistrictsinaccordancewiththeprovisions 54hereof,itshallremainsodivideduntiloneyearfollowingthepublicationofthedecennial 55censusfigures,bywhichdateanewplanshallhavebeenadoptedorthetrusteesshallagain HB1174 13 56berequiredtoruninthedistrictatlarge;provided,however,thatifduringtheperiodbetween 57publicationsofdecennialcensusfigurestheareaofadistrictisincreasedordecreased,anew 58planshallbeadoptedwithinoneyearthereafterorthetrusteesshallberequiredtoruninthe 59districtatlarge.Nomemberoftheredistrictingcommitteeshallserveontheboardoftrustees 60foraperiodofsixyearsfollowinghisserviceontheredistrictingcommittee. 61 5.CandidatesfortheofficeoftrusteeshallbecitizensoftheUnitedStates,atleast 62twenty-oneyearsofage,whohavebeenvotersofthedistrictforatleastonewholeyear 63precedingtheelection,andiftrusteesareelectedotherthanatlargetheyshallbevotersofthe 64subdistrictsforatleastonewholeyearnextprecedingtheelection.Allcandidatesforthefirst 65boardofadistrictshallfiletheirdeclarationofcandidacywiththe[coordinatingboardfor 66highereducation] appropriateelectionauthority. 67 6.Notwithstandingtheprovisionsofthissectionoranyotherlawtothecontrary,the 68boardoftrusteesofthecommunitycollegedistrictinanydistrictthatcontainsacitynot 69withinacountyshallbecomposedofsevenmembers,sixofwhomshalleachbeelectedtoa 70six-yearterm,andoneat-largememberwhoshallbeappointedtoasix-yeartermbythe 71coordinatingboardforhighereducation,beginningwiththeboardelectionoccurring 72immediatelyafterAugust28,2015,subjecttothefollowingprocedures: 73 (1)TheappointedmembershallbeacitizenoftheUnitedStates,atleasttwenty-one 74yearsofage,andaregisteredvoterofthedistrictforatleastoneyearprecedingthe 75appointment; 76 (2)Nomember,electedorappointed,shallbeanemployeeofsuchcommunity 77collegedistrict; 78 (3)Wheneveravacancyoccursintheappointedmember'sseatduetodeath, 79resignation,removalfromthedistrict,orbyoperationoflaworotherwise,thecoordinating 80boardforhighereducationshall,inalikemanner,appointacompetentpersontofillsuch 5thedistrictintosixelectiondistrictsasequalinpopulationaspossible,andshallbylot 6numberthedistrictsfromonetosixinclusive.Thecountycommissionshallcauseanelection 7tobeheldintheambulancedistrictwithinninetydaysaftertheorderestablishingthe 8ambulancedistricttoelectambulancedistrictdirectors.Eachvotershallvoteforonedirector 9fromtheambulanceelectiondistrictinwhichthevoterresides.Thedirectorselectedfrom 10districtsoneandfourshallserveforatermofoneyear,thedirectorselectedfromdistricts 11twoandfiveshallserveforatermoftwoyears,andthedirectorsfromdistrictsthreeandsix 12shallserveforatermofthreeyears;thereafter,thetermsofalldirectorsshallbethreeyears. 13Alldirectorsshallservethetermtowhichtheywereelectedorappointed,anduntiltheir 14successorsareelectedandqualified,exceptincasesofresignationordisqualification.The 15countycommissionshallreapportiontheambulancedistrictswithinsixtydaysafterthe 16populationofthecountyisreportedtothegovernorforeachdecennialcensusoftheUnited 2.CandidatesfordirectorofthehospitaldistrictshallbecitizensoftheUnitedStates, 23votersofthehospitaldistrictwhohaveresidedwithinthestateforoneyearnextprecedingthe 24electionandwhoareatleastthirtyyearsofage.Allcandidatesshallfiletheirdeclarationof 25candidacywiththe[countycommissioncallingtheelectionfortheorganizationalelection,
