115.124.1.Notwithstandinganyotherlawtothecontrary,inanonpartisanelection
2inanypoliticalsubdivisionorspecialdistrictincludingmunicipalelectionsinanycity,town,
3orvillagewithtwothousandorfewerinhabitantsthathaveadoptedaproposalpursuantto
4subsection3ofthissectionbutexcludingmunicipalelectionsinanycity,town,orvillage
5withmorethantwothousandinhabitants,ifthenoticeprovidedforinsubsection5ofsection
6115.127hasbeenpublishedinatleastonenewspaperofgeneralcirculationasdefinedin
7section493.050inthedistrict,andifthenumberofcandidatesforeachofficeinaparticular

15authorityshallpublishanoticecontainingthenamesofthecandidatesthatshallassumethe
16responsibilitiesofofficeunderthissection.Suchnoticeshallbepublishedinatleastone
17newspaperofgeneralcirculationasdefinedinsection493.050insuchpoliticalsubdivisionor
18districtbythefirstofthemonthinwhichtheelectionwouldhaveoccurred,haditbeen
19contested.Notwithstandinganyotherprovisionoflawtothecontrary,ifatanyelectionthe
20numberofcandidatesfilingforaparticularofficeexceedsthenumberofpositionstobefilled
21atsuchelection,theelectionauthorityshallholdtheelectionasscheduled,evenifasufficient
22numberofcandidateswithdrawfromsuchcontestforthatofficesothatthenumberof
23candidatesremainingafterthefilingdeadlineisequaltothenumberofpositionstobefilled.
24 2.Theelectionauthority[orpoliticalsubdivision] responsiblefortheoversightofthe
25filingofcandidatesinanynonpartisanelectioninanypoliticalsubdivisionorspecialdistrict
26shallclearlydesignatewherecandidatesshallformalinetoeffectuatesuchfilingsand
27determinetheorderofsuchfilings;exceptthat,inthecaseofcandidateswhofilea
28declarationofcandidacywiththeelectionauthority[orpoliticalsubdivision] priorto5:00
29p.m.onthefirstdayforfiling,theelectionauthority[orpoliticalsubdivisionmay]shall
30determinebyrandomdrawingtheorderinwhichsuchcandidates'namesshallappearonthe
31ballot.[Ifa]Suchdrawing[isconductedpursuanttothissubsection,it]shallbeconductedso
32thateachcandidate,orcandidate'srepresentativeifthecandidatefiledundersubsection2of
33section115.355,maydrawanumberatrandomatthetimeoffiling.[Ifsuchdrawingis
34conducted,] Theelectionauthority[orpoliticalsubdivision] shallrecordthenumberdrawn
35withthecandidate'sdeclarationofcandidacy.[Ifsuchdrawingisconducted,] Thenamesof
36candidatesfilingonthefirstdayoffilingforeachofficeoneachballotshallbelistedin
37ascendingorderofthenumberssodrawn.
38 3.Thegoverningbodyofanycity,town,orvillagewithtwothousandorfewer
39inhabitantsmaysubmittothevotersatanyavailableelection,aquestiontoadoptthe
40provisionsofsubsection1ofthissectionformunicipalelections.Ifamajorityofthevotes
41castbythequalifiedvotersvotingthereonareinfavorofthequestion,thenthecity,town,or
42villageshallconductnonpartisanmunicipalelectionsasprovidedinsubsection1ofthis
43sectionforallnonpartisanelectionsremainingintheyearinwhichtheproposalwasadopted
44andforthesixcalendaryearsimmediatelyfollowingsuchapproval.Attheendofsuchsix-
45yearperiod,eachsuchcity,town,orvillageshallbeprohibitedfromconductingsuch
46electionsinsuchamannerunlesssuchaquestionisagainadoptedbythemajorityof
47qualifiedvotersasprovidedinthissubsection.
48 4.(1)Notwithstandinganyotherprovisionoflawtothecontrary,the
49appropriateelectionauthorityforallnonpartisanelectionsconductedinapolitical
50subdivisionorspecialdistrictasdescribedinthissectionshallbetheelectionauthority

52politicalsubdivisionorspecialdistrictislocated.
53 (3)Foranonpartisanelectionforapoliticalsubdivisionorspecialdistrict
54locatedwithinthejurisdictionofmorethanoneelectionauthority,theelectionauthority
55ofthejurisdictionwiththegreatestproportionofthepoliticalsubdivision'sorspecial
56district'sregisteredvotersshallbetheappropriateelectionauthorityandsubsections2
57and3ofsection115.023shallapply.
162.491.1.Directorsforurbanschooldistricts,otherthanthosedistrictscontaining
2thegreaterpartofacityofoveronehundredthirtythousandinhabitants,maybenominated
3bypetitiontobefiledwiththe[secretaryoftheboard] appropriateelectionauthorityand
4signedbyanumberofvotersinthedistrictequaltotenpercentofthetotalnumberofvotes
5castforthedirectorreceivingthehighestnumberofvotescastatthenextprecedingbiennial
6election,exceptasprovidedinsubsection4ofthissection.
7 2.Thissectionshallnotbeconstruedasprovidingthesolemethodofnominating
8candidatesfortheofficeofschooldirectorinurbanschooldistrictsthatdonotcontainthe
9greaterpartofacityofoverthreehundredthousandinhabitants.
10 3.Adirectorforanyurbanschooldistrictcontainingacityofgreaterthanone
11hundredthirtythousandinhabitantsandlessthanthreehundredthousandinhabitantsmaybe
12nominatedasanindependentcandidatebyfilingwiththe[secretaryoftheboard]
13appropriateelectionauthorityapetitionsignedbyfivehundredregisteredvotersofsuch
14schooldistrict.
15 4.Inanyurbanschooldistrictlocatedinacountyofthefirstclassificationwithmore
16thaneighty-threethousandbutfewerthanninety-twothousandinhabitantsandwithahome
17rulecitywithmorethanseventy-sixthousandbutfewerthanninety-onethousandinhabitants
18asthecountyseat,acandidatefordirectorshallfileadeclarationofcandidacywiththe
19[secretaryoftheboard] appropriateelectionauthorityandshallnotberequiredtosubmita
20petition.
21 5.Nocandidateforelectionasaschoolboarddirectorrepresentingasubdistrictas
22providedinsection162.563shallberequiredtofileadeclarationofcandidacyasprovidedin
23thissectionasthesolemethodoffilingforcandidacy.
162.492.1.Inallurbandistrictscontainingthegreaterpartofthepopulationofacity
2whichhasmorethanthreehundredthousandinhabitants,theelectionauthorityofthecityin
3whichthegreaterportionoftheschooldistrictlies,andofthecountyifthedistrictincludes
4territorynotwithinthecitylimits,shallserveexofficioasaredistrictingcommission.The
5commissionshallonorbeforeNovember1,2018,dividetheschooldistrictintofive
6subdistricts,allsubdistrictsbeingofcompactandcontiguousterritoryandasnearlyequalin
7thenumberofinhabitantsaspracticableandthereaftertheboardshallredistrictthedistrict
HB1174	3 8intosubdivisionsassoonaspracticableaftereachUnitedStatesdecennialcensus.In
9establishingthesubdistrictseachmembershallhaveonevoteandamajorityvoteofthetotal
10membershipofthecommissionisrequiredtomakeeffectiveanyactionofthecommission.
11 2.Schoolelectionsfortheelectionofdirectorsshallbeheldonmunicipalelection
12daysin2014and2016.Attheelectionin2014,directorsshallbeelectedtoholdofficeuntil
132019anduntiltheirsuccessorsareelectedandqualified.Attheelectionin2016,directors
14shallbeelecteduntil2019anduntiltheirsuccessorsareelectedandqualified.Beginningin
152019,schoolelectionsfortheelectionofdirectorsshallbeheldonthelocalelectiondateas
16specifiedinthecharterofahomerulecitywithmorethanfourhundredthousandinhabitants
17andlocatedinmorethanonecounty.Beginningattheelectionforschooldirectorsin2019,
18thenumberofdirectorsontheboardshallbereducedfromninetoseven.Twodirectorsshall
19beat-largedirectorsandfivedirectorsshallrepresentthesubdistricts,withonedirectorfrom
20eachofthesubdistricts.Atthe2019election,oneoftheat-largedirectorsandthedirectors
21fromsubdistrictsone,three,andfiveshallbeelectedforatwo-yearterm,andtheotherat-
22largedirectorandthedirectorsfromsubdistrictstwoandfourshallbeelectedforafour-year
23term.Thereafter,allsevendirectorsshallserveafour-yearterm.Directorsshallserveuntil
24thenextelectionanduntiltheirsuccessors,thenelected,aredulyqualifiedasprovidedinthis
25section.Inadditiontootherqualificationsprescribedbylaw,eachmemberelectedfroma
26subdistrictshallbearesidentofthesubdistrictfromwhichheorsheiselected.The
27subdistrictsshallbenumberedfromonetofive.
28 3.Thefivecandidates,onefromeachofthesubdistricts,whoreceiveapluralityof
29thevotescastbythevotersofthatsubdistrictandtheat-largecandidatesreceivingaplurality
30oftheat-largevotesshallbeelected.Thenameofnocandidatefornominationshallbe
31printedontheballotunlessthecandidatehasatleastsixtydayspriortotheelectionfileda
32declarationofcandidacywiththe[secretaryoftheboardofdirectors] appropriateelection
33authoritycontainingthesignaturesofatleasttwohundredfiftyregisteredvoterswhoare
34residentsofthesubdistrictwithinwhichthecandidatefornominationtoasubdistrictoffice
35resides,andincaseofat-largecandidatesthesignaturesofatleastfivehundredregistered
36voters.Theelectionauthorityshalldeterminethevalidityofallsignaturesondeclarationsof
37candidacy.
38 4.Inanyelectioneitherforat-largecandidatesorcandidateselectedbythevotersof
39subdistricts,iftherearemorethantwocandidates,amajorityofthevotesarenotrequiredto
40electbutthecandidatehavingapluralityofthevotesshallbeelected.
41 5.Thenamesofallcandidatesshallappearupontheballotwithoutpartydesignation
42andintheorderofthepriority[ofthetimesoffilingtheirpetitionsofnomination] as
43establishedinsection115.124. Nocandidatemayfilebothatlargeandfromasubdistrict
44andthenamesofallcandidatesshallappearonlyonceontheballot,normayanycandidate

46residenceandwhetherthecandidateisfilingatlargeorfromasubdistrictandthenumerical
47designationofthesubdistrictorat-largearea.
48 6.Theprovisionsofallsectionsrelatingtoseven-directorschooldistrictsshallalso
49applytoandgovernurbandistrictsincitiesofmorethanthreehundredthousandinhabitants,
50totheextentapplicableandnotinconflictwiththeprovisionsofthosesectionsspecifically
51relatingtosuchurbandistricts.
52 7.Vacancieswhichoccurontheschoolboardshallbefilledinthemannerprovided
