countyinwhichtheconvictionwashad,ontheapplicationoftheprosecuting 5 attorney,shallissueawritofhabeascorpustobringsuchconvictbeforethe 6 court;orifhebeatlarge,awarrantforhisapprehensionmaybeissuedby 7 suchcourt,oranyjudgethereof.] [546.710.Uponsuchconvictedoffenderbeingbroughtbeforethe 2 court,theyshallproceedtoinquireintothefacts,andifnolegalreasonsexist 3 againsttheexecutionofsentence,suchcourtshallissueawarranttothe 4 directorofthedepartmentofcorrections,fortheexecutionoftheprisonerat 5 thetimethereinspecified,whichexecutionshallbeobeyedbythedirector 6 accordingly.] [546.720.1.Themannerofinflictingthepunishmentofdeathshallbe 2 bytheadministrationoflethalgasorbymeansoftheadministrationoflethal 3 injection.Andforsuchpurposethedirectorofthedepartmentofcorrectionsis 4 herebyauthorizedanddirectedtoprovideasuitableandefficientroomor 5 place,enclosedfrompublicview,withinthewallsofacorrectionalfacilityof 6 thedepartmentofcorrections,andthenecessaryappliancesforcarryinginto HB118 4 7 executionthedeathpenaltybymeansoftheadministrationoflethalgasorby 8 meansoftheadministrationoflethalinjection. 9 2.Thedirectorofthedepartmentofcorrectionsshallselectan 10 executionteamwhichshallconsistofthosepersonswhoadministerlethalgas 11 orlethalchemicalsandthosepersons,suchasmedicalpersonnel,whoprovide 12 directsupportfortheadministrationoflethalgasorlethalchemicals.The 13 identitiesofmembersoftheexecutionteam,asdefinedintheexecution 14 protocolofthedepartmentofcorrections,shallbekeptconfidential. 15 Notwithstandinganyprovisionoflawtothecontrary,anyportionofa 16 recordthatcouldidentifyapersonasbeingacurrentorformermemberofan 17 executionteamshallbeprivilegedandshallnotbesubjecttodiscovery, 18 subpoena,orothermeansoflegalcompulsionfordisclosuretoanypersonor 19 entity,theremainderofsuchrecordshallnotbeprivilegedorclosedunless 20 protectedfromdisclosurebylaw.Thesectionofanexecutionprotocolthat 21 directlyrelatestotheadministrationoflethalgasorlethalchemicalsisanopen 22 record,theremainderofanyexecutionprotocolofthedepartmentof 23 correctionsisaclosedrecord. 24 3.Apersonmaynot,withouttheapprovalofthedirectorofthe 25 departmentofcorrections,knowinglydisclosetheidentityofacurrentor 26 formermemberofanexecutionteamordisclosearecordknowingthatitcould 27 identifyapersonasbeingacurrentorformermemberofanexecutionteam. 28 Anypersonwhoseidentityisdisclosedinviolationofthissectionshall: 29 (1)Haveacivilcauseofactionagainstapersonwhoviolatesthis 30 section; 31 (2)Beentitledtorecoverfromanysuchperson: 32 (a)Actualdamages;and 33 (b)Punitivedamagesonashowingofawillfulviolationofthis 34 section. 35 4.Notwithstandinganyprovisionoflawtothecontrary,ifamember 36 oftheexecutionteamislicensedbyaboardordepartment,thelicensingboard 37 ordepartmentshallnotcensure,reprimand,suspend,revoke,ortakeanyother 38 disciplinaryactionagainsttheperson'slicensebecauseofhisorher 39 participationinalawfulexecution.Allmembersoftheexecutionteamare [546.730.Ajudgmentofdeathmustbeexecutedwithinacorrectional 2 centerofthedepartmentofcorrections;andsuchexecutionshallbeunderthe 3 supervisionanddirectionofthedirectorofthedepartmentofcorrections.] [546.740.Thechiefadministrativeofficerofthecorrectionalcenter,or 2 hisdulyappointedrepresentativeshallbepresentattheexecutionandthe 3 directorofthedepartmentofcorrectionsshallinvitethepresenceofthe 4 attorneygeneralofthestate,andatleasteightreputablecitizens,tobeselected 5 byhim;andheshallattherequestofthedefendant,permitsuchclergyor HB118 5 6 [546.810.Theinquisitionshallbesignedbythejuryandtheofficerin 2 chargeofsuchconvict,andifitappearthatsuchfemaleconvictispregnant 3 withchild,herexecutionshallbesuspendedandtheinquisitionshallbe 4 (1)Alistofallaggravatingormitigatingcircumstancesasprovidedin 6 subsection1ofsection565.032,whichthepartyintendstoproveatthesecond 7 stageofthetrial; 8 (2)Thenamesofallpersonswhomthepartyintendstocallas 9 witnessesatthesecondstageofthetrial; 10 (3)Copiesorlocationsandcustodianofanybooks,papers, 11 documents,photographsorobjectswhichthepartyintendstoofferatthe 12 secondstageofthetrial.Ifcopiesofsuchmaterialsarenotsuppliedto 13 opposingcounsel,thepartyshallcausethemtobemadeavailablefor 14 submittedorwherethestatewaivesthedeathpenalty,thesubmissiontothe 3 trierandallsubsequentproceedingsinthecaseshallproceedasinallother 4 criminalcases. 5 2.Wheremurderinthefirstdegreeissubmittedtothetrierwithouta 6 waiverofthedeathpenalty,thetrialshallproceedintwostagesbeforethe 7 sametrier.Atthefirststagethetriershalldecideonlywhetherthedefendant 8 isguiltyornotguiltyofanysubmittedoffense.Theissueofpunishmentshall 9 notbesubmittedtothetrieratthefirststage.Ifanoffenseischargedother 10 thanmurderinthefirstdegreeinacounttogetherwithacountofmurderinthe 11 firstdegree,thetrialjudgeshallassesspunishmentonanysuchoffense 12 accordingtolaw,afterthedefendantisfoundguiltyofsuchoffenseandafter 13 hefindsthedefendanttobeaprioroffenderpursuanttochapter558. 14 3.Ifmurderinthefirstdegreeissubmittedandthedeathpenaltywas 15 notwaivedbutthetrierfindsthedefendantguiltyofalesserhomicide,a 16 secondstageofthetrialshallproceedasinallothercriminalcases.The 17 attorneysmaythenargueasinothercriminalcasestheissueofpunishment, 18 afterwhichthetriershallassessanddeclarethepunishmentasinallother 19 criminalcases. 20 4.Ifthetrieratthefirststageofatrialwherethedeathpenaltywasnot 21 waivedfindsthedefendantguiltyofmurderinthefirstdegree,asecondstage 22 ofthetrialshallproceedatwhichtheonlyissueshallbethepunishmenttobe 23 assessedanddeclared.Evidenceinaggravationandmitigationofpunishment, 24 includingbutnotlimitedtoevidencesupportinganyoftheaggravatingor 25 mitigatingcircumstanceslistedinsubsection2or3ofsection565.032,maybe 26 presentedsubjecttotherulesofevidenceatcriminaltrials.Suchevidence 27 mayinclude,withinthediscretionofthecourt,evidenceconcerningthe 28 murdervictimandtheimpactoftheoffenseuponthefamilyofthevictimand 29 others.Rebuttalandsurrebuttalevidencemaybepresented.Thestateshallbe 30 thefirsttoproceed.Ifthetrierisajuryitshallbeinstructedonthelaw.The 31 attorneysmaythenarguetheissueofpunishmenttothejury,andthestateshall 32 havetherighttoopenandclosetheargument.Thetriershallassessand 33 declarethepunishmentatlifeimprisonmentwithouteligibilityforprobation, 34 parole,orreleaseexceptbyactofthegovernor: 35 (1)Ifthetrierfindsbyapreponderanceoftheevidencethatthe 36 defendantisintellectuallydisabled;or 37 (2)Ifthetrierdoesnotfindbeyondareasonabledoubtatleastoneof 38 anddecidedpriortotrialwithoutprejudicingthedefendant'srighttohavethe 60 issuesubmittedtothetrieroffactasprovidedinsubsection4ofthissection. 61 6.Asusedinthissection,theterms"intellectualdisability"or 62 "intellectuallydisabled"refertoaconditioninvolvingsubstantiallimitations 63 ingeneralfunctioningcharacterizedbysignificantlysubaverageintellectual 64 functioningwithcontinualextensiverelateddeficitsandlimitationsintwoor 65 moreadaptivebehaviorssuchascommunication,self-care,homeliving,social 66 skills,communityuse,self-direction,healthandsafety,functionalacademics, 67 leisureandwork,whichconditionsaremanifestedanddocumentedbefore 68 eighteenyearsofage. 69 7.Theprovisionsofthissectionshallonlygovernoffensescommitted 70 onorafterAugust28,2001.] [565.032.1.Inallcasesofmurderinthefirstdegreeforwhichthe 2 deathpenaltyisauthorized,thejudgeinajury-waivedtrialshallconsider,or 3 shallincludeinhisorherinstructionstothejuryforittoconsider: 4 (1)Whetherastatutoryaggravatingcircumstanceorcircumstances 5 enumeratedinsubsection2ofthissectionisestablishedbytheevidence 6 beyondareasonabledoubt;and 7 (2)Ifastatutoryaggravatingcircumstanceorcircumstancesisproven 8 beyondareasonabledoubt,whethertheevidenceasawholejustifiesa 9 sentenceofdeathorasentenceoflifeimprisonmentwithouteligibilityfor 10 probation,parole,orreleaseexceptbyactofthegovernor. 11 12 thefirststageofthetrialandevidencesupportinganyofthestatutory 16 aggravatingormitigatingcircumstancessetoutinsubsections2and3ofthis 17 section.Ifthetrierisajury,itshallnotbeinstructeduponanyspecific 18 evidencewhichmaybeinaggravationormitigationofpunishment,butshall 19 beinstructedthateachjurorshallconsideranyevidencewhichheorshe 20 considerstobeaggravatingormitigating. 26 (2)Themurderinthefirstdegreeoffensewascommittedwhilethe 27 offenderwasengagedinthecommissionorattemptedcommissionofanother 28 unlawfulhomicide; 29 (3)Theoffenderbyhisorheractofmurderinthefirstdegree 30 knowinglycreatedagreatriskofdeathtomorethanonepersonbymeansofa 31 weaponordevicewhichwouldnormallybehazardoustothelivesofmore 32 thanoneperson; 79 (2)Themurderinthefirstdegreewascommittedwhilethedefendant 80 wasundertheinfluenceofextremementaloremotionaldisturbance; 81 (3)Thevictimwasaparticipantinthedefendant'sconductor 82 consentedtotheact; 87 (6)Thecapacityofthedefendanttoappreciatethecriminalityofhisor 88 herconductortoconformhisorherconducttotherequirementsoflawwas 89 substantiallyimpaired; 90 (7)Theageofthedefendantatthetimeoftheoffense.] [565.035.1.Wheneverthedeathpenaltyisimposedinanycase,and 2 uponthejudgmentbecomingfinalinthetrialcourt,thesentenceshallbe 3 reviewedontherecordbythesupremecourtofMissouri.Thecircuitclerkof 4 thecourttryingthecase,withintendaysafterreceivingthetranscript,shall 5 transmittheentirerecordandtranscripttothesupremecourttogetherwitha 6 noticepreparedbythecircuitclerkandareportpreparedbythetrialjudge. 7 Thenoticeshallsetforththetitleanddocketnumberofthecase,thenameof 8 thedefendantandthenameandaddressofhisattorney,anarrativestatement 9 ofthejudgment,theoffense,andthepunishmentprescribed.Thereportbythe 10 judgeshallbeintheformofastandardquestionnairepreparedandsuppliedby 11 thesupremecourtofMissouri. 12 2.ThesupremecourtofMissourishallconsiderthepunishmentas 13 wellasanyerrorsenumeratedbywayofappeal. 14 3.Withregardtothesentence,thesupremecourtshalldetermine: 15 (1)Whetherthesentenceofdeathwasimposedundertheinfluenceof 16 passion,prejudice,oranyotherarbitraryfactor;and 17 (2)Whethertheevidencesupportsthejury'sorjudge'sfindingofa 18 statutoryaggravatingcircumstanceasenumeratedinsubsection2ofsection 19 565.032andanyothercircumstancefound; 20 (3)Whetherthesentenceofdeathisexcessiveordisproportionateto 21 thepenaltyimposedinsimilarcases,consideringboththeoffense,thestrength 22 oftheevidenceandthedefendant. 23 4.Boththedefendantandthestateshallhavetherighttosubmitbriefs 24 withinthetimeprovidedbythesupremecourt,andtopresentoralargumentto 25 thesupremecourt. HB118 10 26 5.Thesupremecourtshallincludeinitsdecisionareferencetothose 27 similarcaseswhichittookintoconsideration.Inadditiontoitsauthority 28 regardingcorrectionoferrors,thesupremecourt,withregardtoreviewof 29 deathsentences,shallbeauthorizedto: 30 (1)Affirmthesentenceofdeath;or 31 (2)Setthesentenceasideandresentencethedefendanttolife 32 imprisonmentwithouteligibilityforprobation,parole,orreleaseexceptbyact 33 ofthegovernor;or 34 (3)Setthesentenceasideandremandthecaseforretrialofthe 35 punishmenthearing.Anewjuryshallbeselectedorajurymaybewaivedby 36 agreementofbothpartiesandthenthepunishmenttrialshallproceedin 37 accordancewiththischapter,withtheexceptionthattheevidenceoftheguilty 38 verdictshallbeadmissibleinthenewtrialtogetherwiththeofficialtranscript 39 ofanytestimonyandevidenceproperlyadmittedineachstageoftheoriginal 40 trialwhererelevanttodeterminepunishment. 41 6.Thereshallbeanassistanttothesupremecourt,whoshallbean 42 attorneyappointedbythesupremecourtandwhoshallserveatthepleasureof 43 thecourt.Thecourtshallaccumulatetherecordsofallcasesinwhichthe 44 sentenceofdeathorlifeimprisonmentwithoutprobationorparolewas 45 imposedafterMay26,1977,orsuchearlierdateasthecourtmaydeem 46 appropriate.Theassistantshallprovidethecourtwithwhateverextracted 47 informationthecourtdesireswithrespectthereto,includingbutnotlimitedto 48 asynopsisorbriefofthefactsintherecordconcerningtheoffenseandthe 49 defendant.Thecourtshallbeauthorizedtoemployanappropriatestaff, 50 withinthelimitsofappropriationsmadeforthatpurpose,andsuchmethodsto 51 compilesuchdataasaredeemedbythesupremecourttobeappropriateand 52 relevanttothestatutoryquestionsconcerningthevalidityofthesentence.The 53 officeoftheassistanttothesupremecourtshallbeattachedtotheofficeofthe 54 clerkofthesupremecourtforadministrativepurposes. 55 7.Inadditiontothemandatorysentencereview,thereshallbearight 56 ofdirectappealoftheconvictiontothesupremecourtofMissouri.Thisright 57 ofappealmaybewaivedbythedefendant.Ifanappealistaken,theappeal 58 andthesentencereviewshallbeconsolidatedforconsideration.Thecourt 59 shallrenderitsdecisiononlegalerrorsenumerated,thefactualsubstantiation 60 oftheverdict,andthevalidityofthesentence.] ✔ HB118 11
