HB120 2 23 4.(1)BeginningJanuary1,2026,anemployer[mayenrollandparticipateina 24federalworkauthorizationprogramand]orbusinessentityshallverifytheemployment 25eligibilityofeveryemployeeintheemployer'sorbusinessentity'shirewhoseemployment 26commencesaftertheemployerorbusinessentityenrollsinafederalworkauthorization 27program.Theemployerorbusinessentityshallretainacopyofthedatedverificationreport 28receivedfromthefederalgovernment.[Any] Anemployerorbusinessentity[that 29participates] enrolledandparticipatinginsuchprogramshallhaveanaffirmativedefense 30thatsuchbusinessentityhasnotviolatedsubsection1ofthissection. 31 (2)(a)Ifaprivateemployerorbusinessentityfailstocomplywiththis 32subsection,thedepartmentshallrequiretheprivateemployerorbusinessentityto 33provideanaffidavittothedepartmentstatingthattheprivateemployerorbusiness 34entity: 35 a.Willcomplywiththissubsection; 36 b.Hasterminatedtheemploymentofallunauthorizedaliensinthisstate;and 37 c.Willnotknowinglyemployanunauthorizedalieninthisstate. 38 (b)Iftheprivateemployerorbusinessentitydoesnotprovidetherequired 39affidavitandfailstocomplywiththissubsectionwithinfifteendaysofthedateofthe 40department'snotice,theattorneygeneralshalldirecttheappropriatelicensingagency 41orapplicablemunicipalorcountygoverningbodytosuspendallapplicablelicenses, 42permits,orexemptionsoftheprivateemployerorbusinessentityuntiltheprivate 43employerorbusinessentityprovidesthedepartmentwiththerequiredaffidavitthat 44demonstratescompliancewiththissubsection. 45 5.(1)Ageneralcontractororsubcontractorofanytiershallnotbeliableunder 46sections285.525to285.550whensuchgeneralcontractororsubcontractorcontractswithits 47directsubcontractorwhoviolatessubsection1ofthissection,ifthecontractbindingthe 48contractorandsubcontractoraffirmativelystatesthatthedirectsubcontractorisnot 49knowinglyinviolationofsubsection1ofthissectionandshallnothenceforthbeinsuch 50violationandthecontractororsubcontractorreceivesaswornaffidavitunderthepenaltyof 51perjuryattestingtothefactthatthedirectsubcontractor'semployeesarelawfullypresentin 52theUnitedStates. 53 (2)Ifageneralcontractororsubcontractorofanytierknowsordiscoversthat 54thedirectsubcontractorofsuchgeneralcontractororsubcontractorisinviolationof 55subsection1ofthissection,thegeneralcontractororsubcontractorshallreportsuch 56violationtothedepartment.Ifthegeneralcontractororsubcontractorfailstoreport 57suchviolationuponlearningoftheviolation,thegeneralcontractororsubcontractor 58shallbesubjecttothesamepenaltyfortheviolationasthedirectsubcontractor. HB120 3 285.535.1.Theattorneygeneralshallenforcetherequirementsofsections285.525 2to285.550. 3 2.Anenforcementactionshallbeinitiatedbymeansofawritten,signedcomplaint 4underpenaltyofperjuryasdefinedinsection575.040totheattorneygeneralsubmittedby 5anystateofficial,businessentity,orstateresident.Avalidcomplaintshallincludean 6allegationwhichdescribestheallegedviolatoraswellastheactionsconstitutingthe 7violation,andthedateandlocationwheresuchactionsoccurred.Acomplaintwhichalleges 8aviolationsolelyorprimarilyonthebasisofnationalorigin,ethnicity,orraceshallbe 9deemedinvalidandshallnotbeenforced. 10 3.Uponreceiptofavalidcomplaint,theattorneygeneralshall,withinfifteen 11businessdays,requestidentityinformationfromthebusinessentityregardinganypersons 12allegedtobeunauthorizedaliens.Suchrequestshallbemadebycertifiedmail.Theattorney 13generalshalldirecttheapplicablemunicipalorcountygoverningbodytosuspendany 14applicablelicense,permit,orexemptionsofanybusinessentitywhichfails,withinfifteen 15businessdaysafterreceiptoftherequest,toprovidesuchinformation. 16 4.Theattorneygeneral,afterreceivingtherequestedidentityinformationfromthe 17businessentity,shallsubmitidentitydatarequiredbythefederalgovernmenttoverify,under 188U.S.C.1373,theimmigrationstatusofsuchpersons,andshallprovidethebusinessentity 19withwrittennoticeoftheresultsoftheverificationrequest: 20 (1)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeis 21authorizedtoworkintheUnitedStates,theattorneygeneralshalltakenofurtheractionon 22thecomplaint; 23 (2)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeisnot 24authorizedtoworkintheUnitedStates,theattorneygeneralshallproceedonthecomplaintas 25providedinsubsection5ofthissection; 26 (3)Ifthefederalgovernmentnotifiestheattorneygeneralthatitisunabletoverify 27whetheranemployeeisauthorizedtoworkintheUnitedStates,theattorneygeneralshall 28takenofurtheractiononthecomplaintuntilaverificationfromthefederalgovernment 29concerningthestatusoftheindividualisreceived.Atnopointshallanystateofficialattempt 30tomakeanindependentdeterminationofanyalien'slegalstatuswithoutverificationfromthe 31federalgovernment. 32 5.(1)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeisnot 33authorizedtoworkintheUnitedStates,andtheemployeroftheunauthorizedalien 34participatesinafederalworkauthorizationprogram,thereshallbearebuttablepresumption 35thattheemployerhasmettherequirementsforanaffirmativedefenseundersubsection4of 36section285.530,andtheemployershallcomplywithsubsection6ofthissection. HB120 4 37 (2)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeisnot 38authorizedtoworkintheUnitedStates,theattorneygeneralshallbringacivilactioninCole 39Countyiftheattorneygeneralreasonablybelievesthebusinessentityknowinglyviolated 40subsection1ofsection285.530: 41 (a)Ifthecourtfindsthatabusinessentitydidnotknowinglyviolatesubsection1of 42section285.530,theemployershallhavefifteenbusinessdaystocomplywithsubdivision(1) 43andparagraph(a)ofsubdivision(2)ofsubsection6ofthissection.Iftheentityfailstodoso, 44thecourtshalldirecttheapplicablemunicipalorcountygoverningbodytosuspendthe 45businesspermit,ifsuchexists,andanyapplicablelicensesorexemptionsoftheentityuntil 46theentitycomplieswithsubsection6ofthissection; 47 (b)Ifthecourtfindsthatabusinessentityknowinglyviolatedsubsection1ofsection 48285.530,thecourtshalldirecttheapplicablemunicipalorcountygoverningbodytosuspend 49thebusinesspermit,ifsuchexists,andanyapplicablelicensesorexemptionsofsuchbusiness 50entityfor[fourteen] onehundredtwentydays.Permits,licenses,andexemptionsshallbe 51reinstatedforentitieswhocomplywithsubsection6ofthissectionattheendofthe[fourteen- 52day]one-hundred-twenty-dayperiod. 53 6.Thecorrectionofaviolationwithrespecttotheemploymentofanunauthorized 54alienshallincludethefollowingactions: 55 (1)(a)Thebusinessentityterminatestheunauthorizedalien'semployment.Ifthe 56businessentityattemptstoterminatetheunauthorizedalien'semploymentandsuch 57terminationischallengedinacourtofthestateofMissouri,thefifteen-business-dayperiod 58forprovidinginformationtotheattorneygeneralreferencedinsubsection3ofthissection 59shallbetolledwhilethebusinessentitypursuestheterminationoftheunauthorizedalien's 60employmentinsuchforum;or 61 (b)Thebusinessentity,afteracquiringadditionalinformationfromtheemployee, 62requestsasecondaryoradditionalverificationbythefederalgovernmentoftheemployee's 63authorization,undertheproceduresofafederalworkauthorizationprogram.Whilethis 64verificationispending,thefifteen-business-dayperiodforprovidinginformationtothe 65attorneygeneralreferencedinsubsection3ofthissectionshallbetolled;and 66 (2)Alegalrepresentativeofthebusinessentitysubmits,atanofficedesignatedby 67theattorneygeneral,thefollowing: 68 (a)Aswornaffidavitstatingthattheviolationhasendedthatshallincludea 69descriptionofthespecificmeasuresandactionstakenbythebusinessentitytoendthe 70violation,andthename,address,andotheradequateidentifyinginformationforany 71unauthorizedaliensrelatedtothecomplaint;and 72 (b)Documentationacceptabletotheattorneygeneralwhichconfirmsthatthe 73businessentityhasenrolledinandisparticipatinginafederalworkauthorizationprogram. HB120 5 74 7.Thesuspensionofabusinesslicenseorlicensesundersubsection5ofthissection 75shallterminateonebusinessdayafteralegalrepresentativeofthebusinessentitysubmitsthe 76affidavitandotherdocumentationrequiredundersubsection6ofthissectionfollowingany 77periodofrestrictionrequiredundersubsection5ofthissection. 78 8.Foranentitythatviolatessubsection1ofsection285.530forasecondtime,the 79courtshalldirecttheapplicablemunicipalorcountygoverningbodytosuspend,foroneyear, 80thebusinesspermit,ifsuchexists,andanyapplicablelicenseorexemptionsofthebusiness 81entity.Forasubsequentviolation,thecourtshalldirecttheapplicablemunicipalorcounty 82governingbodytoforeversuspendthebusinesspermit,ifsuchexists,andanyapplicable 83licenseorexemptionsofthebusinessentity.Asecondorsubsequentviolationof 84subsection1ofsection285.530byanybusinessentityshallbedeemedaclassDfelony. 85 9.Inadditiontothepenaltiesinsubsections5and8ofthissection: 86 (1)Uponthefirstviolationofsubsection1ofsection285.530byanybusinessentity 87awardedastatecontractorgrantorreceivingastate-administeredtaxcredit,taxabatement, 88orloanfromthestate,thebusinessentityshallbedeemedinbreachofcontractandthestate 89mayterminatethecontractandsuspendordebarthebusinessentityfromdoingbusinesswith 90thestateforaperiodofthreeyears.Uponsuchtermination,thestatemaywithholdupto 91twenty-fivepercentofthetotalamountduetothebusinessentity; 92 (2)Uponasecondorsubsequentviolationofsubsection1ofsection285.530byany 93businessentityawardedastatecontractorgrantorreceivingastate-administeredtaxcredit, 94taxabatement,orloanfromthestate,thebusinessentityshallbedeemedinbreachofcontract 95andthestatemayterminatethecontractandpermanentlysuspendordebarthebusinessentity 96fromdoingbusinesswiththestate.Uponsuchtermination,thestatemaywithholdupto 97twenty-fivepercentofthetotalamountduetothebusinessentity.Asecondorsubsequent 98violationofsubsection1ofsection285.530byanybusinessentityshallbedeemedaclass 99Dfelony. 100 10.Sections285.525to285.550shallnotbeconstruedtodenyanyprocedural 101mechanismsorlegaldefensesincludedinafederalworkauthorizationprogram. 102 11.Anybusinessentitysubjecttoacomplaintandsubsequentenforcementunder 103sections285.525to285.540,oranyemployeeofsuchabusinessentity,maychallengethe 104enforcementofthissectionwithrespecttosuchentityoremployeeinthecourtsofthestateof 105Missouri. 106 12.Ifthecourtfindsthatanycomplaintisfrivolousinnatureorfindsnoprobable 107causetobelievethattherehasbeenaviolation,thecourtshalldismissthecase.Forpurposes 108ofthissubsection,"frivolous"shallmeanacomplaintnotshownbyclearandconvincing 109evidencetobevalid.Anypersonwhosubmitsafrivolouscomplaintshallbeliableforactual, 110compensatory,andpunitivedamagestotheallegedviolatorforholdingtheallegedviolator HB120 6 111beforethepublicinafalselight.Ifthecourtfindsthatacomplaintisfrivolousorthatthereis 112notprobablecausetobelievetherehasbeenaviolation,theattorneygeneralshallissuea 113publicreporttothecomplainantandtheallegedviolatorstatingwithparticularityitsreasons 114fordismissalofthecomplaint.Uponsuchissuance,thecomplaintandallmaterialsrelating 115tothecomplaintshallbeapublicrecordasdefinedinchapter610. 116 13.Thedeterminationofwhetheraworkerisanunauthorizedalienshallbemadeby 117thefederalgovernment.Adeterminationofsuchstatusofanindividualbythefederal 118governmentshallcreatearebuttablepresumptionastothatindividual'sstatusinanyjudicial 119proceedingsbroughtunderthissectionorsection285.530.Thecourtmaytakejudicialnotice 120ofanyverificationofanindividual'sstatuspreviouslyprovidedbythefederalgovernment 121andmayrequestthefederalgovernmenttoprovideautomatedortestimonialverification. 122 14.Compensation,whetherinmoneyorinkindorinservices,knowinglyprovidedto 123anyunauthorizedalienshallnotbeallowedasabusinessexpensedeductionfromanyincome 124orbusinesstaxesofthisstate. 125 15.Anybusinessentitywhichterminatesanemployeeinaccordancewiththissection 126shallnotbeliableforanyclaimsmadeagainstthebusinessentityunderchapter213forthe 127termination. 285.545.1.Theprovisionsofthissectionshallbeknownandmaybecitedasthe 2"ImmigrantEmploymentRegistrationandTaxationProtectionAct". 3 2.Asusedinthissection,thefollowingtermsmean: 4 (1)"Alien",anypersonnotacitizenornationaloftheUnitedStates,asdefined 5in8U.S.C.1101(a)(3); 6 (2)"Qualifiedimmigrantworker",apersonwho: 7 (a)Isanalien,butnotanunauthorizedalien,asdefinedunderthissection,who 8islegallyauthorizedunderfederallawtoacceptemployment; 9 (b)Hasobtainedavalidworkpermit;and 10 (c)IsanewhireoremployedinthestateofMissouri; 11 (3)"Unauthorizedalien",thesamedefinitionasdefinedundersection285.525. 12 3.TheMissouridepartmentoflaborandindustrialrelationsshallmaintaina 13databaseorregistryofqualifiedimmigrantworkers.Thedepartmentshallestablish 14anyformsandproceduresnecessarytoprocessandmaintainsuchadatabaseor 15registry,mechanismsbywhichemployersshallverifyregistrationofanyqualified 16immigrantworkers,andanyothernecessaryinformationrequiredtoverifytheidentity 17andemploymentofqualifiedimmigrantworkers,butnotmoreordifferentdocuments 18thanarerequiredbyfederallawforthefederalgovernmenttoverifyemployment. HB120 7 19 4.Aqualifiedimmigrantworkershallberequiredtosignanaffidavitof 20understanding,onaformdevelopedbythedepartment,thatincludes,butisnotlimited 21to,thefollowing: 22 (1)Thattheregistrationqualifiesthequalifiedimmigrantworkerfor 23employmentonlyuntillegalimmigrationstatusisdeterminedbythecourts; 24 (2)Thatnothinginthissectionshallmakethequalifiedimmigrantworker 25eligibleforanyotherservicesprovidedbythestate;and 26 (3)Thatifatanytimethequalifiedimmigrantworkerisconvictedofafelony 27crimeinthefederalorstatecourtssystem,theworkprivilegeswillbeimmediately 28revoked. 29 5.Notwithstandinganyotherlawtothecontraryandsubjecttoallapplicable 30federallaws,aqualifiedimmigrantworker,asdefinedunderthissection,shallbe 31registeredbytheworker'semployerwiththedepartment,andsuchemployershall 32providethedepartmentwithallnecessarydocumentationincompliancewiththis 33section. 34 6.Thedepartmentshallprovideawrittenconfirmationtotheemployerupon 35theregistrationofthequalifiedimmigrantworkerincompliancewiththissection. 36 7.Theprovisionsrelatingtoverificationeligibilityofaqualifiedimmigrant 37workershallnotapplytoanemployerwhoreceivesandprovidesthenecessary 38documentationrelatingtothequalifiedimmigrantworkertothedepartmentin 39compliancewiththissection.Theverificationeligibilityofaqualifiedimmigrant 40workershallbeincludedinthedatabaseorregistrymaintainedbythedepartmentfor 41futureeligibilitydeterminations. 42 8.TheMissouriattorneygeneralshallbeauthorizedwiththeenforcementofthe 43provisionsofthissection,subjecttotheapplicablerequirementsofsections285.525to 44285.550. 45 9.Thedepartmentmayestablishmemorandumsofunderstandingbetweenthe 46attorneygeneral'sofficeandtheMissouristatehighwaypatroltosharesuch 47informationunderthissectioninfurtheranceofthepurposesofthissection. 48 10.Thedepartmentshallissueawrittennoncompliancenoticetoanyemployer 49whofailstoregisteraqualifiedimmigrantworkerwithinthirtydaysofhire.Ifthe 50employerfailstoregistertheworkerwithinthefifteendaysafterreceiptofsuchnotice, 51thedepartmentshallnotifytheattorneygeneraloftheemployer'snoncomplianceand 52theattorneygeneralshalldirecttheappropriatelicensingagencyorapplicable 53municipalorcountygoverningbodytosuspendallapplicablelicenses,permits,or 54exemptionsoftheemployeruntiltheemployercomplieswiththissection. HB120 8 55 11.(1)Aftertheemployernotifies,inwriting,thequalifiedimmigrantworker 56oranindividualseekingemploymentthatthefailuretosubmittherequested 57documentationisaviolationofthelawandsubjecttopunishment,anyqualified 58immigrantworkeroranindividualseekingemploymentwhofailstoprovidethe 59employer-requesteddocumentationthatisrequiredtoverifyworkauthorizationstatus 60withtheemployer,federalauthorities,andthedepartmentforthepurposesofthis 61registry,withinthirtydaysofthedateoftherequest,shallbeguiltyofaclassDfelony. 62 (2)Theattorneygeneralshallinvestigateallegedorsuspectedviolationsofthis 63subsectionandshallhavetheauthoritytoprosecuteallegedviolations. 64 (3)Anenforcementactionshallbeinitiatedbymeansofasigned,written 65complaint,underpenaltyofperjury,asdefinedinsection575.040,totheattorney 66generalsubmittedbyanystateofficial,businessentity,orstateresident.Avalid 67complaintshallincludeanallegationthatdescribestheallegedviolatoraswellasthe 68actionsconstitutingtheviolationandthedateandlocationwheresuchactions 69occurred.Acomplaintthatallegesaviolationsolelyorprimarilyonthebasisof 70nationalorigin,ethnicity,orraceshallbedeemedinvalidandshallnotbeenforced. 71 (4)Uponreceiptofavalidcomplaint,theattorneygeneralshall,withinfifteen 72businessdays,requestinformationfromtheemployeroremployeeallegedtobein 73violationregardingtheallegedviolationofthissubsection.Suchrequestshallbemade 74bycertifiedmail. 75 (5)Theattorneygeneral,afterreceivingtherequestedinformationfromthe 76employeroremployeeallegedtobeinviolation,shallsubmitanydatarequiredbythe 77federalgovernmenttoverify,under8U.S.C.1373,theimmigrationstatusofsuch 78employeeandshallprovidetheemployerwithwrittennoticeoftheresultsofthe 79verificationrequest. 80 (a)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeis 81authorizedtoworkintheUnitedStates,theattorneygeneralshalltakenofurther 82actiononthecomplaint. 83 (b)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeis 84notauthorizedtoworkintheUnitedStates,theattorneygeneralshallnotifythe 85employerandtheemployershallterminatetheunauthorizedalien'semploymentand 86followtheproceduresrelatedtothehiringofunauthorizedaliensundersections285.530 87and285.535. 88 (c)Ifthefederalgovernmentnotifiestheattorneygeneralthatitisunableto 89verifywhetheranemployeeisauthorizedtoworkintheUnitedStates,theattorney 90generalshalltakenofurtheractiononthecomplaintuntilverificationfromthefederal 91governmentconcerningthestatusoftheindividualisreceived. HB120 9 92 93Unlessrequiredbyfederallaw,atnopointshallanystateofficialattempttomakean 94independentdeterminationofanyalien'slegalstatuswithoutverificationfromthe 95federalgovernment. 96 (6)Duringtheinvestigation,iftheattorneygeneraldiscoversevidenceofunpaid 97incometax,failuretofiletaxreturns,taxevasion,orotherviolationsofchapter143,the 98attorneygeneralisauthorizedtoinformandcooperatewiththedepartmentofrevenue 99fortheinvestigationandenforcementofanyadditionalcriminalliabilitiesunder 100chapter143. 101 (7)Anyemployeesubjecttoacomplaintandsubsequentenforcementunderthis 102subsectionmaychallengetheenforcementofthissectionwithrespecttosuchemployee 103inthecourtsofthestateofMissouri. 104 (8)Thedeterminationofwhetheraworkerisanunauthorizedalienshallbe 105madebythefederalgovernment.Adeterminationofsuchstatusofanindividualbythe 106federalgovernmentshallcreatearebuttablepresumptionastothatindividual'sstatus 107inanyjudicialproceedingsbroughtunderthissection.Thecourtmaytakejudicial 108noticeofanyverificationofanindividual'sstatuspreviouslyprovidedbythefederal 109governmentandmayrequestthefederalgovernmenttoprovideautomatedor 110testimonialverification. 111 12.Nothinginthissectionshallbeconstruedbytheimmigrationcourtstoimply 112thatthestateofMissouriisanadvocateforalegalimmigrationstatusrelatingtoa 113qualifiedimmigrantworkerorworker. 114 13.Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe 115administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin 116section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 117becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 118536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 119andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 120review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 121heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 122adoptedaftertheeffectivedateofthissection,shallbeinvalidandvoid. 123 14.TheprovisionsofthissectionshalltakeeffectJanuary1,2026. 290.045.1.Apersonwhoissixteenyearsofageorolderbutundereighteen 2yearsofage,enrolledinsecondaryschoolasafull-timestudent,andemployedforwages 3orotherremunerationshallnotbepermitted,forced,orcompelledtoworkafter10:00 4p.m.onaneveningbeforeaschooldaywhenschoolisinsessionfortheregularschool 5year.Theprovisionsofthissectionmaybewaivedbythedirector,onanindividualized HB120 10 6basis,dependinguponthenatureoftheemployment.Suchwaivershallbeprovidedin 7writingtotheemployerbythedirector.Asusedinthissection,"director"meansthe 8directorofthedepartmentoflaborandindustrialrelationsorhisorherauthorized 9representative. 10 2.Theprovisionsofsubsection1ofthissectionshallnotincludethefollowing: 11 (a)Anypersonemployedbyorworkingunderthedirectcontroloftheperson's 12parentorlegalguardian; 13 (b)Astudentwhoattendsahomeschoolasthattermisdefinedundersection 14167.031;or 15 (c)Afull-timestudentwhoiseligibletoreceivecreditforworkthatisperformed 16duringtheschoolyearbaseduponcriteriaestablishedbythesecondaryschoolsystem. 650.475.1.Notwithstandinganyotherprovisionoflaw,nogovernmententity, 2politicalsubdivision,orgovernmentofficialwithinthestateofMissourishallprohibit,orin 3anywayrestrict,anygovernmententityorofficialfromcommunicatingorcooperatingwith 4theUnitedStatesBureauofImmigrationandCustomsEnforcementregardingthecitizenship 5orimmigrationstatus,lawfulorunlawful,ofanyindividual. 6 2.Municipalitiesandpoliticalsubdivisionsmaycollectandsharetheidentityof 7personsbythesamemeanstheFederalBureauofInvestigationoritssuccessoragencyusesin 8itsIntegratedAutomatedFingerprintIdentificationSystemoritssuccessorprogram. 9 3.Notwithstandinganyotherprovisionoflaw,nopersonoragencywithinthestateof 10Missourishallprohibit,orinanywayrestrict,apublicemployeefromdoinganyofthe 11followingwithrespecttoinformationregardingtheimmigrationstatus,lawfulorunlawful,of 12anyindividual: 13 (1)Sendingsuchinformationto,orrequestingorreceivingsuchinformationfrom, 14theUnitedStatesBureauofImmigrationandCustomsEnforcement; 15 (2)Maintainingsuchinformation;or 16 (3)Exchangingsuchinformationwithanyotherfederal,state,orlocalgovernment 17entity. 18 4.Uponthecomplaintofanystateresidentregardingaspecificgovernmententity, 19agency,orpoliticalsubdivisionofthisstateorpriortotheprovisionoffundsorawardingof 20anygrantstoagovernmententity,agency,orpoliticalsubdivisionofthisstate,anymember 21ofthegeneralassemblymayrequestthattheattorneygeneralofthestateofMissouriissuean 22opinionstatingwhetherthegovernmententity,agency,orpoliticalsubdivisionhascurrent 23policiesincontraventionofsubsections1and3ofthissection. 24 5.Nostateagencyordepartmentshallprovideanyfundingorawardanymonetary 25grantstoanygovernmententity,agency,orpoliticalsubdivisiondeterminedundersubsection HB120 11 264ofthissectiontohaveapolicyincontraventionofsubsections1and3ofthissectionuntil 27thepolicyisrepealedornolongerineffect. 28 6.Theprovisionsofsubsections1and3ofthissectionshallnotapplytoanystateor 29localagencyadministeringoneormorefederalpublicbenefitprogramsassuchtermis 30definedin8U.S.C.Section1612, oranyqualifiedimmigrantworkerregisteredinthe 31departmentoflaborandindustrialrelationsdatabaseestablishedundersection285.545. ✔ HB120 12
