Torepealsection571.070,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
unlawfulpossessionofafirearm,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section571.070,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection571.070,toreadasfollows:
571.070.1.Apersoncommitstheoffenseofunlawfulpossessionofafirearmifsuch
2personknowinglyhasanyfirearminhisorherpossessionand:
3 (1)Suchpersonhasbeenconvictedofafelonyunderthelawsofthisstate,orofa
4crimeunderthelawsofanystateoroftheUnitedStateswhich,ifcommittedwithinthisstate,
5wouldbeafelony. Theprovisionsofthissubdivisionshallnotapplyasfollows:
6 (a)Ifsuchfelonyconvictionwasaconvictionofaviolentfelonyunderthelaws
7ofthisstateorofacrimeunderthelawsofanystateoroftheUnitedStatesthatif
8committedwithinthisstatewouldbeaviolentfelony,possessionunderthissubdivision
9shallnotbeanoffenseafteraperiodoftenyearshaspassedfollowingthedateof
10sentencecompletionforthefelonyconviction;and
11 (b)Ifsuchfelonyconvictionwasaconvictionofanonviolentfelonyunderthe
12lawsofthisstateorofacrimeunderthelawsofanystateoroftheUnitedStatesthatif
13committedwithinthisstatewouldbeanonviolentfelony,possessionunderthis
14subdivisionshallnotbeanoffenseafteraperiodofthreeyearshaspassedfollowingthe
15dateofsentencecompletionforthefelonyconviction; or
16 (2)Suchpersonisafugitivefromjustice,ishabituallyinanintoxicatedordrugged
17condition,oriscurrentlyadjudgedmentallyincompetent.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 2.UnlawfulpossessionofafirearmisaclassCfelony,unlessapersonhasbeen
19convictedofadangerousfelonyasdefinedinsection556.061,orthepersonhasaprior
20convictionforunlawfulpossessionofafirearminwhichcaseitisaclassBfelony.
21 3.Theprovisionsofsubdivision(1)ofsubsection1ofthissectionshallnotapplyto
22thepossessionofanantiquefirearm.
23 4.Asusedinthissection,thefollowingtermsmean:
24 (1)"Nonviolentfelony",anyfelonyoffensethatdoesnotinvolvetheuseofforce,
25orthreatofforce,againstanotherperson;
26 (2)"Sentencecompletion",thedateonwhichapersonhassatisfiedall
27obligationsplacedonthepersonaspartofthesentence,includinganyperiodof
28incarcerationandanyperiodofsupervisedprobationorparole;
29 (3)"Violentfelony",anyfelonyoffensethatinvolvestheuseofforce,orthreatof
30force,againstanotherperson.
