1212 571.070.1.Apersoncommitstheoffenseofunlawfulpossessionofafirearmifsuch
1313 2personknowinglyhasanyfirearminhisorherpossessionand:
1414 3 (1)Suchpersonhasbeenconvictedofafelonyunderthelawsofthisstate,orofa
1515 4crimeunderthelawsofanystateoroftheUnitedStateswhich,ifcommittedwithinthisstate,
1616 5wouldbeafelony. Theprovisionsofthissubdivisionshallnotapplyasfollows:
1717 6 (a)Ifsuchfelonyconvictionwasaconvictionofaviolentfelonyunderthelaws
1818 7ofthisstateorofacrimeunderthelawsofanystateoroftheUnitedStatesthatif
1919 8committedwithinthisstatewouldbeaviolentfelony,possessionunderthissubdivision
2020 9shallnotbeanoffenseafteraperiodoftenyearshaspassedfollowingthedateof
2121 10sentencecompletionforthefelonyconviction;and
2222 11 (b)Ifsuchfelonyconvictionwasaconvictionofanonviolentfelonyunderthe
2323 12lawsofthisstateorofacrimeunderthelawsofanystateoroftheUnitedStatesthatif
2424 13committedwithinthisstatewouldbeanonviolentfelony,possessionunderthis
2525 14subdivisionshallnotbeanoffenseafteraperiodofthreeyearshaspassedfollowingthe
2626 15dateofsentencecompletionforthefelonyconviction; or
2727 16 (2)Suchpersonisafugitivefromjustice,ishabituallyinanintoxicatedordrugged
2828 17condition,oriscurrentlyadjudgedmentallyincompetent.
