ThefollowingisasummaryoftheHouseCommitteeSubstituteforHB
1216.
Thisbillauthorizesproducersofarchitecturalpaintsoldat
retailtoestablishorjoinanonprofitrepresentative
organization. Therepresentative organizationandanyproducernot
amemberofsuchorganizationmustdevelopandsubmitaplanfor
theestablishmentofapost-consumerpaintcollectionprogramto
theDepartmentofNaturalResources. Additionalpaintproductscan
beproposedinconsultationwiththeDepartment. Theprogrammust
bestructuredtoreducethegeneration,promotethereuseand
recycling,andmanagethewastestreamofpost-consumerpaint.
Theplanmustincludespecifieditemsincludingalistof
participatingproducersandbrands,informationonthetypesof
architecturalpaintproductscoveredundertheprogram,anda
descriptionofhowtheprogramwillprovideforconvenientcost-
effectivestatewidecollectionofpost-consumerpaintinthisState
andtheeducationandoutreacheffortstoinformconsumersabout
theprogram. Theplanmustbereviewedbyanindependentfinancial
auditorselectedbytherepresentative organizationtoverifythat
thepaintassessmentfeeswillcoverthecostsoftheprogram.
Nolaterthan60daysafterthesubmissionofaplan,the
DepartmentDirectormustmakeadeterminationofwhethertoapprove
theplanassubmitted. Ifthedirectorfindsthattheplandoes
notmeettherequirements,heorshemustprovideawritten
explanationandtheorganizationorproducerhas60daystorevise
theplan.
TheDepartmentmustenforcecompliancewiththeplanasspecified
inthebill.Theplanmustbesubmittedwithin12monthsofthe
effectivedate.Atthetimetheplanissubmittedandannually
thereafter,eachproducersubmittingaplanmustpayan
administrative feeassetbytheDepartmentaccordingtothebill.
Eachproducermustincludeinthepriceofanyarchitecturalpaint
soldtoretailersanddistributorstheper-containeramount,known
asthepaintassessmentfee,intheapprovedplan.Theretaileror
distributormaynotdeducttheamountfromthepurchaseprice.
Retailerscanincorporatethefeeaspartofthepricebutarenot requiredto.NopaintcanbesoldintheStateunlesstheproducer
ofapaintbrandorarepresentative organizationisimplementing
orparticipatingintheprogram.
Apaintcollectionsitemaynotchargeanyadditionalamountfor
thedisposalofpaintwhenthepaintisofferedfordisposal. A
producerortherepresentative organizationthatorganizesthe
collection,transport,andprocessingofpost-consumerpaintmay
notbeliableforanyclaimofaviolationofantitrust,restraint
oftrade,unfairtradepractice,orotheranticompetitive activity
arisingfromconductundertakeninaccordancewiththeprogram.
BeforeMarch31stofeachyear,theproducersorrepresentative
organizationmustsubmitanannualreportforthepreviousyearto
theDirectorthatdetailstheprogram. Thebillspecifiesthe
informationrequiredtobeincludedinthereport.Theproducers
ortherepresentative organizationmustimplementtheprogramon
January1,2027,orsixmonthsaftertheapprovaloftheplan,
whicheveroccurslater.
Generatorsofhouseholdwastesandconditionallyexemptsmall
quantitygeneratorscantransportorsendarchitecturalpaintstoa
paintcollectionsitetotheextentpermittedbyaprogram. Paint
collectionsitescancollectandtemporarilystorearchitectural
paintsgeneratedbycertainentitiesinlieuofanyotherwise
applicablerequirementsofstatelawsorregulations. Theprogram
doesnotrestrictthecollectionofarchitecturalpaintbya
programwherethecollectionisauthorizedbyanyotherstatelaws
orregulationsoraffectanyrequirementsapplicabletofacilities
thattreat,dispose,orrecyclearchitecturalpaintunderanyother
statelawsorregulations.

versionofthebill.
PROPONENTS: Supporterssaythatcurrentlytherearefewplacesto
disposeofunusedoroldpaint.Somemunicipalities offerprograms
buttheyareexpensiveandnotalwaysconvenientforconsumers.
Thisbillwouldestablishastatewideprogramtorecycleunused
paintthatisenvironmentally beneficialandconvenientfor
consumers. Similarprogramshavebeenimplementedin10statesand
theDistrictofColumbia.
