48forsaleatretailinthisstate. 49 2.Producersofarchitecturalpaintsoldatretailinthisstatemayestablishor 50joinarepresentativeorganization.Thedutiesunderthissectionshallbemetbythe 51representativeorganizationonbehalfofallitsmemberproducers.Anyproducerwhois 52notamemberofarepresentativeorganizationshallmeetthedutiesunderthissection 53separately. 54 3.(1)Arepresentativeorganizationoraproducerofarchitecturalpaintsoldat 55retailinthisstatethatisnotamemberofsuchrepresentativeorganizationshalldevelop HCSHB1216 2 56andsubmittothedirectorforthedirector'sapprovalaplanfortheestablishmentofa 57post-consumerpaintcollectionprogram.Additionalpaintproductsmaybeproposedin 58asubsequentprogramplaninconsultationwiththedepartment.Theprogramshallbe 59structuredto: 60 (a)Reducethegenerationofpost-consumerpaint; 61 (b)Promotethereuseandrecyclingofpost-consumerpaint; 62 (c)Managethepost-consumerpaintwastestreamusingenvironmentallysound 63managementpractices;and 64 (d)Limitthedepartment'sroletooversightactivitiesthatincludeapprovingthe 65programplanandreviewingtheannualreport. 66 (2)Theplansubmittedunderthissectionshall: 67 (a)Providealistofparticipatingproducersandbrandscoveredbytheprogram; 68 (b)Provideinformationonthearchitecturalpaintproductscoveredunderthe 69program,suchasinteriororexteriorwater-andoil-basedcoatings,primers,sealers,or 70woodcoatings; 71 (c)Describehowtheprogramwillprovideforconvenientandcost-effective 72statewidecollectionofpost-consumerpaintinthisstate.Theproducersor 73representativeorganizationmaycoordinatetheprogramwithexistinghousehold 74hazardouswastecollectioninfrastructureasismutuallyagreeable.Apaintretailer 75shallbeauthorizedbytheproducersorrepresentativeorganizationasapaintcollection 76siteonlyifthepaintretailervoluntarilyagreestoactassuchandcomplieswithall 77applicablelawsandregulationsandtheretaillocationisconsistentwiththe 78maintenanceofacost-effectivenetworkofpaintcollectionlocations; 79 (d)Establishagoalforthenumberandgeographicdistributionofsitesfor 80collectionofpost-consumerpaintbasedonthefollowingcriteria: 81 a.AtleastninetypercentofMissouriresidentsshallhaveacollectionsitewithin 82afifteen-mileradiusandonesiteshallbeestablishedforeveryfiftythousandresidents 83ofthestateunlessotherwiseapprovedbythedirector;or 84 b.Iftheprogramisunabletomeettherequirementsofthissubsection,a 85collectioneventorotherdepartment-approvedcollectionserviceshallbescheduledona 86periodicbasistoservesuchresidents; 87 (e)Describehowpost-consumerpaintwillbemanagedinthemost 88environmentallyandeconomicallysoundmannerusingthefollowingstrategiesinthe 89followingorder:reuse,recycling,energyrecovery,anddisposal; 90 (f)Describeeducationandoutreacheffortstoinformconsumersaboutthe 91program.Sucheffortsshallinclude,butnotbelimitedto: 92 a.Informationaboutcollectionopportunitiesforpost-consumerpaint; HCSHB1216 3 93 b.Informationaboutthechargefortheoperationoftheprogramthatshallbe 94includedinthepurchasepriceofallarchitecturalpaintsoldinthisstate;and 95 c.Effortstopromotethesourcereduction,reuse,andrecyclingofarchitectural 96paint; 97 (g)Establishaper-containercosttobeaddedtoarchitecturalpaintsoldinthis 98stateasaresultoftheprogram.Thisper-containercost,knownasthepaintassessment 99fee,shallbereviewedbyanindependentfinancialauditortoensurethatanyaddedcost 100topaintsoldinthisstateasaresultoftheprogramdoesnotexceedthecoststooperate 101andsustaintheprograminaccordancewithsoundmanagementpractices;and 102 (h)Describehowtheprogramwillcompensateserviceprovidersforactivities 103conductedundertheprogramthatmayinclude: 104 a.Thecollectionofpost-consumerarchitecturalpaintandarchitecturalpaint 105containersthroughpermanentcollectionsites,collectionevents,orcurbsideservices; 106 b.Thereuseorprocessingofpost-consumerarchitecturalpaintatapermanent 107collectionsite;and 108 c.Thetransportation,recycling,andproperdisposalofpost-consumer 109architecturalpaint. 110 (3)Theindependentfinancialauditorrequiredunderparagraph(g)of 111subdivision(2)ofthissubsectionshallbeselectedbytherepresentativeorganization 112afterconsultationwiththedepartment.Theindependentfinancialauditorshallverify 113thatthecostaddedtoeachunitofpaintwillcoverthecostsoftheprogram.The 114departmentshallreviewtheworkproductoftheindependentfinancialauditor.The 115costofanyworkperformedbysuchindependentfinancialauditorshallbefundedby 116thepaintassessmentfeesauthorizedbytheprogram. 117 (4)Eachmanufacturerundertheplanshallincludeinthepriceofany 118architecturalpaintsoldtoretailersordistributorsinthestatetheper-containeramount 119ofthefeesetforthintheplanorfeeadjustment.Ifarepresentativeorganization 120implementstheplanforamanufacturer,themanufacturershallberesponsiblefor 121filing,reporting,andremittinganyfeeassessedunderthissectionforeachcontainerof 122architecturalpainttotherepresentativeorganization.Aretailerordistributorshallnot 123deducttheamountofthefeefromthepurchasepriceofanyarchitecturalpaintthe 124retailerordistributorsells. 125 (5)Nolaterthansixtydaysafterthesubmissionofaplanunderthissection,the 126directorshallmakeawrittendeterminationofwhethertoapprovetheplanas 127submittedordisapprovetheplan.Ifthedirectorfindstheplandoesnotmeetthe 128requirementsofthissection,thedirectorshallprovideawrittenexplanationofthe 129nonconformingitems.Withinsixtydaysfollowingreceiptofthedirector'swritten HCSHB1216 4 130explanationofitemsthatdonotmeettherequirementsofthissection,therepresentative 131organizationortheproducerofarchitecturalpaintshallsubmitarevisedplantothe 132directorforapproval. 133 (6)Thedepartmentshallenforcetheproducer'sortherepresentative 134organization'scompliancewiththeplanandmay,byregulationorbyusingexisting 135regulationspromulgatedundersections260.230,260.240,and260.249,establish 136enforcementproceduresandpenalties. 137 (7)Nolaterthantheimplementationdateoftheprogram,information 138regardingtheapprovedplan,thenamesofparticipatingproducers,andthebrandsof 139architecturalpaintcoveredbytheprogramshallbepostedonthedepartment'swebsite 140andonthewebsiteoftherepresentativeorganization. 141 (8)Theplanrequiredunderthissubsectionshallbesubmittedtothedepartment 142notlaterthantwelvemonthsaftertheeffectivedateofthissection.Thedepartment 143may,forgoodcauseshown,grantanextensionofthedeadlineforsubmission. 144 (9)Nothinginthissectionshallbeconstruedtorequirethedepartmentto 145developtheplanorestablishtheprogramauthorizedunderthissection.Such 146requirementshallbethesoleresponsibilityoftheproducersorrepresentative 147organization. 148 (10)Nothinginthissectionshallrequirearetailertotrack,file,report,submit, 149orremitafeeassessedunderthissection,salesdata,oranyotherinformationonbehalf 150ofamanufacturer,distributor,orrepresentativeorganization.Nothinginthissection 151shallprohibitamanufacturerandaretailerfromenteringintoremitteragreements. 152 4.(1)Thedepartmentshallestablishanadministrativefeetobepaidbyeach 153producerorrepresentativeorganizationsubmittingaplanunderthissection.The 154departmentshallsetthefeeatanamountthat,whenpaidbyeveryproduceror 155representativeorganizationthatsubmitsaplan,isadequatetoreimbursethe 156department'sfullcostsofadministeringthissection.Thetotalamountofannualfees 157collectedunderthissubdivisionshallnotexceedtheamountnecessarytoreimburse 158costsincurredbythedepartmenttoadministerthissection.Thedepartmentmay 159considerrelevantfactorswhenestablishingthefeeincluding,butnotlimitedto,the 160portionofarchitecturalpaintsoldinthestatebytheproducerorthemembersofthe 161representativeorganizationcomparedtothetotalamountofarchitecturalpaintsoldin 162thestatebyallproducersorrepresentativeorganizationssubmittingaplan. 163 (2)Eachproducerorrepresentativeorganizationimplementingaplanunder 164thissectionshallpaytheadministrativefeerequiredinsubdivision(1)ofthissubsection 165onorbeforeJuly1,2026,andannuallythereafter.Eachyearaftertheinitialpayment, 166theannualadministrativefeeshallnotexceedfivepercentoftheaggregateprogramfee HCSHB1216 5 167addedtothecostofallarchitecturalpaintsoldbyproducersinthestateforthe 168precedingcalendaryear.Thedepartmentmayextendthetimeforpaymentupongood 169causeshown. 170 5.Uponimplementationoftheprogram,eachproducershallincludeintheprice 171ofanyarchitecturalpaintsoldtoretailersanddistributorsinthisstatetheper-container 172amount,knownasthepaintassessmentfee,intheapprovedplan.Noretaileror 173distributorshalldeductsuchamountfromthepurchaseprice. 174 6.Retailersmayincorporatethefeeaspartofthepriceamountdisplayedto 175consumersofarchitecturalproducts.Retailersshallnotberequiredtoincorporatethe 176feeaspartofthepriceamountdisplayedtoconsumersforarchitecturalproducts, 177providedthattheretailersmakeinformationaboutthefeeavailabletoconsumersof 178architecturalpaintproductspriortopurchase. 179 7.(1)Aftertheprogramisimplemented,noproducerorretailershallsellor 180offerforsalearchitecturalpainttoanypersoninthisstateunlesstheproducerofa 181paintbrandorarepresentativeorganizationisimplementingorparticipatinginthe 182programasrequiredbythissection. 183 (2)Aretailershallbedeemedtobeincompliancewiththissectionif,onthedate 184thearchitecturalpaintwasofferedforsale,theproducerislistedonthedepartment's 185websiteasimplementingorparticipatingintheprogramorifthepaintbrandislisted 186onthedepartment'swebsiteasbeingincludedintheprogram. 187 (3)Apaintcollectionsiteauthorizedunderthissectionshallnotchargeany 188additionalamountforthedisposalofpaintwhenthepaintisofferedfordisposal. 189 (4)Aproducerortherepresentativeorganizationthatorganizesthecollection, 190transport,andprocessingofpost-consumerpaintinaccordancewiththeprogramshall 191notbeliableforanyclaimofaviolationofantitrust,restraintoftrade,unfairtrade 192practice,orotheranticompetitiveactivityarisingfromconductundertakenin 193accordancewiththeprogramunderthissection. 194 (5)BeforeMarchthirty-firstofeachyear,theproducersorrepresentative 195organizationshallsubmitanannualreportforthepreviousyeartothedirectorthat 196detailstheprogram.Thefirstreportshallbesubmittedafterthefirstfullyearof 197implementation.Thedirectormay,forgoodcauseshown,extendthedeadlineforfiling 198thereport.Thereportorinformationrelatingtothereportshallbepostedonthe 199department'swebsiteandonthewebsiteoftherepresentativeorganization.Thereport 200shallcontainatleastthefollowing: 201 (a)Adescriptionofthemethodsusedtocollect,transport,andprocesspost- 202consumerpaintinthisstate; HCSHB1216 6 203 (b)Thevolumeandtypeofpost-consumerpaintcollectedbymethodof 204disposition,containinginformationaboutreuse,recycling,othermethodsofprocessing, 205andanyotherrelatedandappropriateinformation; 206 (c)Samplesofeducationalmaterialsprovidedtoconsumersofarchitectural 207paint; 208 (d)Thetotalcostoftheprogram;and 209 (e)Anindependentfinancialauditcompletedbyanindividualfinancialauditor 210chosenbytheproducersortherepresentativeorganization. 211 (6)Financial,production,orsalesdatareportedtothedepartmentbya 212producerorbytherepresentativeorganizationshallnotbesubjecttodisclosure,butthe 213directormayreleaseasummaryformofsuchdatathatdoesnotdisclosefinancial, 214production,orsalesdataoftheproducer,retailer,orrepresentativeorganization. 215 (7)Theproducersortherepresentativeorganizationshallimplementthe 216programrequiredunderthissectiononJanuary1,2027,orsixmonthsafterthe 217approvaloftheplanunderthissection,whicheveroccurslater. 218 8.(1)Generatorsofhouseholdwastesandconditionallyexemptsmallquantity 219generatorsmaytransportorsendarchitecturalpaintstoapaintcollectionsitetothe 220extentpermittedbyaprogramapprovedbythedirector. 221 (2)Paintcollectionsitesmaycollectandtemporarilystorearchitecturalpaints 222generatedbyentitiesspecifiedinsubdivision(1)ofthissubsectioninaccordancewith 223therequirementsoftheprograminlieuofanyotherwiseapplicablerequirementsof 224statelawsorregulations. 225 (3)Nothinginthissectionshallbeconstruedtorestrictthecollectionof 226architecturalpaintbyaprogramwheresuchcollectionisauthorizedbyanyotherstate 227lawsorregulations. 228 (4)Nothinginthissectionshallbeconstruedtoaffectanyrequirements 229applicabletofacilitiesthattreat,dispose,orrecyclearchitecturalpaintunderanyother 230statelawsorregulations. 231 9.Thedirectormaypromulgateallnecessaryrulesandregulationsforthe 232administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin 233section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
