BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section160.261,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection160.261,toreadasfollows: 160.261.1.Thelocalboardofeducationofeachschooldistrictshallclearlyestablish 2awrittenpolicyofdiscipline,includingthedistrict'sdeterminationontheuseofcorporal 3punishmentandtheproceduresinwhichpunishmentwillbeapplied.Awrittencopyofthe 4district'sdisciplinepolicyandcorporalpunishmentprocedures,ifapplicable,shallbe 5providedtothepupilandparentorlegalguardianofeverypupilenrolledinthedistrictatthe 6beginningofeachschoolyearandalsomadeavailableintheofficeofthesuperintendentof 7suchdistrict,duringnormalbusinesshours,forpublicinspection.Nopupilshallbesubjectto 8corporalpunishmentproceduresoutlinedinthedisciplineandcorporalpunishmentpolicy 9withoutaparentorguardianbeingnotifiedandprovidingwrittenpermissionforthecorporal 10punishment.Allemployeesofthedistrictshallannuallyreceiveinstructionrelatedtothe 11specificcontentsofthepolicyofdisciplineandanyinterpretationsnecessarytoimplement 12theprovisionsofthepolicyinthecourseoftheirduties,includingbutnotlimitedtoapproved 13methodsofdealingwithactsofschoolviolence,discipliningstudentswithdisabilitiesand 14instructioninthenecessityandrequirementsforconfidentiality. 15 2.Thepolicyshallrequireschooladministratorstoreportactsofschoolviolenceto 16allteachersattheattendancecenterand,inaddition,tootherschooldistrictemployeeswitha 17needtoknow.Forthepurposesofthischapterorchapter167,"needtoknow"isdefinedas EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18schoolpersonnelwhoaredirectlyresponsibleforthestudent'seducationorwhootherwise 19interactwiththestudentonaprofessionalbasiswhileactingwithinthescopeoftheir 20assignedduties.Asusedinthissection,thephrase"actofschoolviolence"or"violent 21behavior"meanstheexertionofphysicalforcebyastudentwiththeintenttodoserious 22physicalinjuryasdefinedinsection556.061toanotherpersonwhileonschoolproperty, 23includingaschoolbusinserviceonbehalfofthedistrict,orwhileinvolvedinschool 24activities.Thepolicyshallataminimumrequireschooladministratorstoreport,assoonas 25reasonablypractical,totheappropriatelawenforcementagencyanyofthefollowingcrimes, 26oranyactwhichifcommittedbyanadultwouldbeoneofthefollowingcrimes: 27 (1)Firstdegreemurderundersection565.020; 84 (2)Suchstudentisunderthedirectsupervisionofanotheradultdesignatedbythe 85student'sparent,legalguardian,orcustodian,inadvance,inwriting,totheprincipalofthe 86schoolwhichsuspendedthestudentandthesuperintendentorthesuperintendent'sdesignee 87hasauthorizedthestudenttobeonschoolproperty; 88 (3)Suchstudentisenrolledinandattendinganalternativeschoolthatislocated 89withinonethousandfeetofapublicschoolintheschooldistrictwheresuchstudentattended 90school;or HB1220 3 91 (4)Suchstudentresideswithinonethousandfeetofanypublicschoolintheschool 92districtwheresuchstudentattendedschoolinwhichcasesuchstudentmaybeontheproperty 93ofhisorherresidencewithoutdirectadultsupervision. 94 4.Anystudentwhoviolatestheconditionofsuspensionrequiredpursuantto 95subsection3ofthissectionmaybesubjecttoexpulsionorfurthersuspensionpursuanttothe 96provisionsofsections167.161,167.164,and167.171.Inmakingthisdetermination 97considerationshallbegiventowhetherthestudentposesathreattothesafetyofanychildor 98schoolemployeeandwhethersuchstudent'sunsupervisedpresencewithinonethousandfeet 99oftheschoolisdisruptivetotheeducationalprocessorunderminestheeffectivenessofthe 100school'sdisciplinarypolicy.Removalofanypupilwhoisastudentwithadisabilityissubject 101tostateandfederalproceduralrights.Thissectionshallnotlimitaschooldistrict'sabilityto: 102 (1)Prohibitallstudentswhoaresuspendedfrombeingonschoolpropertyor 103attendinganactivitywhileonsuspension; 104 (2)Disciplinestudentsforoff-campusconductthatnegativelyaffectstheeducational 105environmenttotheextentallowedbylaw. 106 5.Thepolicyshallprovideforasuspensionforaperiodofnotlessthanoneyear,or 107expulsion,forastudentwhoisdeterminedtohavebroughtaweapontoschool,includingbut 108notlimitedtotheschoolplaygroundortheschoolparkinglot,broughtaweapononaschool 109busorbroughtaweapontoaschoolactivitywhetheronoroffoftheschoolpropertyin 110violationofdistrictpolicy,exceptthat: 111 (1)Thesuperintendentor,inaschooldistrictwithnohighschool,theprincipalofthe 112schoolwhichsuchchildattendsmaymodifysuchsuspensiononacase-by-casebasis;and 113 (2)Thissectionshallnotpreventtheschooldistrictfromprovidingeducational 114servicesinanalternativesettingtoastudentsuspendedundertheprovisionsofthissection. 115 6.Forthepurposeofthissection,theterm"weapon"shallmeanafirearmasdefined 116under18U.S.C.Section921andthefollowingitems,asdefinedinsection571.010:a 117blackjack,aconcealablefirearm,anexplosiveweapon,afirearm,afirearmsilencer,agas 118gun,aknife,knuckles,amachinegun,aprojectileweapon,arifle,ashotgun,aspringgunor 119aswitchbladeknife;exceptthatthissectionshallnotbeconstruedtoprohibitaschoolboard 120fromadoptingapolicytoallowaCivilWarreenactortocarryaCivilWareraweaponon 121schoolpropertyforeducationalpurposessolongasthefirearmisunloaded.Thelocalboard 122ofeducationshalldefineweaponinthedisciplinepolicy.Suchdefinitionshallincludethe 123weaponsdefinedinthissubsectionbutmayalsoincludeotherweapons. 124 7.Allschooldistrictpersonnelresponsibleforthecareandsupervisionofstudents 125areauthorizedtoholdeverypupilstrictlyaccountableforanydisorderlyconductinschoolor 126onanypropertyoftheschool,onanyschoolbusgoingtoorreturningfromschool,during 127school-sponsoredactivities,orduringintermissionorrecessperiods. HB1220 4 128 8.Teachersandotherauthorizeddistrictpersonnelinpublicschoolsresponsiblefor 129thecare,supervision,anddisciplineofschoolchildren,includingvolunteersselectedwith 130reasonablecarebytheschooldistrict,shallnotbecivillyliablewhenactinginconformity 131withtheestablishedpoliciesdevelopedbyeachboard,includingbutnotlimitedtopoliciesof 132studentdisciplineorwhenreportingtohisorhersupervisororotherpersonasmandatedby 133statelawactsofschoolviolenceorthreatenedactsofschoolviolence,withinthecourseand 134scopeofthedutiesoftheteacher,authorizeddistrictpersonnelorvolunteer,whensuch 135individualisactinginconformitywiththeestablishedpoliciesdevelopedbytheboard. 136Nothinginthissectionshallbeconstruedtocreateanewcauseofactionagainstsuchschool 137district,ortorelievetheschooldistrictfromliabilityforthenegligentactsofsuchpersons. 138 9.Eachschoolboardshalldefineinitsdisciplinepolicyactsofviolenceandany 139otheractsthatconstituteaseriousviolationofthatpolicy."Actsofviolence"asdefinedby 140schoolboardsshallincludebutnotbelimitedtoexertionofphysicalforcebyastudentwith 141theintenttodoseriousbodilyharmtoanotherpersonwhileonschoolproperty,includinga 142schoolbusinserviceonbehalfofthedistrict,orwhileinvolvedinschoolactivities.School 143districtsshallforeachstudentenrolledintheschooldistrictcompileandmaintainrecordsof 144anyseriousviolationofthedistrict'sdisciplinepolicy.Suchrecordsshallbemadeavailable 145toteachersandotherschooldistrictemployeeswithaneedtoknowwhileactingwithinthe 146scopeoftheirassignedduties,andshallbeprovidedasrequiredinsection167.020toany 147schooldistrictinwhichthestudentsubsequentlyattemptstoenroll. 148 10.Spanking,whenadministeredbycertificatedpersonnelandinthepresenceofa 149witnesswhoisanemployeeoftheschooldistrict,ortheuseofreasonableforcetoprotect 150personsorproperty,whenadministeredbypersonnelofaschooldistrictinareasonable 151mannerinaccordancewiththelocalboardofeducation'swrittenpolicyofdiscipline,isnot 152abusewithinthemeaningofchapter210. 153 11.Uponreceiptofanyreportsofchildabusebythechildren'sdivisionpursuantto 154sections210.110to210.165whichallegedlyinvolvepersonnelofaschooldistrict,the 155children'sdivisionshallnotifythesuperintendentofschoolsofthedistrictor,iftheperson 156namedintheallegedincidentisthesuperintendentofschools,thepresidentoftheschool 157boardoftheschooldistrictwheretheallegedincidentoccurred. 158 12.(1)Inordertoensurethesafetyofallstudents,shouldastudentbeexpelledfor 159bringingaweapontoschool,violentbehavior,orforanactofschoolviolence,thatstudent 160shallnot,forthepurposesoftheaccreditationprocessoftheMissourischoolimprovement 161plan,beconsideredadropoutorbeincludedinthecalculationofthatdistrict'seducational 162persistenceratio. 163 (2)Forthe2025-26schoolyearandallsubsequentschoolyears,ifastudentis 164suspended,expelled,orunilaterallyremovedtoaninterimeducationalsettingforanact HB1220 5 165ofschoolviolenceasrequiredunderaschooldistrict'sdisciplinepolicy,suchstudent's 166suspension,expulsion,orremovalshallnotbereportedforanycalculationsoftheschool 167district'sattendanceorenrollmentdataforthepurposesoftheaccreditationprocessof 168theMissourischoolimprovementprogramoritssuccessoraccreditationprogram. ✔ HB1220 6
