(1)Notwithstandinganyprovisionoflawtothecontrary,suchamountasduetothe 64employeeduringsaidemployee'slifeasprovidedforunderthischapterforanawardof 65permanenttotaldisabilityanddeath,exceptsuchamountshallonlybepaidwhenbenefits 66undersubdivisions(2)and(3)ofthissubsectionhavebeenexhausted; 67 80withsection287.223.Inorderforanemployertomakesuchanelection,theemployershall 81providethedepartmentwithnoticeofsuchanelectioninamannerestablishedbythe 82department.TheprovisionsofthisparagraphshallexpireonDecember31,2038;or 83 (b)Foremployerswhorejectmesotheliomaunderthissubsection,thentheexclusive 84remedyprovisionsundersection287.120shallnotapplytosuchliability.Theprovisionsof 85thisparagraphshallexpireonDecember31,2038;and 86 102morebenefitsthansuchemployeewouldreceivehavingonlyobtainedbenefitsfor 103mesotheliomaunderthissection. 287.470.1.Uponitsownmotionorupontheapplicationofanypartyinintereston 2thegroundofachangeincondition,thecommissionmayatanytimeuponarehearingafter 3duenoticetothepartiesinterestedreviewanyawardandonsuchreviewmaymakeanaward 4ending,diminishingorincreasingthecompensationpreviouslyawarded,subjecttothe 5maximumorminimumprovidedinthischapter,andshallimmediatelysendtothepartiesand 6theemployer'sinsureracopyoftheaward.Nosuchreviewshallaffectsuchawardasregards 7anymoneyspaid. 8 2.Uponthefilingofawrittenagreementsignedbytheclaimantandhisorher 9attorney,thecommissionshallchangethename,information,orfeearrangementofthe 10attorneyorlawfirmassociatedwiththeclaimant'scase. 287.610.1.AfterAugust28,2005,thedivisionmayappointadditional 2administrativelawjudgesforamaximumoffortyauthorizedadministrativelawjudges. 3Appropriationsshallbebaseduponnecessity,measuredbytherequirementsandneedsof 4eachdivisionoffice.Administrativelawjudgesshallbedulylicensedlawyersunderthelaws 5ofthisstate.Administrativelawjudgesshallnotpracticelawordolawbusinessandshall 6devotetheirwholetimetothedutiesoftheiroffice.Thedirectorofthedivisionofworkers' 7compensationshallpublishandmaintainonthedivision'swebsitetheappointmentdatesor 8initialdatesofserviceforalladministrativelawjudges. 9 2.[Thethirteenadministrativelawjudgeswiththemostyearsofserviceshallbe 10subjecttoaretentionvoteonAugust28,2008.Thenextthirteenadministrativelawjudges 11withthemostyearsofserviceindescendingordershallbesubjecttoaretentionvoteon 12August28,2012.Administrativelawjudgesappointedandnotpreviouslyreferencedinthis HCSHB123 4 13subsectionshallbesubjecttoaretentionvoteonAugust28,2016.Subsequentretention 14votesshallbeheldeverytwelveyears.Anyadministrativelawjudgewhohasreceivedtwo 15ormorevotesofnoconfidenceunderperformanceauditsbythecommitteeshallnotreceivea 16voteofretention. 17 3.Theadministrativelawjudgereviewcommitteemembersshallnothaveanydirect 18orindirectemploymentorfinancialconnectionwithaworkers'compensationinsurance 19company,claimsadjustmentcompany,healthcareprovidernorbeapracticingworkers' 20compensationattorney.Allmembersofthecommitteeshallhaveaworkingknowledgeof 21workers'compensation. 22 4.Thecommitteeshallwithinthirtydaysofcompletingeachperformanceauditmake 23arecommendationofconfidenceornoconfidenceforeachadministrativelawjudge. 24 5.]Theadministrativelawjudgesappointedbythedivisionshallonlyhave 25jurisdictiontohearanddetermineclaimsuponoriginalhearingandshallhavenojurisdiction 26uponanyreviewhearing,eitherinthewayofanappealfromanoriginalhearingorbywayof 27reopeninganyprioraward,excepttocorrectaclericalerrorinanawardorsettlementifthe 57judgeshallbesenttothegovernornolaterthanthefirstweekofeachlegislativesession 58immediatelyfollowingsuchaudit.Anyadministrativelawjudgewhohasreceivedthreeor 59morevotesofnoconfidenceundertwosuccessiveperformanceauditsbythecommitteemay 60havetheirappointmentimmediatelywithdrawn. 61 (2)Thereviewcommitteeshallconsistofonememberappointedbythepresidentpro 62temofthesenate,onememberappointedbytheminorityleaderofthesenate,onemember 63appointedbythespeakerofthehouseofrepresentatives,andonememberappointedbythe 64minorityleaderofthehouseofrepresentatives.Thegovernorshallappointtothecommittee 65onememberselectedfromthecommissiononretirement,removal,anddisciplineofjudges. 66Thismembershallactasamemberexofficioandshallnothaveavoteinthecommittee.The 67committeeshallannuallyelectachairpersonfromitsmembersforatermofoneyear.The 30thenthoseagenciesareundertheprovisionsofthislaw. 31 3.Theadministrativehearingcommissionisauthorizedtoconducthearingsandmake 32findingsoffactandconclusionsoflawinthosecasesbroughtbytheMissouristateboardfor 33architects,professionalengineers,professionallandsurveyorsandlandscapearchitects 34againstunlicensedpersonsundersection327.076. 35 4.Theadministrativehearingcommissionisauthorizedtoconducthearingsand 36makefindingsoffactandconclusionsoflawinthosecasesbroughtbythedivisionof 37workers'compensationofthedepartmentoflaborandindustrialrelationsagainst 38administrativelawjudgesundersection287.610. 39 5.Notwithstandinganyotherprovisionofthissectiontothecontrary,afterAugust 4028,1995,inordertoencouragesettlementofdisputesbetweenanyagencydescribedin 41subsection1or2ofthissectionanditslicensees,anysuchagencyshall: 42 (1)Providethelicenseewithawrittendescriptionofthespecificconductforwhich 43disciplineissoughtandacitationtothelawandrulesallegedlyviolated,togetherwithcopies 44ofanydocumentswhicharethebasisthereofandtheagency'sinitialsettlementoffer,orfilea 45contestedcaseagainstthelicensee; 46 (2)Ifnocontestedcasehasbeenfiledagainstthelicensee,allowthelicenseeatleast 47sixtydays,fromthedateofmailing,toconsidertheagency'sinitialsettlementofferandto 48contacttheagencytodiscussthetermsofsuchsettlementoffer; 49 (3)Ifnocontestedcasehasbeenfiledagainstthelicensee,advisethelicenseethatthe 50licenseemay,eitheratthetimethesettlementagreementissignedbyallparties,orwithin 51fifteendaysthereafter,submittheagreementtotheadministrativehearingcommissionfor 52determinationthatthefactsagreedtobythepartiestothesettlementconstitutegroundsfor 53denyingordiscipliningthelicenseofthelicensee;and HCSHB123 10 54 (4)Inanycontactunderthissubsectionbytheagencyoritscounselwithalicensee 55whoisnotrepresentedbycounsel,advisethelicenseethatthelicenseehastherighttoconsult 56anattorneyatthelicensee'sownexpense. 57 [5.]6.Ifthelicenseedesiresreviewbytheadministrativehearingcommissionunder 58subdivision(3)ofsubsection[4]5ofthissectionatanytimepriortothesettlementbecoming 59final,thelicenseemayrescindandwithdrawfromthesettlementandanyadmissionsoffact 60orlawintheagreementshallbedeemedwithdrawnandnotadmissibleforanypurposes 61underthelawagainstthelicensee.Anysettlementsubmittedtotheadministrativehearing 62commissionshallnotbeeffectiveandfinalunlessanduntilfindingsoffactandconclusions 63oflawareenteredbytheadministrativehearingcommissionthatthefactsagreedtobythe 64partiestothesettlementconstitutegroundsfordenyingordiscipliningthelicenseofthe 65licensee. 66 [6.]7.Whenaholderofalicense,registration,permit,orcertificateofauthority 67issuedbythedivisionofprofessionalregistrationoraboard,commission,orcommitteeofthe 68divisionofprofessionalregistrationagainstwhomanaffirmativedecisionissoughthasfailed 69topleadorotherwiserespondinthecontestedcaseandadequatenoticehasbeengivenunder 70sections536.067and621.100uponaproperlypledwritingfiledtoinitiatethecontestedcase 71underthischapterorchapter536,adefaultdecisionshallbeenteredagainstthelicensee 72withoutfurtherproceedings.Thedefaultdecisionshallgrantsuchreliefasrequestedbythe 73divisionofprofessionalregistration,board,committee,commission,orofficeinthewriting 74initiatingthecontestedcaseasallowedbylaw.Uponmotionstatingfactsconstitutinga 75meritoriousdefenseandforgoodcauseshown,adefaultdecisionmaybesetaside.The 76motionshallbemadewithinareasonabletime,nottoexceedthirtydaysafterentryofthe
