63 a.Iftheoffensesorviolationswerechargedascountsinthesamecase,allsuch
64offensesandviolationsshallcountasonlythehighestleveloffenseorviolationinthat
65caseforpurposesofdetermininglifetimelimitsonexpungementunderthissectionand
66section610.140.However,ifoneormorecountsinthesameindictmentorinformation
67orconductcommittedwereapartofthesamecourseofcriminalconductasanoffense

77purposeofanylawenforcementorprosecutorialinvestigationoractivityincludingany
78arrestorfindingsofguiltexpungedunderthissectionbyalawenforcementagency,
79criminaljusticeagency,prosecutingattorney,circuitattorney,ormunicipalprosecuting
80attorney,includingitsuseasaprioroffense,violation,orinfractioninasubsequent

82 3.(1)BeginningAugust28,2028,onamonthlybasis,theofficeofstatecourts
83administratorshallidentifyandtransmittothecentralrepositoryandevery

85daysoftherecordbecomingeligibleforautomatedexpungement.

88 (3)Delinquentcourtcosts,fines,fees,orothersumsorderedbyacourt,except

90consideredbytheofficeofstatecourtsadministratorwhendeterminingexpungementof

92statecourtsadministratorshallseekasetoffofanyincometaxrefundandlotteryprize

95 (4)Eachprosecutingagencyinthisstatehasnolaterthansixtydaysfromthe
96dayonwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmittedto
97objecttoanautomatedexpungementandtransmitsuchobjectiontoallparties.The
98prosecutingagencymayobjecttotheautomaticexpungementforanyofthefollowing
99reasons:
100 (a)Afterreviewingtheprosecutingagency'srecord,theagencybelievesthe
101recorddoesnotmeetthedefinitionofacleanslateeligiblecase;
102 (b)Thepersonhasnotpaidcourt-orderedrestitutiontothevictim;or
103 (c)Thepersonhaschargespendingagainsttheminanothercase.
104 (5)Ifaprosecutingagencyobjectsforareasondescribedinsubdivision(4)of
105thissubsection,withinsixtydaysofthedayonwhichthenoticedescribedinsubdivision
106(1)ofthissubsectionistransmitted,therecordshallnotbeexpunged.
107 (6)Ifsixtydayshavepassedwithoutanobjectionfromaprosecutingagencyor
108thecentralrepositoryforoneofthereasonssetforthunderthissubsection,theofficeof
109statecourtsadministratorshalltransmitwithinfifteendaysalltherecordstobe
110expunged,sortedbycircuit,tothepresidingjudgesofeverycircuitcourt.
111 (7)(a)Withinthirtydaysofreceivinganoticetoexpunge,thecircuitcourtshall
112issueordersforexpungementofallrecordsmaintainedinthecircuitforwhichno
113notificationofineligibilitywasreceivedbytheofficeofstatecourtsadministratorfrom
114thecentralrepositoryoraprosecutingagencyunlessthecircuitcourtdeterminesthe
115recordisnoteligibleforautomatedexpungement.
116 (b)Ifthecircuitcourtdeterminesarecordisnoteligibleforautomated

136conviction,andsentenceofthepersoninthecasetowhichtheorderorother
137notificationapplies.Thenonpublicrecordshallbemadeavailableonlytoacourtof
138competentjurisdiction,theofficeofstatecourtsadministrator,thedepartmentof
139corrections,alawenforcementagency,aprosecutingorcircuitattorney,theattorney
140general,orthegovernoruponrequestandonlyforthefollowingpurposes:

166becomeeligibleforautomatedexpungementprovidedtheindividualisnotconvictedof

169 5.Anyprobationorparoleofficereleasinganindividualfromsupervisionfora

175 6.Theprovisionsofthissectionshallapplyretroactivelytoanyarrest,charge,
176trial,andconvictionforwhichthereisadigitalrecordregardlessofthedatethatthe
177arrestwasmade,thechargeorchargeswerebrought,thetrialoccurred,orthe
178convictionwasentered.
179 7.Nothinginthissectionprecludesanindividualfromfilingapetitionfor
180expungementofrecordsundersection610.140ifanindividualiseligibleforan
181automatedexpungementunderthissectionifsuchanautomatedexpungementhasnot
182yetoccurredorcannotoccurpursuanttotheprovisionsofthissection.
183 8.Upontheoccurrenceofoneofthecircumstancesprovidedundersubdivision
184(1)or(2)ofthissubsection,aconvictionthatwasexpungedunderthissectionshallbe
185reinstatedbythecourtasprovidedinthissubsection.
186 (1)Ifitisdeterminedthataconvictionwasimproperlyorerroneouslyexpunged
187becausetheconvictionwasnoteligibletobeexpungedunderthissection,thecourtshall,
188onitsownmotion,reinstatetheconviction.
189 (2)Uponamotionbyapersonowedrestitutionoronitsownmotion,thecourt
190shallreinstateaconvictionthatwasexpungedunderthissectionforwhichtheperson
191whoseconvictionwasexpungedwasorderedtopayrestitutionifthecourtdetermines
192thatthepersonhasnotmadeagood-faithefforttopaytheorderedrestitution.
193 9.Upontheentryofanorderundersection610.140,orupontheautomated
194expungementofaconvictionunderthissection,thepetitioner,forpurposesofthelaw,
195shallbeconsiderednottohavebeenpreviouslyconvicted,exceptforpurposesofthe
196following:
197 (1)Thepetitionershallnotbeentitledtotheremissionofanyfine,costs,orother
198moneyspaidasaconsequenceofaconvictionthatisexpunged;
199 (2)Thissectionshallnotaffecttherightofthepetitionertorelyuponthe
200convictiontobarsubsequentproceedingsforthesameoffense;
201 (3)Thissectionshallnotaffecttherightofavictimofanoffensetobringor
202defendacivilactionfordamages;

610.142.BeginningAugust28,2028,theofficeofstatecourtsadministratorshall
2reporttothejudiciarycommitteesofthesenateandhouseofrepresentatives,orany
3successorcommittees,thefollowingonayearlybasis:
4 (1)Thenumberofrecordsexpungedundersubsection2ofsection610.141,by
5judicialcircuit,withdataaggregatedbyrace,sex,age,circuit,county,andoffensetype
6andlevel;and
7 (2)Thenumberofrecordstransmittedbacktotheofficeofstatecourts
8administratorfromtheMissouristatehighwaypatrol,anyprosecutingagency,orany
9circuitcourtonobjectionthattherecordisnoteligibleforautomatedexpungementor
10thattherecorddoesnotmatchdataheldinthecentralrepository,byjudicialcircuit,
11withdataaggregatedbyrace,sex,age,county,andoffensetypeandlevel.
610.143.1.Acreditbureaumayreportrecordsofarrests,indictmentspending
2trial,andconvictionsofcrimesfornolongerthansevenyearsfromfinaldisposition.
3Recordsofarrests,indictmentspendingtrial,andconvictionsofcrimesshallnolonger
4bereportedifatanytimeafteraconvictionitislearnedthatafullpardonor
5expungementhasbeengrantedforthatconviction,oratanytimeafteranarrestor
6indictmentitislearnedthataconvictiondidnotresult.
7 2.Anycreditbureauoruserofinformationthatwillfullyfailstocomplywith
8anyrequirementofthissectionwithrespecttoanyconsumerisliabletothatconsumer
9inanamountequalto:
10 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure;
11 (2)Punitivedamagesasthecourtmayallow;and

13reasonableattorney'sfeesasdeterminedbythecourt.
14 3.Anycreditbureauoruserofinformationthatisnegligentinfailingtocomply

610.144.1.(1)Thereisherebycreatedinthestatetreasurythe"Missouri
2ExpungementFund",whichshallconsistofmoneysdepositedintothefundfromany
3sourceincluding,butnotlimitedto,gifts,donations,grants,andbequests.Thestate
4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180,
5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,
6uponappropriation,moneysinthisfundshallbeusedsolelyasprovidedinsubsection2
7ofthissection.
8 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
9remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
10generalrevenuefund.
11 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
12otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
13creditedtothefund.
14 2.Thedepartmentofpublicsafety,theinformationtechnologyservicesdivision
15withintheofficeofadministration,andtheofficeofstatecourtsadministratorshall
16expendmoneysfromthefund,uponappropriation,onlyforoneormoreofthe
