SectionA.Chapter170,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection170.025,toreadasfollows:
170.025.1.Eachschooldistrictandcharterschoolshallensurethat:
2 (1)Eachelementaryschoolunderthecontrolofsuchschooldistrictorcharter
3schoolprovidesinstructionincursivewritingsothatstudentscreatereadable
4documentsthroughlegiblecursivehandwritingbytheendofthefifthgrade;and
5 (2)Eachstudentpasseswithproficiencyateacher-constructedtest
6demonstratingcompetencyinbothreadingandwritingcursive.
7 2.Thedepartmentofelementaryandsecondaryeducationmaypromulgate
8rulestoimplementtheprovisionsofthissection.Anyruleorportionofarule,asthat
9termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
10sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
11provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
12536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
13pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
14arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
15andanyruleproposedoradoptedaftertheeffectivedateofthissectionshallbeinvalid
16andvoid.
