BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section167.151,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection167.151,toreadasfollows: 167.151.1.Theschoolboardofanydistrict[,]: 2 (1)Initsdiscretion,mayadmittotheschoolpupilsnotentitledtofreeinstruction; 3and 4 (2)Shallprescribethetuitionfeetobepaidbythem,exceptasprovidedin: 5 (a)Subdivision(2)ofsubsection3ofthissection; 6 (b)Subsection6ofthissection;and[in] 7 (c)Sections167.121,167.131,167.132,[and]167.895, and168.151. 8 2.Orphanchildren,childrenwithonlyoneparentliving,andchildrenwhoseparents 9donotcontributetotheirsupport-ifthechildrenarebetweentheagesofsixandtwentyyears 10andareunabletopaytuition-mayattendtheschoolsofanydistrictinthestateinwhichthey 11haveapermanentortemporaryhomewithoutpayingatuitionfee. 12 3.(1)ForallschoolyearsendingonorbeforeJune30,2023,anyindividualwho 13paysaschooltaxinanyotherdistrictthanthatinwhichsuchindividualresidesmaysend 14suchindividual'schildrentoanypublicschoolinthedistrictinwhichthetaxispaidand 15receiveasacreditontheamountchargedfortuitiontheamountoftheschooltaxpaidtothe 16district;exceptthatanyindividualwhoownsrealestateofwhicheightyacresormoreare 17usedforagriculturalpurposesanduponwhichsuchindividual'sresidenceissituatedmay 18sendsuchindividual'schildrentopublicschoolinanyschooldistrictinwhichapartofsuch EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19realestate,contiguoustothatuponwhichsuchindividual'sresidenceissituated,liesandshall 20notbechargedtuitiontherefor;solongasthirty-fivepercentoftherealestateislocatedinthe 21schooldistrictofchoice.Theschooldistrictofchoiceshallcountthechildreninitsaverage 22dailyattendanceforthepurposeofdistributionofstateaidthroughthefoundationformula. 23 (2)ForallschoolyearsbeginningonorafterJuly1,2023,anycurrentownerof 24residentialrealpropertyoragriculturalrealpropertyoranamedbeneficiaryofatrustthat 25currentlyownsresidentialrealpropertyoragriculturalrealpropertyandthatpaysaschooltax 26inadistrictordistrictsotherthanthedistrictinwhichsuchcurrentownerorcurrent 27beneficiaryresidesmaysenduptofourofsuchowner'sorbeneficiary'schildrentoapublic 28school,excludingacharterschool,inanydistrictinwhichsuchownerortrustpayssuch 29schooltax.Forpurposesofthissubdivision,"residentialrealproperty"shallnotincludeany 30multifamilyresidentialpropertywhichexceedsfourunits.Anowneroranamedbeneficiary 31ofatrustthatcurrentlyownsresidentialrealpropertyshallnotbepermittedunderthis 32subdivisiontosendtheirchildtoadistrictoutsideofthecountyinwhichtheycurrently 33reside.Suchownerorbeneficiaryshallsendthirtydays'writtennoticetoallschooldistricts 34involvedspecifyingwhichschooldistricteachchildwillattend.Suchownerorbeneficiary 35shallalsopresentproofoftheowner'sortrust'sannualpaymentofatleasttwothousand 36dollarsofschooltaxesleviedontherealpropertyspecifiedinthissubdivisionwithinsuch 37schooldistrictandownershipofthespecifiedrealpropertyfornotlessthantheimmediately 38precedingfourconsecutiveyears.Neithertheresidentnornonresidentdistrictsshallbe 39responsibleforprovidingtransportationservicesunderthissubdivision.Theschooldistrict 40attendedshallcountachildattendingunderthissubdivisioninitsaveragedailyattendance 41forthepurposeofdistributionofstateaidunderchapter163,exceptthatsuchnonresident 42studentsshallnotbecountedinthedistrict'saveragedailyattendanceforthepurposesof 43determiningeligibilityforaidpaymentsundersection163.044. 44 4.ForanyschoolyearendingonorbeforeJune30,2023,anyownerofagricultural 45landwho,pursuanttosubsection3ofthissection,hastheoptionofsending[his]such 46individual'schildrentothepublicschoolsofmorethanonedistrictshallexercisesuchoption 47asprovidedinthissubsection.Suchpersonshallsendwrittennoticetoallschooldistricts 48involvedspecifyingtowhichschooldistrict[his]suchchildrenwillattendbyJunethirtiethin 49whichsuchaschoolyearbegins.Ifnotificationisnotreceived,suchchildrenshallattendthe 50schoolinwhichthemajorityof[his]suchindividual'spropertylies.Suchpersonshallnot 51sendanyof[his]suchindividual'schildrentothepublicschoolsofanydistrictotherthanthe 52onetowhich[he]suchindividualhassentnoticepursuanttothissubsectioninthatschool 53yearorinwhichthemajorityof[his]suchindividual'spropertylieswithoutpayingtuitionto 54suchschooldistrict. HCSHB1238 2 55 5.Ifapupilisattendingschoolinadistrictotherthanthedistrictofresidenceandthe 56pupil'sparentisteachingintheschooldistrictorisaregularemployeeoftheschooldistrict 57whichthepupilisattending,thenthedistrictinwhichthepupilattendsschoolshallallowthe 58pupiltoattendschooluponpaymentoftuitioninthesamemannerinwhichthedistrictallows 59otherpupilsnotentitledtofreeinstructiontoattendschoolinthedistrict.Theprovisionsof 60thissubsectionshallapplyonlytopupilsattendingschoolinadistrictwhichhasan 61enrollmentinexcessofthirteenthousandpupilsandnotinexcessoffifteenthousandpupils 62andwhichdistrictislocatedinacountywithacharterformofgovernmentwhichhasa 63populationinexcessofsixhundredthousandpersonsandnotinexcessofninehundred 64thousandpersons. 65 6.(1)Asusedinthissubsection,thefollowingtermsmean: 66 (a)"Contractor",anindividualwhodevotesatleasttwentypaidhoursperweek 67fulfillingemploymentrequirementsorprovidingservicestoorforthebenefitofaschool 68districtorpublicschoolemployerinsuchdistrictinanyjobtitleorpositionthatis 69coveredforanemployeewithsuchjobtitleorinsuchpositionbyaretirementsystem 70createdunderchapter169underacontractbetweensuchindividualorsuch 71individual'semployerandsuchschooldistrictorpublicschool; 72 (b)"Regularemployee",anindividualwhodevotesatleasttwentypaidhours 73perweekfulfillingemploymentrequirementsorprovidingservicestoorforthebenefit 74ofaschooldistrictorpublicschoolinsuchdistrictinanypositionthatiscoveredbya 75retirementsystemcreatedunderchapter169. 76 (2)(a)Forthe2025-26schoolyearandallsubsequentschoolyears,aschool 77districtmayadmitachildwhoseparentisacontractororregularemployeeofaschool 78districtotherthanthechild'sschooldistrictofresidenceorapublicschoolinsuch 79district,andsuchchildmayattendschoolinsuchnonresidentschooldistrict. 80 (b)Suchnonresidentschooldistrictshallallowthechildtoattendschoolinthe 81samemannerinwhichthedistrictallowsotherpupilswhoareentitledtofree 82instructiontoattendschoolinthedistrictandwithoutpayingatuitionfee. 83 (c)Suchchildshallbeconsideredaresidentpupilofsuchnonresidentdistrict 84underthedefinitionofaveragedailyattendanceinsection163.011. 85 (d)Ifsuchchildwishestoattendaschoolwithinthenonresidentdistrictthatisa 86magnetschool,anacademicallyselectiveschool,oraschoolwithacompetitiveentrance 87processthathasadmissionsrequirements,thechild'sparentshallfurnishproofthatthe 88childmeetstheadmissionsrequirementsforsuchschoolinordertoattend. 89 (3)Theschooldistrictorpublicschoolmayrequire: 90 (a)Acontractortoprovidedocumentationshowingthatsuchcontractormeets 91therequirementsofthissubsection;and HCSHB1238 3 92 (b)Acontractororregularemployeetohaveworkedaminimumnumberof 93days,nottoexceedsixty,forsuchcontractor'sorregularemployee'schildtobeeligible 94toattendschoolinsuchnonresidentschooldistrictunderthissubsection. 95 (4)Neithertheresidentdistrictnornonresidentdistrictshallberesponsiblefor 96providingtransportationservicesunderthissubsection. 97 (5)Iftheparentofanonresidentchildattendingschoolunderthissubsection 98ceasestobeacontractororregularemployeeofaschooldistrict,thechildmaycomplete 99theschoolyearasprovidedundertheprovisionsofthissubsection. ✔ HCSHB1238 4
