HB1239 10 5 (b)Graduateandundergraduatestudentsapplyingforresearchorresearch- 6relatedsupportpositions;and 7 (c)Applicantsforpositionsofvisitingresearcherwhoare: 8 a.Citizensofaforeigncountryandwhoarenotpermanentresidentsofthe 9UnitedStates;or 10 b.CitizensandpermanentresidentsoftheUnitedStateswhohaveanaffiliation 11withaninstitutionorprograminacountryofconcernoratleastoneyearofprior 12employmentortraininginacountryofconcernthatwasnotemploymentortrainingby 13anagencyoftheUnitedStatesgovernment. 14 (2)Suchscreeningisrequiredpriortointerviewingsuchapplicantsoroffering 15tosuchanapplicantapositionofemploymentorofvisitingresearcher. 16 (3)Atthediscretionofthepostsecondaryeducationalinstitutionoraffiliate 17thereof,otherapplicantsforsuchpositionsmaybescreened. 18 2.(1)Inadditiontosatisfyingallemploymentandenrollmentqualifications 19imposedbyfederallaw,thegoverningbodyofthepostsecondaryeducationalinstitution 20oraffiliatethereofshallrequirethefollowingofapplicantsdescribedinsubsection1of 21thissection: 22 (a)Aforeignapplicantshallsubmitacompletecopyoftheapplicant'spassport 23andmostrecentlysubmittedUnitedStatesDepartmentofState'sBureauofConsular 24AffairsDS-160,OnlineNonimmigrantVisaApplicationform.Afterextractionand 25submissionofallinformationrelevanttotherequirementsofthissection,a 26postsecondaryeducationalinstitutionoraffiliatethereofmaydestroyorreturnthe 27copyoftheDS-160submittedbyanapplicanttotheapplicant;and 28 (b)Allapplicantsshallsubmitthefollowing: 29 a.Acompleteresumeandcurriculumvitaelistingeverypostsecondary 30educationalinstitutionoraffiliatethereofattended; 52 (b)Contactingallemployersofthemostrecenttenyearstoverifyemployment; 53 (c)Contactingallpostsecondaryeducationalinstitutionsattendedtoverify 54enrollmentandeducationalprogress; 55 (d)Searchingpubliclistingsofpersonssubjecttosanctionsorrestrictionsunder 56federallaw; 57 (e)Submittingtheapplicant'snameandotheridentifyinginformationtothe 58FederalBureauofInvestigationoranyfederalagencyreasonablywillingtoscrutinize 59suchapplicantfornationalsecurityorcounterespionagepurposes;and 60 (f)Anyotherstepsdeemedappropriatetotheresearchintegrityoffice. 61 (2)Thepostsecondaryeducationalinstitutionoraffiliatethereofmayalsodirect 62theresearchintegrityofficetoapproveapplicantsforhirebasedonarisk-based 63determinationconsideringthenatureoftheresearchandthebackgroundandongoing 64affiliationsoftheapplicant. 65 4.(1)Therequirementsofthissectionshallbecompletedbeforeinterviewingor 66offeringanypositiontoanindividualdescribedinsubsection1ofthissectioninany 67researchorresearch-relatedsupportpositionandbeforegrantingsuchindividualany 68accesstoresearchdataoractivitiesorothersensitivedata. 69 (2)Anapplicantrequiredtobescreenedunderthissectionshallnotbe 70employedinanyresearchorresearch-relatedsupportpositioniftheapplicantfailsto 71discloseasubstantialeducational,employment,orresearch-relatedactivityor 72publicationorpresentationatthetimeofsubmittinganapplicationrequiredin 73subsection2ofthissectionunlessthedepartmenthead,oradesignee,certifiesinwriting 74thesubstanceofthenondisclosureandthereasonsfordisregardingsuchfailureto 75disclose.Acopyofsuchcertificationshallbekeptintheinvestigativefileoftheresearch HB1239 12 76integrityofficeandshallbesubmittedtothenearestFederalBureauofInvestigation 77fieldoffice. 78 5.TheresearchintegrityofficeshallreporttothenearestFederalBureauof 79Investigationfieldoffice,toanylawenforcementagencydesignatedbythegovernor, 80andtothegoverningboardofthepostsecondaryeducationalinstitutionoraffiliate 81thereofdescribedinsubsection1ofthissectiontheidentityoftheapplicantwhowas 82rejectedforemploymentbasedonthescrutinyrequiredbythissectionorotherrisk- 83basedscreening. 84 6.(1)BeforeJuly1,2026,eachpostsecondaryeducationalinstitutionoraffiliate 85thereofthathasaresearchbudgetoftenmilliondollarsormoreshallestablishan 86internationaltravelapprovalandmonitoringprogram.Theprogramshallrequire 87preapprovalandscreeningbyaresearchintegrityofficedesignatedbythepresidentor 88chiefadministrativeofficerofthepostsecondaryeducationalinstitutionoraffiliate 89thereofforanyemployment-relatedforeigntravelandemployment-relatedforeign 90activitiesengagedinbyallfaculty,researchers,andresearchdepartmentstaff.Such 91requirementshallbeinadditiontoanyothertravelapprovalprocessapplicabletothe 92postsecondaryeducationalinstitution. 93 (2)Preapprovalbytheresearchintegrityofficeshallbebasedontheapplicant's 94reviewandacknowledgmentofguidancepublishedbytheemployingpostsecondary 95educationalinstitutionoraffiliatethereofthatrelatestocountriesofconcern,countries 96undersanction,orotherrestrictionsordesignationsimposedbythestateortheUnited 97Statesgovernmentincluding,butnotlimitedto: 98 (a)Anyfederallicensingrequirements; 99 (b)Customsrules; 100 (c)Exportcontrols; 101 (d)Restrictionsontakingpostsecondaryeducationalinstitutionpropertyabroad 102including,butnotlimitedto,intellectualproperty; 103 (e)Restrictionsonpresentations,teaching,andinteractionswithforeign 104colleagues;and 105 (f)Othersubjectsimportanttotheresearchandacademicintegrityofthe 106postsecondaryeducationalinstitution. 107 (3)Preapprovalshallbebasedonthebindingcommitmentoftheindividual 108travelernottoviolatelimitationsontravelandactivitiesabroadadoptedbythe 109postsecondaryeducationalinstitutionoraffiliatethereofandtoobeyallapplicable 110federallaws. 111 (4)(a)Thepostsecondaryeducationalinstitutionoraffiliatethereofshall 112maintainrecordsofall: HB1239 13 113 a.Foreigntravelrequestsandapprovals; 114 b.Expensesreimbursedbytheinstitutionoraffiliatethereofduringsuchtravel 115including,butnotlimitedto,reimbursementsfortravel,food,andlodging;and 116 c.Paymentsandhonorariareceivedduringsuchtravelandactivitiesincluding, 117butnotlimitedto,paymentsandhonorariafortravel,food,andlodging. 118 (b)Thepostsecondaryeducationalinstitutionoraffiliatethereofshallalsokeep 119recordsofthepurposeofthetravelandanyrecordsrelatedtotheforeignactivity 120review. 121 (c)Suchrecordsshallberetainedforatleastthreeyearsoranylongerperiodof 122timerequiredbyanyotherapplicablestateorfederallaw. 123 (5)Thepostsecondaryeducationalinstitutionoraffiliatethereofshallprovidean 124annualreportofforeigntraveltocountriesofconcernlistingindividualtravelers, 125foreignlocationsvisited,andforeigninstitutionsvisitedtothecoordinatingboardfor 126highereducation. 127 7.(1)Subjecttotheapprovalofapostsecondaryeducationalinstitution's 128governingbody,apostsecondaryeducationalinstitutionshallenterintoaneworrenew 129anexistingacademicpartnershipwithanacademicorresearchinstitutionlocatedina 130countryofconcernonlyifthepostsecondaryeducationalinstitutionmaintainssufficient 131structuralsafeguardstoprotectthepostsecondaryeducationalinstitution'sintellectual 132property,thesecurityofthisstate,andthenationalsecurityinterestsoftheUnited 133States.Thepostsecondaryeducationalinstitution'sgoverningbodyshallapprovea 134postsecondaryeducationalinstitution'spartnershiponlyifthegoverningbody,in 135consultationwiththeattorneygeneral,determinesthepartnershipmeetsthesafeguard 136requirementsrequiredunderthissubsection. 137 (2)Thesafeguardrequirementsshallinclude,butnotbelimitedto,allofthe 138following: 139 (a)Compliancewithallfederalrequirementsincluding,butnotlimitedto,the 140requirementsoffederalresearchsponsorsandfederalexportcontrolagenciesincluding, 141butnotlimitedto,regulationsregardinginternationaltrafficinarmsandexport 142administrationregulationsandeconomicandtradesanctionsadministeredbythe 143UnitedStatesDepartmentoftheTreasury'sOfficeofForeignAssetsControl,orits 144successor;
