8 (2)Notwithstandingsubdivision(1)ofthissubsection,inschoolyear2019-20and
9subsequentyears,adistrictshallberequiredtomakeupthefirstthirty-sixhoursofschoollost
10orcancelledduetoinclementweatherandhalfthenumberofhourslostorcancelledinexcess
11ofthirty-sixifthemakeupofthehoursisnecessarytoensurethatthedistrict'sstudentsattend
12aminimumofonethousandforty-fourhoursfortheschoolyear,exceptasotherwiseprovided
13undersubsections3and4ofthissection.

15exemptfromtherequirementtomakeupdaysofschoollostorcancelledduetoinclement
16weatherintheschooldistrictwhentheschooldistricthasmadeupthesixdaysrequiredunder
17subsection2ofthissectionandhalfthenumberofadditionallostorcancelleddaysupto
18eightdays,resultinginnomorethantentotalmake-updaysrequiredbythissection.
19 (2)Inschoolyear2019-20andsubsequentyears,aschooldistrictmaybeexempt
20fromtherequirementtomakeupschoollostorcancelledduetoinclementweatherinthe
21schooldistrictwhentheschooldistricthasmadeupthethirty-sixhoursrequiredunder
22subsection2ofthissectionandhalfthenumberofadditionallostorcancelledhoursupto
23forty-eight,resultinginnomorethansixtytotalmake-uphoursrequiredbythissection.
24 4.Thecommissionerofeducationmayprovide,foranyschooldistrictthatcannot
25meettheminimumschoolcalendarrequirementasprovidedinsection171.031,uponrequest,
26awaivertobeexcusedfromsuchrequirement.Thiswaivershallberequestedfromthe
27commissionerofeducationandmaybegrantediftheschoolwasclosedduetocircumstances
28beyondschooldistrictcontrol,includinginclementweatherorfire.
29 5.(1)Exceptasotherwiseprovidedinthissubsection,inschoolyear2020-21and
30subsequentyears,adistrictshallnotberequiredtomakeupanyhoursofschoollostor
31cancelledduetoexceptionaloremergencycircumstancesduringaschoolyearifthedistrict
32hasanalternativemethodsofinstructionplanapprovedbythedepartmentofelementaryand
33secondaryeducationforsuchschoolyear.Exceptionaloremergencycircumstancesshall
34include,butnotbelimitedto,inclementweather,autilityoutage,oranoutbreakofa
35contagiousdisease.Thedepartmentofelementaryandsecondaryeducationshallnotapprove
36anysuchplanunlessthedistrictdemonstratesthattheplanwillnotnegativelyimpact
37teachingandlearninginthedistrict.
38 (2)Ifschoolisclosedduetoexceptionaloremergencycircumstancesandthedistrict
39hasanapprovedalternativemethodsofinstructionplan,thedistrictshallnotifystudentsand
40parentsoneachdayoftheclosurewhetherthealternativemethodsofinstructionplanistobe
41implementedforthatday.Iftheplanistobeimplementedonanydayoftheclosure,the
42districtshallensurethateachstudentreceivesassignmentsforthatdayinhardcopyformor
43receivesinstructionthroughvirtuallearningoranothermethodofinstruction.
44 (3)Adistrictwithanapprovedalternativemethodsofinstructionplanshallnotuse
45alternativemethodsofinstructionasprovidedforintheplanformorethanthirty-sixhours
46duringaschoolyear.Adistrictthathasusedsuchalternativemethodsofinstructionfor
47thirty-sixhoursduringaschoolyearshallberequired,notwithstandingsubsections2and3of

54 (5)Anydistrictwishingtousealternativemethodsofinstructionunderthis

57 (a)Themannerinwhichthedistrictintendstostrengthenandreinforceinstructional
58contentwhilesupportingstudentlearningoutsidetheclassroomenvironment;

97otherequitablereliefaswellaspaymentofreasonableattorney'sfees,costs,andlegal

100 (4)Thestatedepartmentofelementaryandsecondaryeducationmay
101promulgateallnecessaryrulesandregulationsfortheadministrationofthissection.
102Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreated
103undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
104withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section
105536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvested
106withthegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate,

22schooldistrictwhentheschooldistricthasmadeupthethirty-sixhoursrequiredunder
23subsection2ofthissectionandhalfthenumberofadditionallostorcancelledhoursupto
24forty-eight,resultinginnomorethansixtytotalmake-uphoursrequiredbythissection.
25 4.Thecommissionerofeducationmayprovide,foranyschooldistrictthatcannot
26meettheminimumschoolcalendarrequirementofatleastonehundredseventy-fourdaysfor
27schoolswithafive-dayschoolweekoronehundredforty-twodaysforschoolswithafour-
28dayschoolweekandonethousandforty-fourhoursofactualpupilattendanceor,inschool
29year2019-20andsubsequentyears,onethousandforty-fourhoursofactualpupilattendance,
30uponrequest,awaivertobeexcusedfromsuchrequirement.Thiswaivershallberequested
31fromthecommissionerofeducationandmaybegrantediftheschoolwascloseddueto
32circumstancesbeyondschooldistrictcontrol,includinginclementweatherorfire.
33 5.(1)Exceptasotherwiseprovidedinthissubsection,inschoolyear2020-21and
34subsequentyears,adistrictshallnotberequiredtomakeupanyhoursofschoollostor
35cancelledduetoexceptionaloremergencycircumstancesduringaschoolyearifthedistrict

48 (3)Adistrictwithanapprovedalternativemethodsofinstructionplanshallnotuse
49alternativemethodsofinstructionasprovidedforintheplanformorethanthirty-sixhours
50duringaschoolyear.Adistrictthathasusedsuchalternativemethodsofinstructionfor
51thirty-sixhoursduringaschoolyearshallberequired,notwithstandingsubsections2and3of

54 (4)Thedepartmentofelementaryandsecondaryeducationshallgivedistrictswith

56alternativemethodsofinstructionbyconsideringsuchhoursashoursinwhichschoolwas
57actuallyinsession.
58 (5)Anydistrictwishingtousealternativemethodsofinstructionunderthis
59subsectionshallsubmitanapplicationtothedepartmentofelementaryandsecondary
60education.Theapplicationshalldescribe:
61 (a)Themannerinwhichthedistrictintendstostrengthenandreinforceinstructional
62contentwhilesupportingstudentlearningoutsidetheclassroomenvironment;
63 (b)Theprocessthedistrictintendstousetocommunicatetostudentsandparentsthe
64decisiontoimplementalternativemethodsofinstructiononanydayofaclosure;
