HB1280 2 11 (5)Bars,taverns,restaurantsthatseatlessthanfiftypeople,bowlingalleysand 12billiardparlors,whichconspicuouslypostsignsstatingthat"NonsmokingAreasare 13Unavailable"; 14 (6)Privateresidences;and 15 (7)Anyenclosedindoorarena,stadiumorotherfacilitywhichmaybeusedfor 16sportingeventsandwhichhasaseatingcapacityofmorethanfifteenthousandpersons. 191.775.Nopersonshallsmokeorotherwiseusetobacco[,] ortobaccoproducts, 2marijuanaormarijuanaproducts,orvaporproducts,assuchtermisdefinedinsection 3407.925,inanyindoorareaofapublicelementaryorsecondaryschoolbuildingor 4educationalfacility,excludinginstitutionsofhighereducation,oronbusesusedsolelyto 5transportstudentstoorfromschoolortotransportstudentstoorfromanyplacefor 6educationalpurposes.Anyschoolboardofanyschooldistrictmaysetpolicyonthe 7permissibleusesoftobaccoormarijuanaproductsorvaporproductsinanyother 8nonclassroomornonstudentoccupantfacility,andontheschoolgroundsoroutdoorfacility 9areasastheschoolboarddeemsproper. 191.776.Nopersonshallsmokeorotherwiseusetobaccoormarijuanaproductsin 2anyareaofachildcarefacilitylicensedbythedepartmentofhealthandseniorservices 3pursuanttotheprovisionsofsections210.201to210.245duringtheperiodoftimewhenthe 4childrencaredforunderthatlicensearepresent.Anypersonwhoviolatestheprovisionsof 5thissectionshallbeguiltyofaninfraction. 290.145.Itshallbeanimproperemploymentpracticeforanemployertorefuseto 2hire,ortodischarge,anyindividual,ortootherwisedisadvantageanyindividual,withrespect 3tocompensation,termsorconditionsofemploymentbecausetheindividualuseslawful 4alcohol, marijuana,ortobaccoproductsoffthepremisesoftheemployerduringhourssuch 5individualisnotworkingfortheemployer,unlesssuchuseinterfereswiththedutiesand 6performanceoftheemployee,theemployee'scoworkers,ortheoveralloperationofthe 7employer'sbusiness;exceptthat,nothinginthissectionshallprohibitanemployerfrom 8providingorcontractingforhealthinsurancebenefitsatareducedpremiumrateorata 9reduceddeductiblelevelforemployeeswhodonotsmokeorusetobaccoormarijuana 10products.Religiousorganizationsandchurch-operatedinstitutions,andnot-for-profit 11organizationswhoseprincipalbusinessishealthcarepromotionshallbeexemptfromthe 12provisionsofthissection.Theprovisionsofthissectionshallnotbedeemedtocreateacause 13ofactionforinjunctiverelief,damagesorotherrelief. ✔ HB1280 3
