SectionA.Section249.422,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection249.422,toreadasfollows:
249.422.1.Ifapprovedbyamajorityofthevotersvotingontheproposal,anycity,
2town,villageorcountyonbehalfoftheunincorporatedarea,locatedeitherwithinthe
3boundariesofasewerdistrictestablishedpursuanttoArticleVI,Section30(a)ofthe
4MissouriConstitutionorwithinanycountyofthefirstclassificationhavingacharterformof
5governmentwithapopulationofmorethantwohundredtenthousandinhabitantsbutless
6thanthreehundredthousandinhabitants,maybycity,town,villageorcountyordinancelevy
7andimposeannuallyfortherepairoflateralsewerservicelinesonorconnectingresidential
8propertyhavingsixorlessdwellingunitsafeenottoexceed[fifty] onehundreddollarsper
9year.Anycity,town,village,orcountythatestablishesorincreasesthefeeusedtorepairany
10portionofthelateralsewerservicelineshallincludealldefectiveportionsofthelateralsewer
11servicelinefromtheresidentialstructuretoitsconnectionwiththepublicsewersystemline.
12Notwithstandinganyprovisionofchapter448,thefeeimposedpursuanttothischaptershall
13beimposeduponcondominiumsthathavesixorlesscondominiumunitsperbuildingand
14eachcondominiumunitshallberesponsibleforitsproportionateshareofanyfeecharged
15pursuanttothischapter,andinaddition,anycondominiumunitshall,ifdeterminedtobe
16responsibleforandservedbyitsownindividuallateralsewerline,betreatedasanindividual
17residenceregardlessofthenumberofunitsinthedevelopment.Itshallbetheresponsibility
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18ofthecondominiumownerorcondominiumassociationwhoareoftheopinionthattheyare
19notproperlyclassifiedasprovidedinthissectiontonotifythecountyofficeadministeringthe
20program.WhereanexistingsewerlateralprogramwasineffectpriortoAugust28,2003,
21condominiumandapartmentunitsnotpreviouslyenrolledmaybeineligibleforenrollmentif
22itisdeterminedthatthesewerlateralservingtheunitisdefective.
23 2.Thequestionshallbesubmittedinsubstantiallythefollowingform:
24 Shallamaximumchargenottoexceed[fifty] onehundreddollarsbe
25 assessedannuallyonresidentialpropertyforeachlateralsewerservice
26 lineservingsixorlessdwellingunitsonthatpropertyand
27 condominiumsthathavesixorlesscondominiumunitsperbuilding
28 andanycondominiumresponsibleforitsownindividuallateralsewer
29 linetoprovidefundstopaythecostofcertainrepairsofthoselateral
30 sewerservicelineswhichmaybebilledquarterlyorannually?

32 3.Ifamajorityofthevotersvotingthereonapprovetheproposalprovidedforin
33subsection2ofthissection,thegoverningbodyofthecity,town,villageorcountymayenact
34anordinanceforthecollectionandadministrationofsuchfeeinordertoprotectthepublic
35health,welfare,peaceandsafety.Thefundscollectedpursuanttosuchordinanceshallbe
36depositedinaspecialaccounttobeusedsolelyforthepurposeofpayingforalloraportion
37ofthecostsreasonablyassociatedwithandnecessarytoadministerandcarryoutthe
38defectivelateralsewerservicelinerepairs.Allinterestgeneratedondepositedfundsshallbe
39accruedtothespecialaccountestablishedfortherepairoflateralsewerservicelines.
