27unitsthatservelow-incomecustomersshallbeconsideredlow-incomecustomersiffifty
28percentormoreofthetenantsqualifyunderthisdefinition.Certainentities,
29organizations,andinstitutionsthatarefocusedonsocialwelfareandthatservethelow-
30incomecustomercommunitymayalsoqualifyincluding,butnotlimitedto,homeless
31shelters,halfwayhouses,soupkitchens,fosterhomes,orphanages,andothersimilar
32organizations;
33 (6)"Retailelectricsupplier",anymunicipalutility,electricalcorporation
34regulatedunderchapter386,orruralelectriccooperativeunderchapter394that
35providesretailelectricserviceinthisstate;
36 (7)"Subscriber",aretailcustomerofaretailelectricsupplierwhoownsoneor
37moresubscriptionstoacommunitysolarfacilityinterconnectedwiththecustomer's
38retailelectricsupplier."Subscriber"shallincludearetailcustomerwhoownsaportion
39ofacommunitysolarfacility.Asubscriber'ssubscriptionsizeshallbeonehundred
40twentypercentorlessofthetwelve-monthrollingaveragekilowatt-hourusageforany
41onesubscribermeter;
42 (8)"Subscriberadministrator",anentitythatrecruitsandenrollssubscribers,
43administerssubscriberparticipationincommunitysolarfacilities,andmanagesthe
44subscriptionrelationshipbetweensubscribersandaretailelectricsupplier;
45 (9)"Subscription",acontractbetweenasubscriberandsubscriber
46administratorofacommunitysolarfacilitythatentitlesthesubscribertoabillcredit
47againstthesubscriber'sretailelectricbill;
48 (10)"Unsubscribedenergy",theoutputofacommunitysolarfacility,measured
49inkilowatt-hours,thatisnotallocatedtosubscribers.
50 2.Eachretailelectricsuppliershallimplementathree-yearcommunitysolar
51pilotprogramtorunduringcalendaryears2026through2028.Retailelectricsuppliers
52shallallowsubscriberadministratorsandownersoroperatorsofcommunitysolar
53facilitiestorecruitcustomersassubscribersandshallprocesssubscribers'billcreditsas
54requiredbysubdivision(5)ofsubsection3ofthissection.Eachretailelectricsupplier's

56retailelectricsupplier'selectricitysalesforthepreviousyearforeachofthethreeyears
57ofthepilotprogram.
58 3.(1)Acommunitysolarfacilityshallbeauthorizedunderthefollowing
59conditions:
60 (a)Acommunitysolarfacilitymaybebuilt,owned,oroperatedbyathird-party
61entityundercontractwithanowneroroperatorofacommunitysolarfacilityora
62subscriberadministrator.Asubscriberadministratormaycontracttoadministerbill
63creditstothesubscriber'selectricitybill,generatedbythesubscriber'sshareofthe
64communitysolarfacility,subjecttotherequirementsofthissection.Asubscriber
65administratorthatprovidesbillcreditstoasubscriberunderthissectionshallnotbe
66consideredanelectricalcorporationorpublicutilityundersection386.020forpurposes
67ofdeterminingjurisdictionofthecommission;
68 (b)Theowneroroperatorofacommunitysolarfacilitymayserveasa
69subscriberadministratorormaycontractwithathirdpartytoserveasasubscriber
70administratoronbehalfoftheowneroroperator.Nothinginthissectionshallpreventa
71retailelectricsupplierfromowningoroperatingacommunitysolarfacilityorfrom
72actingasasubscriberadministratoraspartofitsowncommunitysolarpilotprogram;
73 (c)Exceptasprovidedunderparagraph(d)ofthissubdivision,thepricepaid
74forasubscriptiontoacommunitysolarfacilityshallnotbesubjecttoregulationbythe
75commission;and
76 (d)NolaterthanninemonthsafterAugust28,2025,thecommissionshall
77establishthevalueofthebillcreditforeachretailelectricsuppliertooffseteach
78subscriber'sretailelectricbillforeachkilowatt-hoursubscribedfromacommunity
79solarfacility.Thecommissionshallestablishthebillcreditvalueinsuchawayasto
80allowforthecreation,financing,accessibility,andoperationofcommunitysolar
81facilitiesandtomaximizecustomerparticipationsoastomeetthegoaloftwopercentof
82electricitysalesperyearasrequiredbysubsection2ofthissection.Thecommission
83shallestablishanadditionalbillcreditvalueforsubscriberswhoarelow-income
84customersinsuchawayastoensurethatlow-incomecustomerssavemoneyontheir
85retailelectricbills.
86 (2)Aretailelectricsuppliershallallowforthetransferabilityandportabilityof
87subscriptions,includingallowingasubscribertoretainasubscriptiontoacommunity
88solarfacilityifthesubscriberrelocateswithinthesameretailelectricsupplier's
89territory.
90 (3)Onamonthlybasis,asubscriberadministratorshallupdatethesubscriber
91administrator'slistofsubscribersandprovideallofthefollowinginformationabout
HB1322	3 92eachsubscribertotheretailelectricsupplierinastandardizedelectronicformat
93approvedbythecommissionforthepurposeofbillcredittosubscribers:
94 (a)Thename,address,accountnumber,andmeternumber;
95 (b)Thekilowatt-hoursofelectricitygenerationattributabletoeachsubscriber;
96and
97 (c)Ifasubscriberadministratorisusingtheretailelectricsupplier'sbilling
98methodstocollectsubscriptionfees,thesubscriptionfeeforthemonthowedbyeach
99subscribertothesubscriberadministrator.
100 (4)Asubscriberadministratororthirdpartyowningoroperatingacommunity
101solarfacilityshallnotbeconsideredaretailelectricsupplieroranelectricgeneration
102providersolelyasaresultofinvolvementwithacommunitysolarfacilityasdefinedby
103thischapter.
104 (5)Retailelectricsuppliersshallhavethefollowingduties:
105 (a)Onamonthlybasis,aretailelectricsuppliershallprovidetoasubscriber
106administratorareportinastandardizedelectronicformatindicatingthetotalvalueof
107thebillcreditgeneratedbythecommunitysolarfacilityinthepriormonthandthe
108amountofthebillcreditappliedtoeachsubscriber;
109 (b)Aretailelectricsuppliershallprovideabillcredittoasubscriber'snext
110monthlyelectricbillfortheproportionaloutputofacommunitysolarfacility
111attributabletothesubscriberinthesamemannerasifthesolarfacilitywerelocated
112onthecustomer'sproperty;
113 (c)Ifrequestedbyasubscriberadministrator,aretailelectricsuppliershall
114includeasubscriber'ssubscriptionfeeonthemonthlybillandforwardthecollected
115subscriptionfeestothesubscriberadministratoronamonthlybasis;and
116 (d)Nolaterthanoneyearaftertheeffectivedateofthissection,aretailelectric
117suppliershallmakeavailableandupdate,inacommerciallyreasonablemanner,a
118systemmapshowingtheloadingofthedistributionsystemandindicatingwhereinthe
119serviceterritorythedistributionsystemcouldaccommodatenewsolargeneration.
120 (6)Retailelectricsuppliersshallbecompensatedinthefollowingmanner:
121 (a)Asubscriberadministratorshallcompensatearetailelectricsupplierforthe
122retailelectricsupplier'sreasonabledirectcostsofinterconnectionofacommunitysolar
123facility.Suchcompensationshallbeintheformofaone-timepaymentupon
124interconnection;and
125 (b)Aretailelectricsuppliershallbeentitledtorecoveritsreasonabledirectcosts
126ofcomplyingwiththerequirementsofthissectionandenablingacommunitysolar
127facilitywithinitsserviceterritoryincluding,butnotlimitedto,addedbillingcostsand
128addedcostsofnetmeteringandinterconnectionforcommunitysolarfacilities.These
HB1322	4 129reasonabledirectcostsshallbeintheformofanannualfeeinvoicedtothesubscriber
130administratorbasedonthetotalfinalsystemsizeofthecommunitysolarfacility.
131 (7)Eachcommunitysolarfacilityshallbesubscribedwithatleasttenpercent
132low-incomecustomersandtwentypercentresidentialcustomers.
133 (8)Aretailelectricsuppliershallpurchaseunsubscribedenergyfroma
134communitysolarfacilityattheretailelectricsupplier'savoidedcostasapprovedbythe
135commission.NolaterthanninemonthsafterAugust28,2025,thecommissionshall
136establishregulationsnecessarytoeffectuatethissectionregardingthepurchaseof
137unsubscribedenergy.
138 (9)Noentity,affiliatedentity,orentitiesundercommoncontrolshalldevelop,
139own,oroperatemorethanonecommunitysolarfacilityonthesameparcelor
140contiguousparcelsofland.
141 4.Interconnectionstandardsforcommunitysolarfacilitiesunderonehundred
142kilowattsshallbethesameasthoseforcustomer-generatorsundersection386.890.For
143systemslargerthanonehundredkilowatts,thecommissionshalldeveloptechnicaland
144netmeteringinterconnectionrulesforcustomer-generatorsintendingtooperate
145communitysolarfacilitiesorrenewableon-sitegeneratorsinparallelwiththeelectric
146utilitygrid,consistentwithrulesdefinedinotherstateswithintheserviceregionofthe
147regionaltransmissionorganizationthatmanagesthetransmissionsysteminanypartof
148thisstate.Indevelopingitsrules,thecommissionshallconveneastakeholderprocessto
149developstatewidetechnicalandnetmeteringrulesforcustomergeneratorswithsystems
150largerthanonehundredkilowatts.
151 5.Thecommissionshallpromulgaterulesandregulationstoimplementthe
152provisionsofthissectionwithinninemonthsofAugust28,2025.Anyruleorportionof
153arule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority
154delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjectto
155alloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissectionand
156chapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
157pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
158arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
159andanyruleproposedoradoptedafterAugust28,2025,shallbeinvalidandvoid.
