Missouricenterforagroforestry,theUniversityofMissouriextensionservice, 4 theMissouridepartmentofnaturalresources,privateindustrycouncilsandthe 5 Missouridepartmentofagriculture,anagroforestryprogram.Theprogram 6 shallbedesignedtoencouragethedevelopmentofastateprogramof 7 agroforestry,andshallencouragesoilconservationanddiversificationsofthe 8 state'sagriculturalbasethroughtheuseoftreesplantedinanagroforestry 9 configurationtoaccommodatealleycropping,forested-riparianbuffers, 10 silvopastureandwindbreaks.] acreofeligiblelandshallbeanamountwhich,whenaddedtoanycashorin- 8 kindnetincomeproducedbycropsraisedontheland,issubstantiallyequalto 9 theamountperacrepreviouslypaidorwhichwouldhavebeenpaidtothe 10 landownerunderthefederalconservationreserveprogram. 11 3.Ifanapplicationmadepursuanttosection252.315isapprovedby 12 thedirector,thedirectorshalldevelopascheduleofannualpaymentstobe 13 madebythestate. 14 4.Thestateshallnotmakeanypaymenttoalandownertomaintain 15 theuseofeligiblelandduringtheenhancementphaseforagroforestry 16 purposesaftertenyearshaveelapsedsincethefirstsuchincentivepaymentis 17 naturalresourcesfromthetaximposedbySections47(a),47(b)and47(c)of 5 ArticleIVoftheConstitutionofMissouri,fundsappropriatedbythegeneral 6 assemblyforthatpurpose,grants,bequestsorgifts,oranycombination 7 thereof.] [252.315.1.Toparticipateintheprogram,thelandownershallmake 2 applicationtothedirectorinwriting.Thewrittenapplicationshallshowthe 3 numberofacrestobeplacedintheprogramandthatthelandwhichistobe 4 placedintheagroforestryprogrammeetstheeligibilityrequirementsofthis 5 section.Theapplicationshallalsocontainadetailedplanofthelandowner's 6 proposaltomeettherequirementsofsections252.300to252.333,including 7 thetypeandnumberoftreestobeplanted,established,ormanaged,thetype 8 ofcompatiblegrass,othercropsandsuchotherinformationasmaybedeemed 9 necessary.Thenumberoftreesrequiredtosatisfyeligibilitymayvarywith 10 agroforestrypractice,butineachcaseshallbeasufficientnumbertoguarantee 11 thesuccessofthepracticeandshallbeconsistentwithstandardsestablished 12 foreachpractice. 13 2.Thedirectorshallrevieweachapplication.Inreviewingthe 14 applicationthedirectorshalldeterminethetypeortypesofsoillocatedinthe 15 areaofthelandproposedtobeincludedintheagroforestryprogramandshall 16 applythelandcapabilityclassificationsystemtodeterminethepotentialor 17 limitationsofthelandforinclusionintheprogram.Beforethedirectoracts 18 upontheapplication,anon-siteinspectionshallbemadebyarepresentativeof 19 thedepartmentofconservationoritsapprovedagent.Theinspecting 20 representativeshallattesttotheefficacyoftheagroforestryplantobeused, 21 thenumberofacrestobeplacedunderagroforestrymanagement,thespecies 22 andnumberoftreestobeplanted,established,ormanaged,andothercrop 23 componentsoftheproposedprogram.Afterthereportoftheon-siteinspector 24 andthereviewbythedirector,thedirectorshalldeterminethelandowner's HB1366 3 25 eligibilitytoparticipateintheagroforestryprogramandshalldeterminethe 26 amountofcostsharing,includingin-kindandlaborcomponents,forthe 27 landowner.Ifthedirectorfailstoapproveanapplication,theaggrieved 28 landownermayrequestahearingbeforetheconservationcommissionorits 29 authorizedrepresentativewithinthirtydaysofnoticetothelandownerofthe 30 failureoftheconservationdepartmenttoapprovetheapplication,orthe 31 landownermayproceedundertheprovisionsofsection536.150asiftheactof 32 theconservationdepartmentwasonenotsubjecttoadministrativereview.If 33 anactionisbroughtpursuanttosection536.150,venueshallbeinCole 34 County.] [252.318.1.Alllandparticipatingintheagroforestryprogramshall 2 beinspectedannuallybyarepresentativeofthedirector,toensurethattheland 3 continuestocomplywiththerequirementsofsections252.300to252.333and 4 thatpracticespecificationsarebeingmaintainedinaccordancewithapplicable 5 rulesandregulations. 6 2.Iftheannualinspectiondeterminesthatthelandisnolongerin 7 compliancewiththeprovisionsofsections252.300to252.333orwiththe 8 rulesandregulationspromulgatedpursuanttotheprovisionsofsections 9 252.300to252.333,thedirectorshallnotifythelandownerofthatfactand 10 shalldetailthespecificsinwhichthelandfailstomeettherequirements.The 11 landownermayrespondtothenoticewithinthirtydaysofreceipt,eitherby 12 contestingtheinspectionreportorbyprovidingthedirectorwithaproposalto 13 correcttheproblemswhichformthebasisofthenotice.Ifthelandowner 14 conteststhefindingsoftheannualinspection,theaggrievedlandownermay 15 requestahearingbeforetheconservationcommissionoritsauthorized 16 representativeorthelandownermayproceedundertheprovisionsofsection 17 536.150,asiftheactoftheconservationdepartmentwasonenotsubjectto 18 administrativereview.Ifanactionisbroughtpursuanttosection536.150, 19 venueshallbeinColeCounty.Ifthelandownerprovidesthedirectorwitha 20 proposaltocorrecttheproblemswhichformthebasisofthenotice,the 21 agroforestryprogrambypresentingaforecastofanticipatedeconomic 7 developmentsfromtheafforestationinthestateasaresultofthe 8 agroforestryprogram; 9 (2)Suggestspublicorprivatesectorinitiativesthatwillpotentially 10 servetomaximizetheeconomicbenefitsforrelatednewdevelopmentand 11 expansionofexistingbusinessesresultingfromtheagroforestryprogram; 12 (3)Suggestsmethodstopromotethedevelopmentofwoodandother 13 forestryrelatedproducts; 14 (4)Suggestspublicorprivatesectorinitiativesormethodswhichwill 15 resultinsignificantincreasesinjobopportunitiesandemployment. 16 2.Thereportshallbesubmittedtothegovernorandtothegeneral 17 assemblybyJanuarythirty-firstofeachofthefollowingyears:1996,2001, 18
