SectionA.Chapter210,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection210.212,toreadasfollows:
210.212.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Aquaticactivity",anactivityinvolvingapoolorotherbodyofwater,
3includingcanoeing,thatmayexposeachildtoariskofseriousinjurybecauseofthe
4inherentdangeroftheactivity;
5 (2)"Campcounselor",anemployeeofasummercampwhointeractswithandis
6responsibleforthesupervisionandsafetyofchildrenatasummercampandengagesin
7activitiesincluding,butnotlimitedto,planningandleadinggroupevents,maintaininga
8scheduleofactivitiesforchildrenatthecamp,andrespondingtosafetyorbehavioral
9incidents;
10 (3)"Medicalemergency",aninjuryorthesuddenand,atthetime,unexpected
11onsetofahealthconditionthatmanifestsitselfbysymptomsofsufficientseveritythat
12wouldleadaprudentlayperson,possessinganaverageknowledgeofhealthand
13medicine,tobelievethattheabsenceofimmediatemedicalcarecouldresultin:
14 (a)Placingtheperson'shealthinsignificantjeopardy;
15 (b)Seriousimpairmenttoabodilyfunction;
16 (c)Seriousdysfunctionofanybodilyorganorpart;or
17 (d)Inadequatelycontrolledpain;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (4)"Summercamp",aprogramoperatedfromMaytoSeptemberbyaperson
19ororganizationwiththeprimaryfunctionofprovidingasummerrecreationalprogram
20forchildrenfiveyearsofageorolderandprovidingnochildcareforchildrenunderfive
21yearsofageinthesamespaceorinthesameoutdoorplayareasimultaneously.
22"Summercamp"shallnotincludeanyreligion-basedsummercamp.
23 2.Anypersonororganizationoperatingasummercampinthisstateshall
24ensurethatemployeesofthesummercamparecertifiedinoperatingequipmentusedin
25anyaquaticactivityofferedbythesummercamp.
26 3.(1)Anypersonororganizationoperatingasummercampinthisstateshall
27establishandretainonsiteawrittensite-specificemergencyplan,whichshallbe
28approvedbythedirectorofthesummercamp,outliningproceduresthataddressthe
29followingemergencysituations:
30 (a)Naturaldisasters;
31 (b)Alostchildorchildren;
32 (c)Fires;
33 (d)Transportationemergencies;
34 (e)Medicalemergencies;
35 (f)Unauthorizedpersonsonornearthepremisesofthesummercamp;
36 (g)Aquaticemergencies,asappropriateforthesite;and
37 (h)Otheremergencysituations,asappropriateforthesite.
38 (2)Summercampemployees,includingthedirectorandcampcounselors,shall
39betrainedinimplementingtheemergencyplanproceduresprovidedforunder
40subdivision(1)ofthissubsection.
41 4.Atleastfiftypercentofthecampcounselorsemployedbyasummercamp,
42andanydirectoremployedbyasummercamp,shallbetrainedincardiopulmonary
43resuscitationandintheuseofanautomatedexternaldefibrillator.
44 5.Anyaquaticactivityofferedbyasummercamptochildrenattendingthe
45summercampandanyrelatedequipmentshallbeinspectedannuallybytherelevant
46statedepartmentincluding,butnotlimitedto,thedepartmentofhealthandsenior
47services,thedepartmentofpublicsafety,orthedepartmentofconservation.Such
48inspectionsmaybecompletedbylocalagenciesifthestandardsemployedbylocal
49personnelaresubstantiallyequivalenttostatestandardsandlocalpersonnelare
50availableforenforcementofsuchstandards.
51 6.Thedepartmentofelementaryandsecondaryeducationshallmaintainalist
52ofalllicensedsummercampsinthisstateandanycomplaintsagainstanyofthose
53summercamps.Suchinformationshallbemadeavailabletothepublic.
HB1377	2 54 7.Itshallbeunlawfulforanypersonororganizationtoestablish,maintain,or
55operateasummercampthathasnotobtainedalicenseunderthissectionfromthe
56departmentofelementaryandsecondaryeducation.Everysummercampshalldisclose
57thelicensurestatusofthecamptotheparentsorguardiansofthechildrenforwhichthe
58campprovidesrecreationinthesummer.
59 8.Anypersonororganizationoperatingasummercampinthisstateshall
60maintainrecordsofallinspectionsrequiredundersubsection5ofthissectionofaquatic
61activitiesofferedbythesummercamptochildrenattendingthesummercampandof
62anyrelatedequipment.
63 9.Allcampcounselorsshallbesubjecttoacriminalbackgroundcheck.Such
64backgroundcheckshallinclude:
65 (1)AstateandFederalBureauofInvestigationfingerprintcheck;
66 (2)AsearchoftheNationalSexOffenderRegistry;and
67 (3)Asearchofthefollowingregistries,repositories,ordatabasesinMissouri,
68thestatewherethecampcounselorresides,andeachstatewheresuchcampcounselor
69residedduringtheprecedingfiveyears:
70 (a)Thestatecriminalregistryorrepository,withtheuseoffingerprintsbeing
71requiredinthestatewherethecampcounselorresidesandoptionalinotherstates;
72 (b)Thestatesexoffenderregistryorrepository;
73 (c)Thestatefamilycaresafetyregistry;and
74 (d)Thestate-basedchildabuseandneglectregistryanddatabase.
75 10.BeginningMay1,2027,anypersonororganizationthatviolatesthe
76provisionsofthissectionshallbeguiltyofaclassCmisdemeanorforthefirstoffense
77andshallbeassessedafinenottoexceedsevenhundredfiftydollarsandshallbeguilty
78ofaclassAmisdemeanorandshallbeassessedafineofuptotwothousanddollarsper
79day,nottoexceedatotaloftenthousanddollars,foranysubsequentoffense.Ifaperson
80ororganizationviolatestheprovisionsofthissectionpriortoMay1,2027,thepersonor
81organizationshallreceiveawrittenwarningforeachviolation.
82 11.Thedepartmentofelementaryandsecondaryeducationmaypromulgateall
83necessaryrulesandregulationsfortheadministrationofthissection.Anyruleor
84portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
85authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
86subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This
87sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
88generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
89disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
HB1377	3 90rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2025,shallbe
91invalidandvoid.
