32.056.Exceptforusespermittedunder18U.S.C.Section2721(b)(1),the
2departmentofrevenueshallnotreleasethehomeaddressoforanyinformationthatidentifies
3anyvehicleownedorleasedbyanypersonwhois[a]anactiveorretiredcounty,stateor
4federalparoleofficer,[a]federalpretrialofficer,[a]peaceofficerpursuanttosection590.010,
5[a]personvestedbyArticleV,Section1oftheMissouriConstitutionwiththejudicialpower
6ofthestate,[a]memberofthefederaljudiciary,oramemberofsuchperson'simmediate
7familycontainedinthedepartment'smotorvehicleordriverregistrationrecords,basedona
8specificrequestforsuchinformationfromanyperson.Anysuchpersonmaynotifythe
9departmentofhisorherstatusandthedepartmentshallprotecttheconfidentialityofthe
10homeaddressandvehiclerecordsonsuchapersonandhisorherimmediatefamilyas
11requiredbythissection.Thissectionshallnotprohibitthedepartmentfromreleasing
12informationonamotorregistrationlistpursuanttosection32.055orfromreleasing
13informationonanyofficerwhoholdsaclassA,BorCcommercialdriver'slicensepursuant
14totheMotorCarrierSafetyImprovementActof1999,asamended,49U.S.C.31309.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 301.469.1.Anyvehicleownermayreceivelicenseplatesasprescribedinthis
2section,foranymotorvehiclesuchpersonowns,eithersolelyorjointly,otherthanan
3apportionedmotorvehicleoracommercialmotorvehiclelicensedinexcessoftwenty-four
4thousandpoundsgrossweight,afteranannualpaymentofanemblem-useauthorizationfeeto
5theMissouriconservationheritagefoundation.Thefoundationherebyauthorizestheuseof
6itsofficialemblemstobeaffixedonmultiyearlicenseplatesasprovidedinthissection.Any
7vehicleownermayannuallyapplyfortheuseoftheemblems.
8 2.Uponannualapplicationandpaymentofatwenty-fivedollaremblem-use
9authorizationfeetotheMissouriconservationheritagefoundation,thefoundationshallissue
10tothevehicleowner,withoutfurthercharge,anemblem-useauthorizationstatement,which
11shallbepresentedtothedirectorofthedepartmentofrevenueatthetimeofregistrationofa
12motorvehicle.
13 3.Uponpresentationoftheannualstatement,paymentofafifteendollarfeein
14additiontotheregularregistrationfeesanddocumentswhichmayberequiredbylaw,the
15directorofthedepartmentofrevenueshallissuealicenseplate,whichshallbearanemblem
16oftheMissouriconservationheritagefoundationinaformprescribedbythedirector,tothe
17vehicleowner.Suchlicenseplatesshallbemadewithfullyreflectivematerialwitha
18commoncolorschemeanddesign,shallbeclearlyvisibleatnight,andshallbeaesthetically
19attractive,asprescribedbysection301.130.Notwithstandingtheprovisionsofsection
20301.144,noadditionalfeeshallbechargedforthepersonalizationoflicenseplatespursuant
21tothissection.
22 4.Applicationfortheemblem-useauthorizationandpaymentofthetwenty-five-
23dollarcontributionmayalsobemadeatthetimeofregistrationtothedirectorofthe
24departmentofrevenue,whoshalldepositthecontributiontothecreditoftheMissouri
25conservationheritagefoundation.
26 5.Avehicleowner,whowaspreviouslyissuedaplatewithaMissouriconservation
27heritagefoundationemblemauthorizedbythissectionbutwhodoesnotprovideanemblem-
28useauthorizationstatementatasubsequenttimeofregistration,shallbeissuedanewplate
29whichdoesnotbearthefoundationemblem,asotherwiseprovidedbylaw.
30 [5.]6.Thedirectorofthedepartmentofrevenuemaypromulgaterulesand
31regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthattermis
32definedinsection536.010,thatispromulgatedundertheauthoritydelegatedinthissection
33shallbecomeeffectiveonlyifithasbeenpromulgatedpursuanttotheprovisionsofchapter
34536.AllrulemakingauthoritydelegatedpriortoAugust28,1999,isofnoforceandeffect;
35however,nothinginthissectionshallbeinterpretedtorepealoraffectthevalidityofanyrule
36filedoradoptedpriortoAugust28,1999,ifitfullycompliedwiththeprovisionsofchapter
37536.Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
HB138	2 38generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
39disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
40rulemakingauthorityandanyruleproposedoradoptedafterAugust28,1999,shallbeinvalid
41andvoid.
301.472.1.Anymotorvehicleownermayreceivespeciallicenseplatesforany
2motorvehiclethepersonowns,eithersolelyorjointly,otherthananapportionedmotor
3vehicleoracommercialmotorvehiclelicensedinexcessoftwenty-fourthousandpounds
4grossweightasprescribedinthissectionafteranannualpaymentofanemblem-use
5authorizationfeetoaprofessionalsportsteamwhichhasmadeanagreementpursuantto
6subsection5ofthissection.Forthepurposesofthissectiona"professionalsportsteam"shall
7meananorganizationlocatedinthisstatefranchisedbytheNationalProfessionalSoccer
8League,theNationalWomen'sSoccerLeague,theNationalFootballLeague,theNational
9BasketballAssociation,theNationalHockeyLeague,theInternationalHockeyLeague,orthe
10AmericanLeagueortheNationalLeagueofMajorLeagueBaseballorateamplayingin
11MajorLeagueSoccer.
12 2.Theprofessionalsportsteamwhichhasmadeanagreementpursuanttosubsection
135ofthissectionandwhichreceivestheemblem-useauthorizationfeeherebyauthorizesthe
14useofitsofficialemblemtobeaffixedonmultiyearpersonalizedlicenseplatesasprovidedin
15thissection.Anyvehicleownermayannuallyapplyfortheuseoftheemblem.Thedirector
16ofrevenueshallnotauthorizethemanufacturerofthematerialtoproducesuchlicenseplates
17withtheindividualseal,logo,oremblemuntilthedepartmentofrevenuereceivesaminimum
18ofonehundredapplicationsforeachspecificprofessionalsportsteam.
19 3.Uponannualapplicationandpaymentofathirty-fivedollaremblem-use
20contributiontotheprofessionalsportsteamsuchteamshallissuetothevehicleowner,
21withoutfurthercharge,anemblem-useauthorizationstatement,whichshallbepresentedby
22theownertothedirectorofthedepartmentofrevenueatthetimeofregistrationofamotor
23vehicle.Uponpresentationoftheannualstatementandpaymentofafifteendollarfeein
24additiontotheregularregistrationfees,andpresentationofotherdocumentswhichmaybe
25requiredbylaw,thedirectorshallissueapersonalizedlicenseplate,whichshallbearthe
26officialemblemoftheprofessionalsportsteaminamannerdeterminedbythedirector.Such
27licenseplatesshallbemadewithfullyreflectivematerialwithacommoncolorschemeand
28design,shallbeclearlyvisibleatnight,andshallbeaestheticallyattractive,asprescribedby
29section301.130.Afeefortheissuanceofpersonalizedlicenseplatesissuedpursuantto
30section301.144shallnotberequiredforplatesissuedpursuanttothissection.
31 4.Avehicleowner,whowaspreviouslyissuedaplatewithaprofessionalsportsteam
32emblemauthorizedbythissectionbutwhodoesnotprovideanemblem-useauthorization
HB138	3 33statementatasubsequenttimeofregistration,shallbeissuedanewplatewhichdoesnotbear
34theprofessionalsportsteamemblem,asotherwiseprovidedbylaw.
35 5.Thedirectorofthedepartmentofrevenueisauthorizedtomakeagreementswith
36professionalsportsteamsonbehalfofthestatewhichallowtheuseofanysuchteam'sofficial
37emblempursuanttotheprovisionsofthissectionasconsiderationforreceivingathirty-five
38dollaremblem-usecontribution.
39 6.Exceptasprovidedinsubsection7ofthissection,aprofessionalsportsteam
40receivingathirty-fivedollarcontributionshallforwardsuchcontribution,lessanamountnot
41inexcessoffivepercentofthecontributionforthecostsofadministration,totheJackson
42CountySportsAuthorityortheSt.LouisRegionalConventionandVisitorsCommission.
43Themoneysshallbeadministeredasfollows:
44 (1)Thesportsauthoritymayretainnotinexcessoffivepercentofallfunds
45forwardedtoitpursuanttothissectionforthecostsofadministrationandshallexpendthe
46remainingbalanceofsuchfunds,afterconsultationwithaprofessionalsportsteamwithinthe
47authority'sarea,onmarketingandpromotingsuchteam.Theamountofmoneyexpended
48fromthefundsobtainedpursuanttothissectionbytheauthorityperprofessionalsportsteam
49shallbeinthesameproportiontothetotalfundsavailabletobeexpendedonsuchteamasthe
50proportionofcontributionsforwardedbytheteamtotheauthorityistothetotalcontributions
51receivedbytheauthority;
52 (2)Theregionalconventionandvisitorscommissionshallholdtherevenuesreceived
53fromtheprofessionalsportsteamsintheSt.Louisareainseparateaccountsforeachteam.
54Eachteammaysubmitanannualmarketingplantothecommission.Expensesofateam
55whichareinaccordancewiththemarketingplanshallbereimbursedbythecommissionas
56longasmoneysareavailableintheaccount.Thecommissionmayretainnotinexcessoffive
57percentforthecostsofadministration.Ifnomarketingplanissubmittedbyateam,the
58commissionshallmarketandpromotetheteam.
59 7.TheKansasCityChiefsshallforwardallemblem-usefeesreceived,lessanamount
60notinexcessoffivepercentofthecostsofadministration,totheChiefs'Children'sFund,a
61not-for-profitfundestablishedtobenefitchildreninneedintheKansasCityarea.
62 8.Thedirectorofthedepartmentofrevenueshallpromulgaterulesandregulations
63fortheadministrationofthissection.Noruleorportionofarulepromulgatedpursuanttothe
64authorityofthissectionshallbecomeeffectiveunlessithasbeenpromulgatedpursuanttothe
65provisionsofchapter536.
