HB1388 2 53 (2)Ifanotherjurisdictionhastakendisciplinaryactionagainstanapplicant,the 54boardshalldetermineifthecausefortheactionwascorrectedandthematterresolved. 55Ifthematterhasnotbeenresolvedbythatjurisdiction,theboardmaydenyalicense 56untilthematterisresolved. 57 5.Nothinginthissectionshallprohibittheboardfromdenyingalicensetoan 58applicantunderthissectionforanyreasondescribedinsection334.100. 59 6.Anypersonwhoislicensedundertheprovisionsofthissectionshallbesubject 60totheboard'sjurisdictionandallrulesandregulationspertainingtothepracticeasa 61physicianassistantinthisstate. 62 7.Thissectionshallnotbeconstruedtowaiveanyrequirementforanapplicant 63topayanyfees. 334.1800.1.Sections334.1800to334.1860shallbeknownandmaybecitedas 2the"PhysicianAssistantLicensureCompact". 3 2.InordertostrengthenaccesstoMedicalServices,andinrecognitionofthe 4advancesinthedeliveryofMedicalServices,theParticipatingStatesofthePA 5LicensureCompacthavealliedincommonpurposetodevelopacomprehensiveprocess 6thatcomplementstheexistingauthorityofStateLicensingBoardstolicenseand 7disciplinePAsandseekstoenhancetheportabilityofaLicensetopracticeasaPAwhile 8safeguardingthesafetyofpatients.ThisCompactallowsMedicalServicestobe 9providedbyPAs,viathemutualrecognitionoftheLicensee'sQualifyingLicenseby 10otherCompactParticipatingStates.ThisCompactalsoadoptstheprevailingstandard 11forPAlicensureandaffirmsthatthepracticeanddeliveryofMedicalServicesbythe 12PAoccurswherethepatientislocatedatthetimeofthepatientencounter,andtherefore 13requiresthePAtobeunderthejurisdictionoftheStateLicensingBoardwherethe 14patientislocated.StateLicensingBoardsthatparticipateinthisCompactretainthe 15jurisdictiontoimposeAdverseActionagainstaCompactPrivilegeinthatStateissued 16toaPAthroughtheproceduresofthisCompact.ThePALicensureCompactwill 17alleviateburdensformilitaryfamiliesbyallowingactivedutymilitarypersonneland 18theirspousestoobtainaCompactPrivilegebasedonhavinganunrestrictedLicensein 19goodstandingfromaParticipatingState. 334.1805.InthisCompact: 2 (1)"AdverseAction"meansanyadministrative,civil,equitable,orcriminal 3actionpermittedbyaState'slawswhichisimposedbyaLicensingBoardorother 4authorityagainstaPALicenseorLicenseapplicationorCompactPrivilegesuchas 5Licensedenial,censure,revocation,suspension,probation,monitoringoftheLicensee, 6orrestrictionontheLicensee'spractice. 4authorizedbyCommissionRule. 5 (2)HoldcurrentNCCPAcertification. 6 (3)HavenofelonyormisdemeanorConviction. 7 (4)Haveneverhadacontrolledsubstancelicense,permit,orregistration 8suspendedorrevokedbyaStateorbytheUnitedStatesDrugEnforcement 9Administration. 10 (5)HaveauniqueidentifierasdeterminedbyCommissionRule. 11 (6)HoldaQualifyingLicense. 12 (9)IfaCompactPrivilegehasbeenrevokedorislimitedorrestrictedina 19ParticipatingStateforconductthatwouldnotbeabasisfordisciplinaryactionina 20ParticipatingStateinwhichtheLicenseeispracticingorapplyingtopracticeundera 21CompactPrivilege,thatParticipatingStateshallhavethediscretionnottoconsider 22suchactionasanAdverseActionrequiringthedenialorremovalofaCompact 23PrivilegeinthatState. 24 (10)NotifytheCompactCommissionthattheLicenseeisseekingtheCompact 25PrivilegeinaRemoteState. 26 (11)MeetanyJurisprudenceRequirementofaRemoteStateinwhichthe 27LicenseeisseekingtopracticeundertheCompactPrivilegeandpayanyfeesapplicable 28tosatisfyingtheJurisprudenceRequirement. 29 (12)ReporttotheCommissionanyAdverseActiontakenbyanon-participating 30Statewithinthirty(30)daysaftertheactionistaken. 31 2.TheCompactPrivilegeisvaliduntiltheexpirationorrevocationofthe 32QualifyingLicenseunlessterminatedpursuanttoanAdverseAction.TheLicensee 33mustalsocomplywithalloftherequirementsofsubsection1ofthissectiontomaintain HB1388 6 34theCompactPrivilegeinaRemoteState.IftheParticipatingStatetakesAdverse 35ActionagainstaQualifyingLicense,theLicenseeshalllosetheCompactPrivilegeinany 36RemoteStateinwhichtheLicenseehasaCompactPrivilegeuntilallofthefollowing 37occur: 38 (1)TheLicenseisnolongerlimitedorrestricted;and 39 (2)Two(2)yearshaveelapsedfromthedateonwhichtheLicenseisnolonger 40limitedorrestrictedduetotheAdverseAction. 41 3.OncearestrictedorlimitedLicensesatisfiestherequirementsofsubdivisions 42(1)and(2)ofsubsection2ofthissection,theLicenseemustmeettherequirementsof 43subsection1ofthissectiontoobtainaCompactPrivilegeinanyRemoteState. 44 4.ForeachRemoteStateinwhichaPAseeksauthoritytoprescribecontrolled 45substances,thePAshallsatisfyallrequirementsimposedbysuchStateingrantingor 46renewingsuchauthority. 334.1820.UponaLicensee'sapplicationforaCompactPrivilege,theLicensee 2shallidentifytotheCommissiontheParticipatingStatefromwhichtheLicenseeis 3applying,inaccordancewithapplicableRulesadoptedbytheCommission,andsubject 4tothefollowingrequirements: 5 (1)WhenapplyingforaCompactPrivilege,theLicenseeshallprovidethe 6CommissionwiththeaddressoftheLicensee'sprimaryresidenceandthereaftershall 7immediatelyreporttotheCommissionanychangeintheaddressoftheLicensee's 8primaryresidence. 9 (2)WhenapplyingforaCompactPrivilege,theLicenseeisrequiredtoconsent 10toacceptserviceofprocessbymailattheLicensee'sprimaryresidenceonfilewiththe 11CommissionwithrespecttoanyactionbroughtagainsttheLicenseebytheCommission 12oraParticipatingState,includingasubpoena,withrespecttoanyactionbroughtor 13investigationconductedbytheCommissionoraParticipatingState. 334.1825.1.AParticipatingStateinwhichaLicenseeislicensedshallhave 2exclusivepowertoimposeAdverseActionagainsttheQualifyingLicenseissuedbythat 3ParticipatingState. 4 2.InadditiontotheotherpowersconferredbyStatelaw,aRemoteStateshall 5havetheauthority,inaccordancewithexistingStatedueprocesslaw,todoallofthe 6following: 7 (1)TakeAdverseActionagainstaPA'sCompactPrivilegewithinthatStateto 8removeaLicensee'sCompactPrivilegeortakeotheractionnecessaryunderapplicable 9lawtoprotectthehealthandsafetyofitscitizens. 10 (2)Issuesubpoenasforbothhearingsandinvestigationsthatrequirethe 11attendanceandtestimonyofwitnessesaswellastheproductionofevidence.Subpoenas HB1388 7 12issuedbyaLicensingBoardinaParticipatingStatefortheattendanceandtestimonyof 13witnessesortheproductionofevidencefromanotherParticipatingStateshallbe 14enforcedinthelatterStatebyanycourtofcompetentjurisdiction,accordingtothe 15practiceandprocedureofthatcourtapplicabletosubpoenasissuedinproceedings 16pendingbeforeit.Theissuingauthorityshallpayanywitnessfees,travelexpenses, 17mileageandotherfeesrequiredbytheservicestatutesoftheStateinwhichthe 18witnessesorevidencearelocated. 19 (3)Notwithstandingsubdivision(2)ofthissubsection,subpoenasmaynotbe 20issuedbyaParticipatingStatetogatherevidenceofconductinanotherStatethatis 21lawfulinthatotherStateforthepurposeoftakingAdverseActionagainstaLicensee's 22CompactPrivilegeorapplicationforaCompactPrivilegeinthatParticipatingState. 23 (4)NothinginthisCompactauthorizesaParticipatingStatetoimposediscipline 24againstaPA'sCompactPrivilegeortodenyanapplicationforaCompactPrivilegein 25thatParticipatingStatefortheindividual'sotherwiselawfulpracticeinanotherState. 26 3.ForpurposesoftakingAdverseAction,theParticipatingStatewhichissued 27theQualifyingLicenseshallgivethesamepriorityandeffecttoreportedconduct 28receivedfromanyotherParticipatingStateasitwouldiftheconducthadoccurred 29withintheParticipatingStatewhichissuedtheQualifyingLicense.Insodoing,that 30ParticipatingStateshallapplyitsownStatelawstodetermineappropriateaction. 31 4.AParticipatingState,ifotherwisepermittedbyStatelaw,mayrecoverfrom 32theaffectedPAthecostsofinvestigationsanddispositionofcasesresultingfromany 33AdverseActiontakenagainstthatPA. 34 5.AParticipatingStatemaytakeAdverseActionbasedonthefactualfindings 35ofaRemoteState,providedthattheParticipatingStatefollowsitsownproceduresfor 36takingtheAdverseAction. 37 6.(1)InadditiontotheauthoritygrantedtoaParticipatingStatebyits 38respectiveStatePAlawsandregulationsorotherapplicableStatelaw,anyParticipating 39StatemayparticipatewithotherParticipatingStatesinjointinvestigationsofLicensees. 40 (2)ParticipatingStatesshallshareanyinvestigative,litigation,orcompliance 41materialsinfurtheranceofanyjointorindividualinvestigationinitiatedunderthis 42Compact. 43 7.IfanAdverseActionistakenagainstaPA'sQualifyingLicense,thePA's 44CompactPrivilegeinallRemoteStatesshallbedeactivateduntiltwo(2)yearshave 45elapsedafterallrestrictionshavebeenremovedfromtheStateLicense.Alldisciplinary 46ordersbytheParticipatingStatewhichissuedtheQualifyingLicensethatimpose 47AdverseActionagainstaPA'sLicenseshallincludeaStatementthatthePA'sCompact 48PrivilegeisdeactivatedinallParticipatingStatesduringthependencyoftheorder. HB1388 8 49 8.IfanyParticipatingStatetakesAdverseAction,itpromptlyshallnotifythe 50administratoroftheDataSystem. 334.1830.1.TheParticipatingStatesherebycreateandestablishajoint 2governmentagencyandnationaladministrativebodyknownasthePALicensure 3CompactCommission.TheCommissionisaninstrumentalityoftheCompactStates 4actingjointlyandnotaninstrumentalityofanyoneState.TheCommissionshallcome 5intoexistenceonoraftertheeffectivedateoftheCompactassetforthinsubsection1of 6section334.1850. 7 2.(1)EachParticipatingStateshallhaveandbelimitedtoone(1)delegate 8selectedbythatParticipatingState'sLicensingBoardor,iftheStatehasmorethanone 9LicensingBoard,selectedcollectivelybytheParticipatingState'sLicensingBoards. 10 (2)Thedelegateshallbeeither: 11 (a)AcurrentPA,physicianorpublicmemberofaLicensingBoardorPA 12Council/Committee;or 13 (b)AnadministratorofaLicensingBoard. 14 (3)Anydelegatemayberemovedorsuspendedfromofficeasprovidedbythe 15lawsoftheStatefromwhichthedelegateisappointed. 16 (4)TheParticipatingStateLicensingBoardshallfillanyvacancyoccurringin 17theCommissionwithinsixty(60)days. 18 (5)Eachdelegateshallbeentitledtoone(1)voteonallmattersvotedonbythe 19Commissionandshallotherwisehaveanopportunitytoparticipateinthebusinessand 20affairsoftheCommission.Adelegateshallvoteinpersonorbysuchothermeansas 21providedinthebylaws.Thebylawsmayprovidefordelegates'participationin 22meetingsbytelecommunications,videoconference,orothermeansofcommunication. 23 (6)TheCommissionshallmeetatleastonceduringeachcalendaryear. 24AdditionalmeetingsshallbeheldassetforthinthisCompactandthebylaws. 25 (7)TheCommissionshallestablishbyRuleatermofofficefordelegates. 26 3.TheCommissionshallhavethefollowingpowersandduties: 27 (1)EstablishacodeofethicsfortheCommission; 28 (2)EstablishthefiscalyearoftheCommission; 29 (3)Establishfees; 30 (4)Establishbylaws; 31 (5)Maintainitsfinancialrecordsinaccordancewiththebylaws; 32 (6)Meetandtakesuchactionsasareconsistentwiththeprovisionsofthis 33Compactandthebylaws; (3)TheCommissionshallbeentitledtoreceiveserviceofprocessinany 12proceedingregardingtheenforcementorinterpretationoftheCompactorthe 13Commission'sRulesandshallhavestandingtointerveneinsuchaproceedingforall 14purposes.FailuretoprovidetheCommissionwithserviceofprocessshallrendera 15judgmentororderinsuchproceedingvoidastotheCommission,thisCompact,or 16CommissionRules. 17 2.(1)IftheCommissiondeterminesthataParticipatingStatehasdefaultedin 18theperformanceofitsobligationsorresponsibilitiesunderthisCompactorthe 19CommissionRules,theCommissionshallprovidewrittennoticetothedefaultingState 20andotherParticipatingStates.Thenoticeshalldescribethedefault,theproposed 21meansofcuringthedefaultandanyotheractionthattheCommissionmaytakeand 22shallofferremedialtrainingandspecifictechnicalassistanceregardingthedefault. 23 (2)IfaStateindefaultfailstocurethedefault,thedefaultingStatemaybe 24terminatedfromthisCompactuponanaffirmativevoteofamajorityofthedelegatesof 25theParticipatingStates,andallrights,privilegesandbenefitsconferredbythis 26CompactuponsuchStatemaybeterminatedontheeffectivedateoftermination.A 27cureofthedefaultdoesnotrelievetheoffendingStateofobligationsorliabilities 28incurredduringtheperiodofdefault. 29 (3)TerminationofparticipationinthisCompactshallbeimposedonlyafterall 30othermeansofsecuringcompliancehavebeenexhausted.Noticeofintenttosuspendor 31terminateshallbegivenbytheCommissiontothegovernor,themajorityandminority HB1388 19 32leadersofthedefaultingState'slegislature,andtotheLicensingBoard(s)ofeachofthe 33ParticipatingStates. 34 (4)AStatethathasbeenterminatedisresponsibleforallassessments, 35obligations,andliabilitiesincurredthroughtheeffectivedateoftermination,including 36obligationsthatextendbeyondtheeffectivedateoftermination. 37 (5)TheCommissionshallnotbearanycostsrelatedtoaStatethatisfoundtobe 38indefaultorthathasbeenterminatedfromthisCompact,unlessagreeduponinwriting 39betweentheCommissionandthedefaultingState. 40 (6)ThedefaultingStatemayappealitsterminationfromtheCompactbythe 41CommissionbypetitioningtheU.S.DistrictCourtfortheDistrictofColumbiaorthe 42federaldistrictwheretheCommissionhasitsprincipaloffices.Theprevailingmember 43shallbeawardedallcostsofsuchlitigation,includingreasonableattorney'sfees. 44 (7)UpontheterminationofaState'sparticipationintheCompact,theState 45shallimmediatelyprovidenoticetoallLicenseeswithinthatStateofsuchtermination: 46 (a)LicenseeswhohavebeengrantedaCompactPrivilegeinthatStateshall 47retaintheCompactPrivilegeforonehundredeighty(180)daysfollowingtheeffective 48dateofsuchtermination. 49 (b)LicenseeswhoarelicensedinthatStatewhohavebeengrantedaCompact 50PrivilegeinaParticipatingStateshallretaintheCompactPrivilegeforonehundred 51eighty(180)daysunlesstheLicenseealsohasaQualifyingLicenseinaParticipating 52StateorobtainsaQualifyingLicenseinaParticipatingStatebeforetheonehundred 53eighty(180)-dayperiodends,inwhichcasetheCompactPrivilegeshallcontinue. 54 3.(1)UponrequestbyaParticipatingState,theCommissionshallattemptto 55resolvedisputesrelatedtothisCompactthatariseamongParticipatingStatesand 56betweenparticipatingandnon-ParticipatingStates. 57 (2)TheCommissionshallpromulgateaRuleprovidingforbothmediationand 58bindingdisputeresolutionfordisputesasappropriate. 59 4.(1)TheCommission,inthereasonableexerciseofitsdiscretion,shallenforce 60theprovisionsofthisCompactandRulesoftheCommission. 61 (2)Ifcomplianceisnotsecuredafterallmeanstosecurecompliancehavebeen 62exhausted,bymajorityvote,theCommissionmayinitiatelegalactionintheUnited 63StatesDistrictCourtfortheDistrictofColumbiaorthefederaldistrictwherethe 64Commissionhasitsprincipaloffices,againstaParticipatingStateindefaulttoenforce 65compliancewiththeprovisionsofthisCompactandtheCommission'spromulgated 66Rulesandbylaws.Thereliefsoughtmayincludebothinjunctivereliefanddamages.In 67theeventjudicialenforcementisnecessary,theprevailingpartyshallbeawardedall 68costsofsuchlitigation,includingreasonableattorney'sfees. HB1388 20 69 (3)TheremedieshereinshallnotbetheexclusiveremediesoftheCommission. 70TheCommissionmaypursueanyotherremediesavailableunderfederalorStatelaw. 71 5.(1)AParticipatingStatemayinitiatelegalactionagainsttheCommissionin 72theU.S.DistrictCourtfortheDistrictofColumbiaorthefederaldistrictwherethe 73Commissionhasitsprincipalofficestoenforcecompliancewiththeprovisionsofthe 74CompactanditsRules.Thereliefsoughtmayincludebothinjunctivereliefand 75damages.Intheeventjudicialenforcementisnecessary,theprevailingpartyshallbe 76awardedallcostsofsuchlitigation,includingreasonableattorney'sfees. 77 (2)NopersonotherthanaParticipatingStateshallenforcethisCompactagainst 78theCommission. 334.1850.1.ThisCompactshallcomeintoeffectonthedateonwhichthis 2CompactstatuteisenactedintolawintheseventhParticipatingState. 3 (1)OnoraftertheeffectivedateoftheCompact,theCommissionshallconvene 4andreviewtheenactmentofeachoftheStatesthatenactedtheCompactpriortothe 5Commissionconvening("CharterParticipatingStates")todetermineifthestatute 6enactedbyeachsuchCharterParticipatingStateismateriallydifferentthantheModel 7Compact. 8 (a)ACharterParticipatingStatewhoseenactmentisfoundtobematerially 9differentfromtheModelCompactshallbeentitledtothedefaultprocesssetforthin 10subsection2ofsection334.1845. 11 (b)IfanyParticipatingStatelaterwithdrawsfromtheCompactorits 12participationisterminated,theCommissionshallremaininexistenceandtheCompact 13shallremainineffectevenifthenumberofParticipatingStatesshouldbelessthan 14seven.ParticipatingStatesenactingtheCompactsubsequenttotheCommission 15conveningshallbesubjecttotheprocesssetforthinsubdivision(21)ofsubsection3of 16section334.1830todetermineiftheirenactmentsaremateriallydifferentfromthe 17ModelCompactandwhethertheyqualifyforparticipationintheCompact. 18 (2)ParticipatingStatesenactingtheCompactsubsequenttotheseveninitial 19CharterParticipatingStatesshallbesubjecttotheprocesssetforthinsubdivision(21) 20ofsubsection3ofsection334.1830todetermineiftheirenactmentsarematerially 21differentfromtheModelCompactandwhethertheyqualifyforparticipationinthe 22Compact. 23 (3)AllactionstakenforthebenefitoftheCommissionorinfurtheranceofthe 24purposesoftheadministrationoftheCompactpriortotheeffectivedateoftheCompact 25ortheCommissioncomingintoexistenceshallbeconsideredtobeactionsofthe 26CommissionunlessspecificallyrepudiatedbytheCommission. HB1388 21 27 2.AnyStatethatjoinsthisCompactshallbesubjecttotheCommission'sRules 28andbylawsastheyexistonthedateonwhichthisCompactbecomeslawinthatState. 29AnyRulethathasbeenpreviouslyadoptedbytheCommissionshallhavethefullforce 30andeffectoflawonthedaythisCompactbecomeslawinthatState. 31 3.AnyParticipatingStatemaywithdrawfromthisCompactbyenactinga 32statuterepealingthesame. 33 (1)AParticipatingState'swithdrawalshallnottakeeffectuntilonehundred 34eighty(180)daysafterenactmentoftherepealingstatute.Duringthisonehundred 35eighty(180)day-period,allCompactPrivilegesthatwereineffectinthewithdrawing 36StateandweregrantedtoLicenseeslicensedinthewithdrawingStateshallremainin 37effect.IfanyLicenseelicensedinthewithdrawingStateisalsolicensedinanother 38ParticipatingStateorobtainsalicenseinanotherParticipatingStatewithintheone 39hundredeighty(180)days,theLicensee'sCompactPrivilegesinotherParticipating 40Statesshallnotbeaffectedbythepassageoftheonehundredeighty(180)days. 41 (2)WithdrawalshallnotaffectthecontinuingrequirementoftheState 42LicensingBoard(s)ofthewithdrawingStatetocomplywiththeinvestigative,and 43AdverseActionreportingrequirementsofthisCompactpriortotheeffectivedateof 44withdrawal. 45 (3)UpontheenactmentofastatutewithdrawingaStatefromthisCompact,the 46StateshallimmediatelyprovidenoticeofsuchwithdrawaltoallLicenseeswithinthat 47State.SuchwithdrawingStateshallcontinuetorecognizealllicensesgrantedpursuant 48tothisCompactforaminimumofonehundredeighty(180)daysafterthedateofsuch 49noticeofwithdrawal. 50 4.NothingcontainedinthisCompactshallbeconstruedtoinvalidateorprevent 51anyPAlicensureagreementorothercooperativearrangementbetweenParticipating 52StatesandbetweenaParticipatingStateandnon-ParticipatingStatethatdoesnot 53conflictwiththeprovisionsofthisCompact. 54 5.ThisCompactmaybeamendedbytheParticipatingStates.Noamendmentto 55thisCompactshallbecomeeffectiveandbindinguponanyParticipatingStateuntilitis 56enactedmateriallyinthesamemannerintothelawsofallParticipatingStatesas 57determinedbytheCommission. 334.1855.1.ThisCompactandtheCommission'srulemakingauthorityshallbe 2liberallyconstruedsoastoeffectuatethepurposes,andtheimplementationand 3administrationoftheCompact.ProvisionsoftheCompactexpresslyauthorizingor 4requiringthepromulgationofRulesshallnotbeconstruedtolimittheCommission's 5rulemakingauthoritysolelyforthosepurposes. HB1388 22 6 2.TheprovisionsofthisCompactshallbeseverableandifanyphrase,clause, 7sentenceorprovisionofthisCompactisheldbyacourtofcompetentjurisdictiontobe 8contrarytotheconstitutionofanyParticipatingState,aStateseekingparticipationin 9theCompact,oroftheUnitedStates,ortheapplicabilitythereoftoanygovernment, 10agency,personorcircumstanceisheldtobeunconstitutionalbyacourtofcompetent 11jurisdiction,thevalidityoftheremainderofthisCompactandtheapplicabilitythereof 12toanyothergovernment,agency,personorcircumstanceshallnotbeaffectedthereby. 13 3.Notwithstandingsubsection2ofthissection,theCommissionmaydenya 14State'sparticipationintheCompactor,inaccordancewiththerequirementsof 15subsection2ofsection334.1845,terminateaParticipatingState'sparticipationinthe 16Compact,ifitdeterminesthataconstitutionalrequirementofaParticipatingStateis,or 17wouldbewithrespecttoaStateseekingtoparticipateintheCompact,amaterial 18departurefromtheCompact.Otherwise,ifthisCompactshallbeheldtobecontraryto 19theconstitutionofanyParticipatingState,theCompactshallremaininfullforceand 20effectastotheremainingParticipatingStatesandinfullforceandeffectastothe 21ParticipatingStateaffectedastoallseverablematters. 334.1860.1.Nothinghereinpreventstheenforcementofanyotherlawofa 2ParticipatingStatethatisnotinconsistentwiththisCompact. 3 2.AnylawsinaParticipatingStateinconflictwiththisCompactaresuperseded 4totheextentoftheconflict. 5 3.AllagreementsbetweentheCommissionandtheParticipatingStatesare 6bindinginaccordancewiththeirterms. ✔ HB1388 23
