BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section557.026,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection557.026,toreadasfollows:
557.026.1.Whenaprobationofficerisavailabletoanycourt,suchprobationofficer
2shall,unlesswaivedbythedefendant,conductapresentenceinvestigationinallfelonycases
3andmakeasentencingassessmentreporttothecourtbeforeanyauthorizeddispositionis
4madeundersection557.011.InallclassAmisdemeanorcasesaprobationofficershall,if
5directedbythecourt,conductapresentenceinvestigationandmakeasentencingassessment
6reporttothecourtbeforeanyauthorizeddispositionismadeundersection557.011.The
7reportshallnotbesubmittedtothecourtoritscontentsdisclosedtoanyoneuntilthe
8defendanthasbeenfoundguilty.
9 2.Thesentencingassessmentreportshallbeprepared,presentedandutilizedas
10providedbyruleofcourt,exceptthatnocourtshallpreventthedefendantortheattorneyfor
11thedefendantfromhavingaccesstothecompletesentencingassessmentreportand
12recommendationsbeforeanyauthorizeddispositionismadeundersection557.011.
13 3.Thedefendantshallnotbeobligatedtomakeanystatementtoaprobationofficer
14inconnectionwithanysentencingassessmentreport.
15 4.Whenthejudgeorjuryentersafindingofguiltandassessespunishment,the
16probationofficershall,aspartofthepresentenceinvestigation,inquireofthevictimofthe
17offenseforwhichsuchpunishmentwasassessedofthefactsoftheoffenseandanypersonal
