5 (a)Anybirthingcenter;or
6 (b)Anypublicorprivateestablishmentthatisoperatedprimarilyforthepurposeof
7performingsurgicalprocedures[orprimarilyforthepurposeofperformingchildbirths,] and

197.215.1.Uponreceiptofanapplicationforalicense,thedepartmentofhealthand
2seniorservicesshallissuealicenseiftheapplicantandambulatorysurgicalcenterfacilitiesor
3abortionfacilitiesmeettherequirementsestablishedundersections197.200to197.240,and
4haveprovidedaffirmativeevidencethat:
5 (1)Eachmemberofthesurgicalstaffisaphysician,dentistorpodiatristcurrently
6licensedtopracticeinMissouri,andeachpersonauthorizedtoperformorinduceabortionsis
7aphysiciancurrentlylicensedtopracticeinMissouri;
8 (2)Surgicalproceduresinambulatorysurgicalcentersshallbeperformedonlyby
9physicians,dentistsorpodiatrists,whoatthetimeareprivilegedtoperformsurgical
10proceduresinatleastonelicensedhospitalinthecommunityinwhichtheambulatory
11surgicalcenterislocated,thusprovidingassurancetothepublicthatpatientstreatedinthe
12centershallreceivecontinuityofcareshouldtheservicesofahospitalberequired;
13alternatively,theapplicantshallsubmitacopyofacurrentworkingagreementwithatleast
14onelicensedhospitalinthecommunityinwhichtheambulatorysurgicalcenterislocated,
15guaranteeingthetransferandadmittanceofpatientsforemergencytreatmentwhenever
16necessary. Theprovisionsofthissubdivisionshallnotapplytobirthingcenters;
17 (3)Continuousphysicianservicesorregisteredprofessionalnursingservicesare
18providedwheneverapatientisinthefacility;
19 (4)Adequatemedicalrecordsforeachpatientaretobemaintained.
20 2.Uponreceiptofanapplicationforalicense,ortherenewalthereof,thedepartment
21shallissueorrenewthelicenseiftheapplicantandprogrammeettherequirements
22establishedundersections197.200to197.240.Eachlicenseshallbeissuedonlyforthe
23personsandpremisesnamedintheapplication.Alicense,unlesssoonersuspendedor
24revoked,shallbeissuedforaperiodofoneyear.
25 3.Eachlicenseshallbeissuedonlyforthepremisesandpersonsorgovernmental
26unitsnamedintheapplication,andshallnotbetransferableorassignableexceptwiththe
HB1404 2 27writtenconsentofthedepartment.Licensesshallbepostedinaconspicuousplaceonthe
28licensedpremises.
29 4.If,duringtheperiodinwhichanambulatorysurgicalcenterlicenseoranabortion
30facilitylicenseisineffect,thelicenseholderoroperatorlegallytransfersoperational
31responsibilitiesbyanyprocesstoanotherpersonasdefinedinsection197.200,anapplication
32shallbemadefortheissuanceofanewlicensetobecomeeffectiveonthetransferdate.
