4enactedinlieuthereof,tobeknownassection161.026,toreadasfollows:
[161.026.1.Notwithstandingtheprovisionsofsection161.032orany
2 otherprovisionoflaw,thegovernorshall,byandwiththeadviceandconsent
3 ofthesenate,appointateacherrepresentativetothestateboardofeducation,
4 whoshallattendallmeetingsandparticipateinalldeliberationsoftheboard.
5 Theteacherrepresentativeshallnothavetherighttovoteonanymatterbefore
6 theboardorbecountedinestablishingaquorumundersection161.082.
7 2.Theteacherrepresentativeshallbeanactiveclassroomteacher.For
8 purposesofthissection,"activeclassroomteacher"meansaresidentofthe
9 stateofMissouriwhoisafull-timeteacherwithatleastfiveyearsofteaching
10 experienceinthestateofMissouri,whoiscertifiedtoteachunderthelaws
11 governingthecertificationofteachersinMissouri,andwhoisnotonleaveat
12 thetimeoftheappointmenttothepositionofteacherrepresentative.The
13 teacherrepresentativeshallhavethewrittensupportofthelocalschoolboard
14 priortoacceptingtheappointment.
15 3.Thetermoftheteacherrepresentativeshallbefouryears,and
16 appointmentsmadeunderthissectionshallbemadeinrotationfromeach

19 4.Ifavacancyoccursforanyreasoninthepositionofteacher
20 representative,thegovernorshallappoint,byandwiththeadviceandconsent
21 ofthesenate,areplacementfortheunexpiredterm.Suchreplacementshallbe
22 aresidentofthesamecongressionaldistrictastheteacherrepresentativebeing
23 replaced,shallmeetthequalificationssetforthundersubsection2ofthis
24 section,andshallserveuntilhisorhersuccessorisappointedandqualified.
25 5.Iftheteacherrepresentativeceasestobeanactiveclassroom
26 teacher,asdefinedundersubsection2ofthissection,orfailstofollowthe
27 board'sattendancepolicy,theteacherrepresentative'spositionshall
28 immediatelybecomevacantunlessanabsenceiscausedbysicknessor
29 someaccidentpreventingtherepresentative'sarrivalatthetimeandplace
30 appointedforthemeeting.
31 6.Theteacherrepresentativeshallreceivethesamereimbursementfor
32 expensesasmembersofthestateboardofeducationreceiveundersection
33 161.022.
34 7.Atnotimeshallmorethanonenonvotingmemberserveonthestate
35 boardofeducation.
36 8.TheprovisionsofthissectionshallexpireonAugust28,2026.]
161.026.1.Notwithstandingtheprovisionsofsection161.032oranyotherprovision
2oflaw,thegovernorshall,byandwiththeadviceandconsentofthesenate,appointateacher
3representativetothestateboardofeducationwhoshallattendallmeetingsandparticipatein
4alldeliberationsoftheboard.Theteacherrepresentativeshallnothavetherighttovoteon
5anymatterbeforetheboardorbecountedinestablishingaquorumundersection161.082.
6 2.Theteacherrepresentativeshallbeanactiveclassroomteacher.Forpurposesof
7thissection,"activeclassroomteacher"meansaresidentofthestateofMissouriwhoisafull-
8timeteacherwithatleastfiveyearsofteachingexperienceinthestateofMissouri,whois
9certifiedtoteachunderthelawsgoverningthecertificationofteachersinMissouri,andwho
10isnotonleaveatthetimeoftheappointmenttothepositionofteacherrepresentative.The
11teacherrepresentativeshallhavethewrittensupportofthelocalschoolboardpriorto
12acceptingtheappointment.
13 3.Thetermoftheteacherrepresentativeshallbefouryears,and[appointmentsmade
14underthissectionshallbemadeinrotationfromeachcongressionaldistrictbeginningwith
15thefirstcongressionaldistrictandcontinuinginnumericalorder] forthesecondand
16succeedingappointments,thenewlyappointedteacherrepresentativeshallnotbe
17appointedfromthesamecongressionaldistrictastheimmediatelyprecedingteacher
18representative.
19 4.Ifavacancyoccursforanyreasoninthepositionofteacherrepresentative,the
20governorshallappoint,byandwiththeadviceandconsentofthesenate,areplacementfor
21theunexpiredterm.Suchreplacement[shallbearesidentofthesamecongressionaldistrict

23subsection2ofthissection,andshallserveuntilhisorhersuccessorisappointedand
24qualified.[Ifthegeneralassemblyisnotinsessionatthetimeformakinganappointment,
25thegovernorshallmakeatemporaryappointmentuntilthenextsessionofthegeneral
26assembly,whenthegovernorshallnominateapersontofillthepositionofteacher
27representative.]
28 5.Iftheteacherrepresentativeceasestobeanactiveclassroomteacher,asdefined
29undersubsection2ofthissection,orfailstofollowtheboard'sattendancepolicy,theteacher
30representative'spositionshallimmediatelybecomevacantunlessanabsenceiscausedby
31sicknessorsomeaccidentpreventingtheteacherrepresentative'sarrivalatthetimeandplace
32appointedforthemeeting.
33 6.Theteacherrepresentativeshallreceivethesamereimbursementforexpensesas
34membersofthestateboardofeducationreceiveundersection161.022.
35 7.Atnotimeshallmorethanonenonvotingmemberserveonthestateboardof
36education.
37 8.TheprovisionsofthissectionshallexpireonAugust28,[2025] 2031.
