67.1463.1.Thedistrictshallprovidenoticetothegoverningbodyofthe
2municipalityinwhichsuchdistrictislocatedofahearingormeeting,whetheropenor
3closed.
4 2.Exceptasotherwiseprovidedinsubsection4ofthissection,suchnoticeshall
5beprovidedtothegoverningbodyofthemunicipalityinwhichsuchdistrictislocatedat
6leasttencalendardaysbeforesuchhearingormeeting.
7 3.Exceptasotherwiseprovidedinsubsection4ofthissection,thedistrictshall
8submittothegoverningbodyofthemunicipalityinwhichsuchdistrictislocatedthe
9completeagendaofahearingormeetingforwhichnoticeisrequiredunderthissection
10atleastthreedaysbeforethebeginningofsuchhearingormeeting.
11 4.Ifadistrictcallsanemergencyhearingormeetingforwhichthedistrictis
12unabletomeetthenoticerequirementsofsubsection2ofthissectionortheagenda
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 13submissionrequirementsofsubsection3ofthissection,thedistrictshallprovidesuch
14noticeandsubmitsuchagendatothegoverningbodyofthemunicipalityinwhichsuch
15districtislocatedwithoutdelaybeforethehearingormeeting.
67.1471.1.Thefiscalyearforthedistrictshallbethesameasthefiscalyearofthe
2municipality.
3 2.Noearlierthanonehundredeightydaysandnolaterthanninetydayspriortothe
4firstdayofeachfiscalyear,theboardshallsubmittotheMissouridepartmentofrevenue,the
5stateauditor,andthegoverningbodyofthecityaproposedannualbudget,settingforth
6expectedexpenditures,revenues,andratesofassessmentsandtaxes,ifany,forsuchfiscal
7year.Thegoverningbodymayreviewandcommenttotheboardonthisproposedbudget,
8butifsuchcommentsaregiven,thegoverningbodyofthemunicipalityshallprovidesuch
9writtencommentstotheboardnolaterthansixtydayspriortothefirstdayoftherelevant
10fiscalyear;suchcommentsshallnotconstituterequirementsbutshallonlybe
11recommendations.
12 3.Theboardshallholdanannualmeetingandadoptanannualbudgetnolaterthan
13thirtydayspriortothefirstdayofeachfiscalyear.
14 4.(1)Withinonehundredtwentydaysaftertheendofeachfiscalyear,thedistrict
15shallsubmitareporttothemunicipalclerk,theMissouridepartmentofrevenue,thestate
16auditor,andtheMissouridepartmentofeconomicdevelopment.
17 (2)Thereportshall:
18 (a)Statetheservicesprovided,revenuescollected,andexpendituresmadebythe
19districtduringsuchfiscalyear;
20 (b)Statethedatesthedistrictadopteditsannualbudget,submitteditsproposed
21annualbudgettothemunicipality,andsubmitteditsannualreporttothemunicipalclerk;
22[and]
23 (c)Includecopiesofwrittenresolutionsapprovedbytheboardduringthefiscalyear;
24 (d)Listthedatesandlocationofeachmeetingoftheboardduringsuch
25reportingperiod;and
26 (e)Includeanaffidavitsignedbyaboardmemberunderpenaltyofperjurythat
27suchsubmittedreportistrueandaccuratetothebestofthemember'sknowledge,
28information,andbelief.
29 (3)Themunicipalclerkshallretainthisreportaspartoftheofficialrecordsofthe
30municipalityandshallalsocausethisreporttobespreadupontherecordsofthegoverning
31body.
32 5.(1)Thestateauditormayauditadistrictinthesamemannerastheauditormay
33auditanyagencyofthestate.
HB1416 2 34 (2)(a)Thestateauditorshallcalculateacompliancegradeindicatingthe
35reportingcomplianceofeachdistrictandthepercentageofreportingcomplianceforall
36districts.
37 (b)Suchgradeshallbepostedonthestateauditor'swebsitenolaterthanthirty
38daysafterthereportingdeadlinerequiredunderthissection.
39 (c)Adistrict'sfailuretosubmitsuchreportontimeshallresultinacompliance
40gradeofzeroforsuchdistrict.Nodistrictshallbegrantedanyopportunityfor
41amendmentoradjustmentofsuchzerogradeaftersuchgradeiscalculatedandposted.
42 (3)Thestateauditorshallnotcreatealetterorothernoticeofacknowledgment
43ofreceiptofsuchreportthatdoesnotincludethecompliancegradeforadistrictas
44describedinsubdivision(2)ofthissubsection.
[67.1471.1.Thefiscalyearforthedistrictshallbethesameasthe
2 fiscalyearofthemunicipality.
3 2.Noearlierthanonehundredeightydaysandnolaterthanninety
4 dayspriortothefirstdayofeachfiscalyear,theboardshallsubmittothe
5 governingbodyofthecityaproposedannualbudget,settingforthexpected
6 expenditures,revenues,andratesofassessmentsandtaxes,ifany,forsuch
7 fiscalyear.Thegoverningbodymayreviewandcommenttotheboardonthis
8 proposedbudget,butifsuchcommentsaregiven,thegoverningbodyofthe
9 municipalityshallprovidesuchwrittencommentstotheboardnolaterthan
10 sixtydayspriortothefirstdayoftherelevantfiscalyear;suchcommentsshall
11 notconstituterequirementsbutshallonlyberecommendations.
12 3.Theboardshallholdanannualmeetingandadoptanannualbudget
13 nolaterthanthirtydayspriortothefirstdayofeachfiscalyear.
14 4.Withinonehundredtwentydaysaftertheendofeachfiscalyear,
15 thedistrictshallsubmitareporttothemunicipalclerkandtheMissouri
16 departmentofeconomicdevelopment.Thereportshallstatetheservices
17 provided,revenuescollected,andexpendituresmadebythedistrictduring
18 suchfiscalyear;statethedatesthedistrictadopteditsannualbudget,
19 submitteditsproposedannualbudgettothemunicipality,andsubmittedits
20 annualreporttothemunicipalclerk;andincludecopiesofwrittenresolutions
21 approvedbytheboardduringthefiscalyear.Themunicipalclerkshallretain
22 thisreportaspartoftheofficialrecordsofthemunicipalityandshallalso
23 causethisreporttobespreadupontherecordsofthegoverningbody.
24 5.Thestateauditormayauditadistrictinthesamemannerasthe
25 auditormayauditanyagencyofthestate.]
67.1473.1.Adistrictthatfailstoprovidenoticeoftheannualmeetingorthat
2failstoachieveacompliancegradeofatleasteightypercentasrequiredundersection
367.1471may,afternoticeofahearingandavotebythegoverningbodyofthe
4municipalityinwhichsuchdistrictislocated:
5 (1)Havethedistrictboarddissolvedinpartorinfullandnewboardmembers
6electedasprovidedinsection67.1451;or
HB1416 3 7 (2)Beterminatedasprovidedinsection67.1481.
8 2.Adistrictthatisterminatedundersubsection1ofthissectionshall:
9 (1)Immediatelyceaselevyingandcollectinganytaximposedforthebenefitof
10thedistrict;
11 (2)Usemoneysremaininginthedistrict'scommunityimprovementdistrict
12municipalfundtosatisfyallindebtednessofthedistrict;and
13 (3)Afterindebtednessissatisfiedasdescribedinsubdivision(2)ofthis
14subsection,returnallremainingmoneystoanyentitytaxedbythedistrictatthetimeof
15suchterminationinproportiontotheamountscollectedfromsuchentities.
16 3.Thegoverningbodyofamunicipalityinwhichaterminateddistrictunder
17subsection1ofthissectionislocatedshallnotbeobligatedorliableforanyofthe
18terminateddistrict'sremainingindebtedness,inaction,failureoffiduciary
19responsibility,fraudulentactivity,orotherencumbranceofsuchterminateddistrict.
