BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section171.033asenactedbysenatebillsnos.681&682,onehundred 2firstgeneralassembly,secondregularsession,isrepealedandonenewsectionenactedinlieu 3thereof,tobeknownassection171.033,toreadasfollows: 171.033.1."Inclementweather",forpurposesofthissection,shallbedefinedasice, 2snow,extremecold,excessiveheat,flooding,oratornado. 3 2.(1)Adistrictshallberequiredtomakeupthefirstsixdaysofschoollostor 4cancelledduetoinclementweatherandhalfthenumberofdayslostorcancelledinexcessof 5sixdaysifthemakeupofthedaysisnecessarytoensurethatthedistrict'sstudentswillattend 6aminimumofonehundredforty-twodaysandaminimumofonethousandforty-fourhours 7fortheschoolyearexceptasotherwiseprovidedinthissection.Schoolswithafour-day 8schoolweekmayschedulesuchmake-updaysonFridays. 9 (2)Notwithstandingsubdivision(1)ofthissubsection,inschoolyear2019-20and 10subsequentyears,adistrictshallberequiredtomakeupthefirstthirty-sixhoursofschoollost 11orcancelledduetoinclementweatherandhalfthenumberofhourslostorcancelledinexcess 12ofthirty-sixifthemakeupofthehoursisnecessarytoensurethatthedistrict'sstudentsattend 13aminimumofonethousandforty-fourhoursfortheschoolyear,exceptasotherwiseprovided 14undersubsections3and4ofthissection. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 15 3.(1)Inthe2009-10schoolyearandsubsequentyears,aschooldistrictmaybe 16exemptfromtherequirementtomakeupdaysofschoollostorcancelledduetoinclement 17weatherintheschooldistrictwhentheschooldistricthasmadeupthesixdaysrequiredunder 18subsection2ofthissectionandhalfthenumberofadditionallostorcancelleddaysupto 19eightdays,resultinginnomorethantentotalmake-updaysrequiredbythissection. 20 (2)Inschoolyear2019-20andsubsequentyears,aschooldistrictmaybeexempt 21fromtherequirementtomakeupschoollostorcancelledduetoinclementweatherinthe 22schooldistrictwhentheschooldistricthasmadeupthethirty-sixhoursrequiredunder 23subsection2ofthissectionandhalfthenumberofadditionallostorcancelledhoursupto 24forty-eight,resultinginnomorethansixtytotalmake-uphoursrequiredbythissection. 25 4.Thecommissionerofeducationmayprovide,foranyschooldistrictthatcannot 26meettheminimumschoolcalendarrequirementofatleastonehundredseventy-fourdaysfor 27schoolswithafive-dayschoolweekoronehundredforty-twodaysforschoolswithafour- 28dayschoolweekandonethousandforty-fourhoursofactualpupilattendanceor,inschool 29year2019-20andsubsequentyears,onethousandforty-fourhoursofactualpupilattendance, 30uponrequest,awaivertobeexcusedfromsuchrequirement.Thiswaivershallberequested 31fromthecommissionerofeducationandmaybegrantediftheschoolwascloseddueto 32circumstancesbeyondschooldistrictcontrol,includinginclementweatherorfire. 33 5.(1)Exceptasotherwiseprovidedinthissubsection,inschoolyear2020-21and 34subsequentyears,adistrictshallnotberequiredtomakeupanyhoursofschoollostor 35cancelledduetoexceptionaloremergencycircumstancesduringaschoolyearifthedistrict 36hasanalternativemethodsofinstructionplanapprovedbythedepartmentofelementaryand 37secondaryeducationforsuchschoolyear.Exceptionaloremergencycircumstancesshall 38include,butnotbelimitedto,inclementweather,autilityoutage,oranoutbreakofa 39contagiousdisease.Thedepartmentofelementaryandsecondaryeducationshallnotapprove 40anysuchplanunlessthedistrictdemonstratesthattheplanwillnotnegativelyimpact 41teachingandlearninginthedistrict. 42 (2)Ifschoolisclosedduetoexceptionaloremergencycircumstancesandthedistrict 43hasanapprovedalternativemethodsofinstructionplan,thedistrictshallnotifystudentsand 44parentsoneachdayoftheclosurewhetherthealternativemethodsofinstructionplanistobe 45implementedforthatday.Iftheplanistobeimplementedonanydayoftheclosure,the 46districtshallensurethateachstudentreceivesassignmentsforthatdayinhardcopyformor 47receivesinstructionthroughvirtuallearningoranothermethodofinstruction. 48 (3)Adistrictwithanapprovedalternativemethodsofinstructionplanshallnotuse 49alternativemethodsofinstructionasprovidedforintheplanformorethanthirty-sixhours 50duringaschoolyear.Adistrictthathasusedsuchalternativemethodsofinstructionfor 51thirty-sixhoursduringaschoolyearshallberequired,notwithstandingsubsections2and3of HB1431 2 52thissection,tomakeupanysubsequenthoursofschoollostorcancelledduetoexceptionalor 53emergencycircumstancesduringsuchschoolyear. 54 (4)Thedepartmentofelementaryandsecondaryeducationshallgivedistrictswith 55approvedalternativemethodsofinstructionplanscreditforthehoursinwhichtheyuse 56alternativemethodsofinstructionbyconsideringsuchhoursashoursinwhichschoolwas 57actuallyinsession. 58 (5)Anydistrictwishingtousealternativemethodsofinstructionunderthis 59subsectionshallsubmitanapplicationtothedepartmentofelementaryandsecondary 60education.Theapplicationshalldescribe: 61 (a)Themannerinwhichthedistrictintendstostrengthenandreinforceinstructional 62contentwhilesupportingstudentlearningoutsidetheclassroomenvironment; 63 (b)Theprocessthedistrictintendstousetocommunicatetostudentsandparentsthe 64decisiontoimplementalternativemethodsofinstructiononanydayofaclosure; 65 (c)Themannerinwhichthedistrictintendstocommunicatethepurposeand 66expectationsforadayinwhichalternativemethodsofinstructionwillbeimplementedto 67studentsandparents; 68 (d)Theassignmentsandmaterialstobeusedwithinthedistrictfordaysinwhich 69alternativemethodsofinstructionwillbeimplementedtoeffectivelyfacilitateteachingand 70supportlearningforthebenefitofthestudents; 71 (e)Themannerinwhichstudentattendancewillbedeterminedforadayinwhich 72alternativemethodsofinstructionwillbeimplemented.Themethodchosenshallbelinkedto 73completionoflessonsandactivities; 74 (f)Theinstructionalmethods,whichshallincludeinstructionthroughelectronic 75meansandinstructionthroughothermeansforstudentswhohavenoaccesstointernet 76servicesoracomputer; 77 (g)Instructionalplansforstudentswithindividualizededucationprograms;and 78 (h)Theroleandresponsibilityofcertifiedpersonneltobeavailabletocommunicate 79withstudents. 80 6.Inthe2022-23schoolyearandsubsequentyears,aschooldistrict'sone-half-day 81educationprogramsshallbesubjecttothefollowingprovisionsinproportionsappropriatefor 82aone-half-dayeducationprogram,asapplicable: 83 (1)Requirementsinsubsection2ofthissectiontomakeupdaysorhoursofschool 84lostorcancelledbecauseofinclementweather; 85 (2)Exemptionsinsubsection3ofthissection; 86 (3)Waiverprovisionsinsubsection4ofthissection;and 87 (4)Approvedalternativemethodsofinstructionprovisionsinsubsection5ofthis 88section. HB1431 3 89 7.Notwithstandinganyotherprovisionofthissectiontothecontrary,noschool 90districtshallberequiredtomakeupmorethantendaysofschoollostorcancelleddue 91toinclementweatherduringthe2024-25schoolyear. SectionB.Becauseimmediateactionisnecessarytoprovideimmediaterelieffor 2schooldistrictsadverselyaffectedbyinclementweather,sectionAofthisactisdeemed 3necessaryfortheimmediatepreservationofthepublichealth,welfare,peace,andsafety,and 4isherebydeclaredtobeanemergencyactwithinthemeaningoftheconstitution,andsection 5Aofthisactshallbeinfullforceandeffectuponitspassageandapproval. ✔ HB1431 4
