SectionA.Section217.690,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection217.690,toreadasfollows:
217.690.1.Allreleasesorparolesshallissueuponorderoftheparoleboard,duly
2adopted.
3 2.Beforeorderingtheparoleofanyoffender,theparoleboardshallconducta
4validatedriskandneedsassessmentandevaluatethecaseundertherulesgoverningparole
5thatarepromulgatedbytheparoleboard.Theparoleboardshallthenhavetheoffender
6appearbeforeahearingpanelandshallconductapersonalinterviewwithhimorher,unless
7waivedbytheoffender,oriftheguidelinesindicatetheoffendermaybeparoledwithoutneed
8foraninterview.Theguidelinesandrulesshallnotallowforthewaiverofahearingifa
9victimrequestsahearing.Theappearanceorpresencemayoccurbymeansofa
10videoconferenceatthediscretionoftheparoleboard.Aparolemaybeorderedforthebest
11interestofsocietywhenthereisareasonableprobability,basedontheriskassessmentand
12indicatorsofreleasereadiness,thatthepersoncanbesupervisedunderparolesupervisionand
13successfullyreintegratedintothecommunity,notasanawardofclemency;itshallnotbe
14consideredareductionofsentenceorapardon.Everyoffenderwhileonparoleshallremain
15inthelegalcustodyofthedepartmentbutshallbesubjecttotheordersoftheparoleboard.
16 3.Thedivisionofprobationandparolehasdiscretionaryauthoritytorequirethe
17paymentofafee,nottoexceedsixtydollarspermonth,fromeveryoffenderplacedunder

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18divisionsupervisiononprobation,parole,orconditionalrelease,towaiveallorpartofany
19fee,tosanctionoffendersforwillfulnonpaymentoffees,andtocontractwithaprivateentity
20forfeecollectionsservices.Nosuchfeeshallbeleviedoraccrueforthefirstsixtydays
21theoffenderisonprobation,parole,orconditionalrelease.Allfeescollectedshallbe
22depositedintheinmatefundestablishedinsection217.430.Feescollectedmaybeusedto
23paythecostsofcontractedcollectionsservices.Thefeescollectedmayotherwisebeusedto
24providecommunitycorrectionsandinterventionservicesforoffenders.Suchservicesinclude
25substanceabuseassessmentandtreatment,mentalhealthassessmentandtreatment,electronic
26monitoringservices,residentialfacilitiesservices,employmentplacementservices,andother
27offendercommunitycorrectionsorinterventionservicesdesignatedbythedivisionof
28probationandparoletoassistoffenderstosuccessfullycompleteprobation,parole,or
29conditionalrelease.Thedivisionofprobationandparoleshalladoptrulesnotinconsistent
30withlaw,inaccordancewithsection217.040,withrespecttosanctioningoffendersandwith
31respecttoestablishing,waiving,collecting,andusingfees.
32 4.Theparoleboardshalladoptrulesnotinconsistentwithlaw,inaccordancewith
33section217.040,withrespecttotheeligibilityofoffendersforparole,theconductofparole
34hearingsorconditionstobeimposeduponparoledoffenders.Wheneveranorderforparole
35isissueditshallrecitetheconditionsofsuchparole.
36 5.Whenconsideringparoleforanoffenderwithconsecutivesentences,theminimum
37termforeligibilityforparoleshallbecalculatedbyaddingtheminimumtermsforparole
38eligibilityforeachoftheconsecutivesentences,excepttheminimumtermforparole
39eligibilityshallnotexceedtheminimumtermforparoleeligibilityforanordinarylife
40sentence.
41 6.Anyoffendersentencedtoatermofimprisonmentamountingtofifteenyearsor
42moreormultipletermsofimprisonmentthat,takentogether,amounttofifteenormoreyears
43whowasundereighteenyearsofageatthetimeofthecommissionoftheoffenseoroffenses
44maybeeligibleforparoleafterservingfifteenyearsofincarceration,regardlessofwhether
45thecaseisfinalforthepurposesofappeal,andmaybeeligibleforreconsiderationhearingsin
46accordancewithregulationspromulgatedbytheparoleboard.
47 7.Theprovisionsofsubsection6ofthissectionshallnotapplytoanoffenderfound
48guiltyofcapitalmurder,murderinthefirstdegreeormurderintheseconddegree,when
49murderintheseconddegreeiscommittedpursuanttosubdivision(1)ofsubsection1of
50section565.021,whowasundereighteenyearsofagewhentheoffendercommittedthe
51offenseoroffenseswhomaybefoundineligibleforparoleorwhoseparoleeligibilitymaybe
52controlledbysection558.047or565.033.
53 8.Anyoffenderunderasentenceforfirstdegreemurderwhohasbeendeniedrelease
54onparoleafteraparolehearingshallnotbeeligibleforanotherparolehearinguntilatleast
HB1439	2 55threeyearsfromthemonthoftheparoledenial;however,thissubsectionshallnotpreventa
56releasepursuanttosubsection4ofsection558.011.
57 9.Avictimwhohasrequestedanopportunitytobeheardshallreceivenoticethatthe
58paroleboardisconductinganassessmentoftheoffender'sriskandreadinessforreleaseand
59thatthevictim'sinputwillbeparticularlyhelpfulwhenitpertainstosafetyconcernsand
60specificprotectivemeasuresthatmaybebeneficialtothevictimshouldtheoffenderbe
61grantedrelease.
62 10.Parolehearingsshall,ataminimum,containthefollowingprocedures:
63 (1)Thevictimorpersonrepresentingthevictimwhoattendsahearingmaybe
64accompaniedbyoneotherperson;
65 (2)Thevictimorpersonrepresentingthevictimwhoattendsahearingshallhavethe
66optionofgivingtestimonyinthepresenceoftheinmateortothehearingpanelwithoutthe
67inmatebeingpresent;
68 (3)Thevictimorpersonrepresentingthevictimmaycallorwritetheparoleboard
69ratherthanattendthehearing;
70 (4)Thevictimorpersonrepresentingthevictimmayhaveapersonalmeetingwitha
71paroleboardmemberattheparoleboard'scentraloffice;
72 (5)Thejudge,prosecutingattorneyorcircuitattorneyandarepresentativeofthe
73locallawenforcementagencyinvestigatingthecrimeshallbeallowedtoattendthehearingor
74provideinformationtothehearingpanelinregardtotheparoleconsideration;and
75 (6)Theparoleboardshallevaluateinformationlistedinthejuvenilesexoffender
76registrypursuanttosection211.425,providedtheoffenderisbetweentheagesofseventeen
77andtwenty-one,asitimpactsthesafetyofthecommunity.
78 11.Theparoleboardshallnotifyanypersonoftheresultsofaparoleeligibility
79hearingifthepersonindicatestotheparoleboardadesiretobenotified.
80 12.Theparoleboardmay,atitsdiscretion,requireanyoffenderseekingparoleto
81meetcertainconditionsduringthetermofthatparolesolongassaidconditionsarenotillegal
82orimpossiblefortheoffendertoperform.Theseconditionsmayincludeanamountof
83restitutiontothestateforthecostofthatoffender'sincarceration.
84 13.Specialparoleconditionsshallberesponsivetotheassessedriskandneedsofthe
85offenderortheneedforextraordinarysupervision,suchaselectronicmonitoring.Theparole
86boardshalladoptrulestominimizetheconditionsplacedonlow-riskcases,tofrontload
87conditionsuponrelease,andtorequirethemodificationandreductionofconditionsbasedon
88theperson'scontinuingstabilityinthecommunity.Paroleboardrulesshallpermitparole
89conditionstobemodifiedbyparoleofficerswithreviewandapprovalbysupervisors.
90 14.Nothingcontainedinthissectionshallbeconstruedtorequirethereleaseofan
91offenderonparolenortoreducethesentenceofanoffenderheretoforecommitted.
HB1439	3 92 15.BeginningJanuary1,2001,theparoleboardshallnotorderaparoleunlessthe
93offenderhasobtainedahighschooldiplomaoritsequivalent,orunlesstheparoleboardis
94satisfiedthattheoffender,whilecommittedtothecustodyofthedepartment,hasmadean
95honestgood-faithefforttoobtainahighschooldiplomaoritsequivalent;providedthatthe
96directormaywaivethisrequirementbycertifyinginwritingtotheparoleboardthatthe
97offenderhasactivelyparticipatedinmandatoryeducationprogramsorisacademicallyunable
98toobtainahighschooldiplomaoritsequivalent.
99 16.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
100createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
101withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
102Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
103generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
104disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
105rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2005,shallbeinvalid
106andvoid.
