establishmentofacontingencymanagementprogramwithinthedepartmentof
corrections.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter217,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection217.1350,toreadasfollows:
217.1350.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Contingencymanagement",anevidence-basedrecoverymodelusedaspart
3ofsubstanceabusetreatmentinwhichpersonsarerewardedforevidenceofpositive
4behaviorchange;
5 (2)"Department",thedepartmentofcorrections;
6 (3)"Program",thecontingencymanagementprogramestablishedunderthis
7section.
8 2.Subjecttoappropriation,thereshallbeestablishedwithinthedepartmentof
9correctionsa"ContingencyManagementProgram"tofacilitateandencouragelong-
10termabstinencefromsubstanceabuseandprovidecashincentivestoeligiblepersons
11whoareonprobationorparoleafterservingtimeinthedepartmentofcorrections.
12 3.Participantsintheprogramshallbeeligibletoreceivecashincentiveawards
13basedonmeetingthefollowingminimumrequirements:
14 (1)Sixmonthsofabstinencepost-incarcerationfromsubstanceabuse;
15 (2)Participationinatleastsixty-tworecoverymeetingsthatareapprovedbythe
16departmentofcorrections;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (3)Completionofatleasttwonegativedrugscreenings;and
18 (4)Completionofarecoveryworkbook.
19 4.Uponsuccessfulcompletionoftherequirementsofsubsection3ofthissection,
20programparticipantsshallbeeligibletoreceiveatwohundredfiftydollarcash
21incentiveaward.Thedepartmentshallawardnomorethantwenty-eighttwohundred
22fiftydollarcashawardsunderthissection.
23 5.Thedepartmentofcorrectionsmaypromulgateallnecessaryrulesand
24regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
25termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
26sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
27provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
28536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
29pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
30arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
31andanyruleproposedoradoptedafterAugust28,2025,shallbeinvalidandvoid.
32 6.Undersection23.253oftheMissourisunsetact:
33 (1)Theprovisionsofthenewprogramauthorizedunderthissectionshall
34automaticallysunsetsixyearsaftertheeffectivedateofthissectionunlessreauthorized
35byanactofthegeneralassembly;
36 (2)Ifsuchprogramisreauthorized,theprogramauthorizedunderthissection
37shallautomaticallysunsettwelveyearsaftertheeffectivedateofthereauthorizationof
38thissection;and
39 (3)ThissectionshallterminateonSeptemberfirstofthecalendaryear
40immediatelyfollowingthecalendaryearinwhichtheprogramauthorizedunderthis
41sectionissunset.
