Torepealsection338.333,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
licensureofentitiesinvolvedinthedistributionofdrugs.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section338.333,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection338.333,toreadasfollows:
338.333.1.Exceptasotherwiseprovidedbytheboardofpharmacybyruleinthe
2eventofanemergencyortoalleviateasupplyshortage,nopersonordistributionoutletshall
3actasawholesaledrugdistributor,pharmacydistributor,drugoutsourcer,orthird-party
4logisticsproviderwithoutfirstobtaininglicensetodosofromtheMissouriboardof
5pharmacyandpayingtherequiredfee.Theboardmaygranttemporarylicenseswhenthe
6wholesaledrugdistributor,pharmacydistributor,drugoutsourcer,orthird-partylogistics
7providerfirstappliesforalicensetooperatewithinthestate.Temporarylicensesshall
8remainvaliduntilsuchtimeastheboardshallfindthattheapplicantmeetsorfailstomeetthe
9requirementsforregularlicensure.Nolicenseshallbeissuedorrenewedforawholesale
10drugdistributor,pharmacydistributor,drugoutsourcer,orthird-partylogisticsproviderto
11operateunlessthesameshallbeoperatedinamannerprescribedbylawandaccordingtothe
12rulesandregulationspromulgatedbytheboardofpharmacywithrespectthereto.Separate
13licensesshallberequiredforeachdistributionsiteownedoroperatedbyawholesaledrug
14distributor,pharmacydistributor,drugoutsourcer,orthird-partylogisticsprovider,unless
15suchdrugdistributor,pharmacydistributor,drugoutsourcer,orthird-partylogisticsprovider
16meetstherequirementsofsection338.335.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 2.Anagentoremployeeofanylicensedorregisteredwholesaledrugdistributor,
18pharmacydistributor,drugoutsourcer,orthird-partylogisticsproviderneednotseek
19licensureunderthissectionandmaylawfullypossesspharmaceuticaldrugs,iftheagentor
20employeeisactingintheusualcourseofhisorherbusinessoremployment.
21 3.Theboardmaypermitout-of-statewholesaledrugdistributors,drugoutsourcers,
22third-partylogistics[provider] providers, orout-of-statepharmacydistributorstobelicensed
23asrequiredbysections338.210to338.370onthebasisofreciprocitytotheextentthatthe
24entityboth:
25 (1)Possessesavalidlicensegrantedbyanotherstatepursuanttolegalstandards
26comparabletothosewhichmustbemetbyawholesaledrugdistributor,pharmacydistributor,
27drug[outsourcers] outsourcer, orthird-partylogisticsproviderofthisstateasprerequisites
28forobtainingalicenseunderthelawsofthisstate. Ifastatelicenseisnotissuedbytheir
29residentstate,out-of-statewholesaledrugdistributorsandthird-partylogistics
30providerswithacurrentandvaliddrugdistributoraccreditationfromtheNational
31AssociationofBoardsofPharmacyoritssuccessormaybeeligibleforlicensureas
32providedbytheboardbyrule;and
33 (2)DistributesintoMissourifromastatewhichwouldextendreciprocaltreatment
34underitsownlawstoawholesaledrugdistributor,pharmacydistributor,drugoutsourcers,or
35third-partylogisticsproviderofthisstate.
