BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section338.333,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection338.333,toreadasfollows: 338.333.1.Exceptasotherwiseprovidedbytheboardofpharmacybyruleinthe 2eventofanemergencyortoalleviateasupplyshortage,nopersonordistributionoutletshall 3actasawholesaledrugdistributor,pharmacydistributor,drugoutsourcer,orthird-party 4logisticsproviderwithoutfirstobtaininglicensetodosofromtheMissouriboardof 5pharmacyandpayingtherequiredfee.Theboardmaygranttemporarylicenseswhenthe 6wholesaledrugdistributor,pharmacydistributor,drugoutsourcer,orthird-partylogistics 7providerfirstappliesforalicensetooperatewithinthestate.Temporarylicensesshall 8remainvaliduntilsuchtimeastheboardshallfindthattheapplicantmeetsorfailstomeetthe 9requirementsforregularlicensure.Nolicenseshallbeissuedorrenewedforawholesale 10drugdistributor,pharmacydistributor,drugoutsourcer,orthird-partylogisticsproviderto 11operateunlessthesameshallbeoperatedinamannerprescribedbylawandaccordingtothe 12rulesandregulationspromulgatedbytheboardofpharmacywithrespectthereto.Separate 13licensesshallberequiredforeachdistributionsiteownedoroperatedbyawholesaledrug 14distributor,pharmacydistributor,drugoutsourcer,orthird-partylogisticsprovider,unless 15suchdrugdistributor,pharmacydistributor,drugoutsourcer,orthird-partylogisticsprovider 16meetstherequirementsofsection338.335. Ifastatelicenseisnotissuedbytheir 29residentstate,out-of-statewholesaledrugdistributorsandthird-partylogistics 30providerswithacurrentandvaliddrugdistributoraccreditationfromtheNational 31AssociationofBoardsofPharmacyoritssuccessormaybeeligibleforlicensureas 32providedbytheboardbyrule;and 33 (2)DistributesintoMissourifromastatewhichwouldextendreciprocaltreatment 34underitsownlawstoawholesaledrugdistributor,pharmacydistributor,drugoutsourcers,or 35third-partylogisticsproviderofthisstate. ✔ HB1465 2
