SectionA.Chapter644,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection644.800,toreadasfollows:
644.800.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Department",thedepartmentofnaturalresources;
3 (2)"Discharge",areleasebyanymeansincluding,butnotlimitedto,spilling,
4leaking,pumping,pouring,spraying,emitting,disposing,escaping,emptying,or
5dumping,whetherintentionalorunintentional;
6 (3)"Perfluoroalkylandpolyfluoroalkylsubstances"or"PFAS",any
7perfluoroalkylandpolyfluoroalkylsubstanceslistedinthetoxicchemicallistunder
8section313oftheEmergencyPlanningandCommunityRight-to-KnowAct
9("EPCRA"),asamended;
10 (4)"Person",thesameasdefinedundersection644.016;

12 2.Thedepartmentshallpromulgaterulesregulatingthemanufacture,use,
13storage,andremediationoffirefightingorfire-suppressingfoamtowhichPFAShave
14beenintentionallyadded.Suchrulesandregulationsshallbedesignedtoprotectthe
15environmentandensuresafeandcleansoil,water,andairforthestateofMissouri.
16 3.Apersonthatdischargesorcausestobedischargedfirefightingorfire-
17suppressingfoamtowhichPFAShavebeenintentionallyaddedintooruponanylake,

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18pond,river,stream,sewer,surfacewaterdrainage,groundwater,otherwatersofthe
19state,oranypublicorprivatewatersupplyorontolandadjacentto,on,oroversuch
20watersshallreportthedischargetothedepartmentassoonaspracticable,butnolater
21thattwenty-fourhoursafterthedischargeoccurs.
22 4.BeginningJanuary1,2027,apersonshallnotmanufacture,sell,offerforsale,
23distributeforsale,ordistributeforuseinthisstateafirefightingorfire-suppressing
24foamtowhichPFAShavebeenintentionallyadded,exceptinthefollowing
25circumstances:
26 (1)Suchfoamismanufactured,sold,ordistributedforuseatanairportinthe
27state,solongasthefoamisrequiredbyfederallaworregulationtobeusedatairports
28forfirefightingorfire-suppressingpurposesincluding,butnotlimitedto,asrequiredby
2914C.F.R.139.Theexceptioninthissubdivisionshallnotapplyifsuchfoamisnot
30requiredbyfederallaworregulation;or
31 (2)Suchfoamismanufactured,sold,ordistributedforamarinedefense
32applicationandtheuseofthefoamisrequiredbytheUnitedStatesDepartmentof
33Defense.
34 5.Apersonthatmanufacturesforsaleordistributioninthisstateafirefighting
35orfire-suppressingfoamshall,uponrequestbythedepartment,providethedepartment
36withacertificateofcompliancecertifyingthatthefoamdoesnotcontainintentionally
37addedPFASorisexceptedfromtheprohibitionundersubdivision(1)or(2)of
38subsection4ofthissection.
39 6.Exceptasprovidedinsubsection4ofthissection,beforeJanuary1,2027,a
40personthatmanufacturesfirefightingorfire-suppressingfoamtowhichPFAShave
41beenintentionallyaddedandsold,offeredforsale,ordistributedinthisstatebefore
42January1,2027,shall:
43 (1)Providewrittennotificationregardingtheprohibitiontoanypersoninthe
44statethatreceivedsuchfoamfromthemanufacturerforsale,distribution,oruse;and
45 (2)Issuearecallofallsuchfoam,whichshallincludeaprocessbywhicha
46personinthestatethatreceivedsuchfoamwillbereimbursedbythemanufacturerfor
47therecalledfoam.
48 7.Thedirectormaypromulgateallnecessaryrulesandregulationsforthe
49administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin
50section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
51becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
52536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
53andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
54review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
HB1466 2 55heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
56adoptedafterAugust28,2025,shallbeinvalidandvoid.
