47 (2)Installanenergystoragesystem; 48 (3)Connectanenergystoragesystemtoaneworexistingsolarelectricsystem 49sitedonthecustomer-generator'spremisesthatisconfirmedbytheelectrical 50corporationtohavebecomeoperationalandincompliancewiththeprovisionsof 51section386.890;and 52 (4)Transfertotheelectricalcorporationallrights,titles,andinterestinandto 53therenewableenergycreditsassociatedwiththesolarelectricsystemandenergy 54storagesystemthatqualifiedthecustomer-generatorfortherebateforaperiodoften HB1487 2 55yearsfromthedatetheelectricalcorporationconfirmedthattheenergystoragesystem 56wasinstalledandoperational. 57 5.Anelectricalcorporation'sobligationtomakerebatepaymentsunderthis 58sectionshallnotexceedthefollowinglimitations: 59 (1)AsofAugust28,2025,anelectricalcorporationwithonemillionormore 60customersinthestateshallnotbeobligatedtopayrebatesinanycalendaryearfrom 612025through2031inanamountexceedingfivemillionsixhundredthousanddollarsor 62inanaggregateamountexceedingtwenty-eightmilliondollars; 63 (2)AsofAugust28,2025,anelectricalcorporationwithlessthanonemillionbut 64morethantwohundredthousandcustomersinthestateshallnotbeobligatedtopay 65rebatesinanycalendaryearfrom2025through2031inanamountexceedingone 66millionsixhundredthousanddollarsorinanaggregateamountexceedingeightmillion 67dollars;and 68 (3)AsofAugust28,2025,anelectricalcorporationwithtwohundredthousand 69orlesscustomersinthestateshallnotbeobligatedtopayrebatesinanycalendaryear 70from2025through2031inanamountexceedingonemillionfourhundredthousand 71dollarsorinanaggregateamountexceedingsevenmilliondollars. 72 6.Aftertheissuanceoftherebateunderthissection,anelectricalcorporation 73shallbepermittedtorecoverthecostofallrebatepaymentsithasmadethrougheither 74baseratesorarateadjustmentmechanismundersection393.1030andshallalsobe 75permittedtodeferandamortizetherecoveryofsuchcosts,includinginterestatthe 76electricalcorporation'sshort-termborrowingrate,througheitherbaseratesora 77surchargeoveraperiodoftheelectricalcorporation'schoicenottoexceedfiveyears, 78providedthatifrecoveryofsuchcostsinsuchmannerandoversuchatimeperiod 79wouldcausetheelectricalcorporationtoexceedtheonepercentmaximumaverage 80retailrateincreaselimitationrequiredbysubdivision(1)ofsubsection2ofsection 81393.1030.Therecoveryofsuchcoststhatwouldexceedtheonepercentmaximum 82averageretailrateincreaselimitationshallbedeferredbytheelectricalcorporationtoa 83regulatoryassettowhichcarryingcostsattheelectricalcorporation'sweightedaverage 84costofcapitalshallbeaddedandrecoveredthroughbaseratesorthrougharate 85adjustmentmechanismundersection393.1030,assoonaspracticable. 86 7.Thecommissionshallpromulgaterulestoimplementtheprovisionsofthis 87section.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 88createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit 89complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 90section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 91vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe HB1487 3 92effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional, 93thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust 9428,2025,shallbeinvalidandvoid. ✔ HB1487 4
