BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections476.056and478.250,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections476.056and478.250,toreadasfollows:
476.056.1.Anycity,county,villageorothermunicipalitymayprovidefor
2automationofitsmunicipalcourtpursuanttosubsection3ofsection476.055,inthemanner
3providedinthissection.Inordertomakesuchprovisions,suchmunicipalitymust:
4 (1)Adoptanordinanceimposingthesurchargeintheamountallowed,andpayablein
5themannerprovided,bysection[476.053] 488.027, andsections488.010to488.020;
6 (2)Enterintoanagreementwiththestatecourtsadministratorforautomationofthe
7municipality'scourt.Suchagreementmayprovideforcontinuationofthesurchargefora
8minimumperiodoftime,payabletothefundestablishedbysection476.055,oraspecialfund
9establishedinthestatetreasuryforsuchpurposeuponexpirationofsection476.055,for
10paymentofaguaranteedminimumannualamountintheeventthatpaymentofsuch
11surchargesshallnotoffsetthecostoftheautomationofthemunicipality'scourt;andsuch
12othertermsasmaybeagreedonbetweenthemunicipalityandthestatecourtsadministrator.
13 2.Notwithstandingtheprovisionsofsection[476.053] 488.027, thepaymentofany
14surchargeprovidedbythissectionmaycontinueforaperiodinexcessofthatallowedby
15section[476.053] 488.027forpaymentofsurchargesinthecircuitcourts.Theprovisionsof
16section33.080shallnotapplytoanyspecialfundestablishedpursuanttothissection.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 478.250.1.Untilotherwiseprovidedbycourtruleauthorizedbytheconstitutionor
2bycourtorderauthorizedbylaw,casesshallcontinuetobefiledinthesameplacesandthe
3samefiling,docketingandassignmentofcaseproceduresshallapplyaswereineffecton
4January1,1979,withrespecttothesamecategoriesofcases.
5 2.Inthosecountieswithcentralizedfiling,ifacaseiswithinthosecategoriesofcases
6enumeratedinsubdivisions(1)and(2)ofsubsection1ofsection517.011,theplaintiffwhen
7filingthecasemaydesignateatthetimeoffilingthatthecaseshallbeheardanddetermined
8underthecivilpracticeandprocedureapplicablebeforecircuitjudges[, andinsucheventthe
9caseshallbeheardanddeterminedbyacircuitjudgeunlessanassociatecircuitjudgeshallbe
10assignedortransferredtohearanddeterminethecasepursuanttosection478.240or478.245
11orSection6ofArticleVoftheConstitution.Ifnosuchdesignationismade,thecaseshallbe
12heardanddeterminedunderchapter517].
13 3.Intheassignmentofcasestoassociatecircuitjudgesincircuitcourtswithmore
14thanoneresidentassociatecircuitjudge,insofarasisreasonablypossibleandconsistentwith
15theproperadministrationofjustice,assignmentsmadeeitherpursuanttolocalcircuitcourt
16ruleorbythepresidingjudge:
17 (1)Shallnoteffectanassignmentofthecausefromthecourthousewherethecaseis
18filedtoanothercourthouseinthecountyforhearingwithouttheconsentofthepartiesshown
19exceptforgoodcauseshown;and
20 (2)Shallbemadeinsuchmanneraswillassurethatwhenalitigantorcounsel
21simultaneouslyfileanumberofcasesofasimilarcharactertobeheardbeforeanassociate
22circuitjudge,suchcaseswillbeassignedasagrouptoasingleassociatecircuitjudgeorin
23suchothermanneraswillreasonablyassurethattheywillbeprocessedandheardwithout
24settingorreturndateconflictswhichwouldrequirecounseltoappearonmultipleoccasions
25oratconflictingtimes.
26 4.Theprovisionsofsubsection3ofthissectionshallapplyastoassignmentsmade
27whereacentralizeddocketingprocedurehasbeenadoptedbylocalcourtorderunderthe
28provisionsofsubsection4ofsection478.245.
