4747 35 (f)Unauthorizedpersonsonornearthepremisesofthesummercamp;
4848 36 (g)Aquaticemergencies,asappropriateforthesite;and
4949 37 (h)Otheremergencysituations,asappropriateforthesite.
5050 38 (2)Summercampemployees,includingthedirectorandcampcounselors,shall
5151 39betrainedinimplementingtheemergencyplanproceduresprovidedforunder
5252 40subdivision(1)ofthissubsection.
5353 41 4.Atleastfiftypercentofthecampcounselorsemployedbyasummercamp,
5454 42andanydirectoremployedbyasummercamp,shallbetrainedincardiopulmonary
5555 43resuscitationandintheuseofanautomatedexternaldefibrillator.
5656 44 5.Anyaquaticactivityofferedbyasummercamptochildrenattendingthe
5757 45summercampandanyrelatedequipmentshallbeinspectedannuallybytherelevant
5858 46statedepartmentincluding,butnotlimitedto,thedepartmentofhealthandsenior
5959 47services,thedepartmentofpublicsafety,orthedepartmentofconservation.Such
6060 48inspectionsmaybecompletedbylocalagenciesifthestandardsemployedbylocal
6161 49personnelaresubstantiallyequivalenttostatestandardsandlocalpersonnelare
6262 50availableforenforcementofsuchstandards.
6363 51 6.Thedepartmentofelementaryandsecondaryeducationshallmaintainalist
6464 52ofalllicensedsummercampsinthisstateandanycomplaintsagainstanyofthose
6565 53summercamps.Suchinformationshallbemadeavailabletothepublic.
6666 HB1536 2 54 7.Itshallbeunlawfulforanypersonororganizationtoestablish,maintain,or
6767 55operateasummercampthathasnotobtainedalicenseunderthissectionfromthe
6868 56departmentofelementaryandsecondaryeducation.Everysummercampshalldisclose
6969 57thelicensurestatusofthecamptotheparentsorguardiansofthechildrenforwhichthe
7070 58campprovidesrecreationinthesummer.
7171 59 8.Anypersonororganizationoperatingasummercampinthisstateshall
7272 60maintainrecordsofallinspectionsrequiredundersubsection5ofthissectionofaquatic
7373 61activitiesofferedbythesummercamptochildrenattendingthesummercampandof
7474 62anyrelatedequipment.
7575 63 9.Allcampcounselorsshallbesubjecttoacriminalbackgroundcheck.Such
7676 64backgroundcheckshallinclude:
7777 65 (1)AstateandFederalBureauofInvestigationfingerprintcheck;
7878 66 (2)AsearchoftheNationalSexOffenderRegistry;and
7979 67 (3)Asearchofthefollowingregistries,repositories,ordatabasesinMissouri,
8080 68thestatewherethecampcounselorresides,andeachstatewheresuchcampcounselor
8181 69residedduringtheprecedingfiveyears:
8282 70 (a)Thestatecriminalregistryorrepository,withtheuseoffingerprintsbeing
8383 71requiredinthestatewherethecampcounselorresidesandoptionalinotherstates;
8484 72 (b)Thestatesexoffenderregistryorrepository;
8585 73 (c)Thestatefamilycaresafetyregistry;and
8686 74 (d)Thestate-basedchildabuseandneglectregistryanddatabase.
8787 75 10.BeginningMay1,2027,anypersonororganizationthatviolatesthe
8888 76provisionsofthissectionshallbeguiltyofaclassCmisdemeanorforthefirstoffense
8989 77andshallbeassessedafinenottoexceedsevenhundredfiftydollarsandshallbeguilty
9090 78ofaclassAmisdemeanorandshallbeassessedafineofuptotwothousanddollarsper
9191 79day,nottoexceedatotaloftenthousanddollars,foranysubsequentoffense.Ifaperson
