285.2000.Forthepurposesofsections285.2000to285.2015,thefollowingterms
2shallmean:
3 (1)"Affiliate",apersonthatdirectlyorindirectly,throughoneormore
4intermediaries,controls,iscontrolledby,orisundercommoncontrolwithanother
5person.Forthepurposesofthissubdivision,"control"meansthepossession,directlyor
6indirectly,ofmorethanfiftypercentofthepowertodirectorcausethedirectionofthe
7managementandpoliciesofaperson,whetherthroughtheownershipofvotingshares,
8bycontract,orotherwise;

285.2003.1.Anemployershallprovidetoeachemployee,uponhire,orwithin
2thirtydaysofAugust28,2025,awrittendescriptionof:
3 (1)Eachquotatowhichtheemployeeissubject,includingthequantified
4numberoftaskstobeperformedormaterialstobeproducedorhandledwithina
5definedtimeperiod;
6 (2)Anypotentialadverseemploymentactionthatcouldresultfromfailureto
7meeteachquota;and
8 (3)Anyincentivesorbonusprogramsassociatedwithmeetingorexceedingeach
9quota.
10 2.Wheneverthereisachangetoaquotathatresultsinadifferentquotathan
11themostrecentwrittendescriptionprovidedtotheemployee,theemployershall:
12 (1)Notifytheemployeeorallyorinwritingassoonaspossibleandbeforethe
13employeeissubjecttothenewquota;and
14 (2)Providetheemployeewithanupdatedwrittendescriptionofeachquotato
15whichtheemployeeissubjectwithintwobusinessdaysofthequotachange.
16 3.Wheneveranemployertakesanadverseactionagainstanemployeeinwhole
17orinpartforfailuretomeetaquota,theemployershallprovidethatemployeewiththe
18applicablequotafortheemployeeandthepersonalwork-speeddatafortheemployee
19thatwasthebasisfortheadverseaction.

38hundredfiftydollars.Thefirstviolationshallnotexceedtwohundredfiftydollars.The
39departmentmay,atanytime,waiveorreduceanycivilpenaltyassessedagainstan
40employerunderthissectionifthedepartmentdeterminesthattheemployerhastaken
41correctiveactiontoremedyaviolation.Thedepartmentshalladoptrulescreatinga
42scheduletoenhancepenalties,basedonrepeatviolationsbytheemployer.
43 7.Uponreceivingacomplaint,thedepartmentmayrequestorsubpoenathe
44recordsofthewarehousedistributioncenter.
45 8.Forenforcementactionsundersections285.2000to285.2015,ifanyperson
46failstopayanassessmentunderthissection,orunderanyruleunderthissection,after
47ithasbecomeafinalandunappealableorder,orafteracourthasenteredfinal
48judgmentinfavoroftheagency,thedirectorortheattorneygeneralmayinitiate
49collectionproceduresasauthorizedbylaw.
50 9.Ifthedepartmentfindsthataquotaviolatessections285.2000to285.2015,the
51departmentmayordertheemployertoreviewandprovideacorrectedwrittenquotato
52theaffectedemployeeoremployeeswithinfifteencalendardaysandplacealetterinthe
53employee'spersonnelfiletoacknowledgethecorrection.

5ofcompliancetothedirectorbyfilinganoticeofappealwiththeadministrativehearing
6commissionundertheprovisionsofchapter621withinfifteencalendardaysofthe
7department'sissuanceofthecitationandnoticeofassessmentordeterminationof
8compliance.Acitationandnoticeofassessmentordeterminationofcompliancenot
9appealedwithinfifteencalendardaysisfinalandbinding,andnotsubjecttofurther
10appeal.

285.2015.Thedepartmentmaypromulgateallnecessaryrulesandregulations
2fortheadministrationofsections285.2000to285.2015.Anyruleorportionofarule,as
3thattermisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedin
4thissectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
5provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
6536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
7pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
8arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
9andanyruleproposedoradoptedafterAugust28,2025,shallbeinvalidandvoid.
