80section,lessanysumspaidtoattorneysorforcostsinlitigatingtheothercivilactionor 81obtainingthesettlementagreement.Areimbursementrequiredunderthissubsection 82shallnotexceedtheamountofthemonetaryawardtheclaimantwinsfordamagesinthe 83othercivilactionortheamountreceivedinthesettlementagreement. 84 7.Ifthecourtfindsthattheclaimantisentitledtoajudgment,itshallentera 85certificateofinnocencefindingthattheclaimantwasinnocentofalloffensesforwhich 86theclaimantwasmistakenlyconvicted.Theclerkofthecourtshallsendacertifiedcopy 87ofthecertificateofinnocenceandthejudgmententrytotheattorneygeneralfor 88paymentundersection105.711. 89 8.Uponentryofacertificateofinnocence,theclaimantshallautomaticallybe 90grantedanorderofexpungementfromthecourtinwhichheorshepledguiltyorwas 91sentencedtoexpungefromallofficialrecordsorrecordationsofhisorherarrest,plea, 92trial,orconviction.Upongrantingoftheorderofexpungement,therecordsandfiles 93maintainedinanyadministrativeorcourtproceedinginanassociateorcircuitdivision 94ofthecourtshallbeconfidentialandonlyavailabletothepartiesorbyorderofthe 95courtforgoodcauseshown.Theeffectofsuchordershallbetorestoresuchpersonto 96thestatusheorsheoccupiedpriortosucharrest,plea,orconvictionandasifsuchevent 97hadnevertakenplace.Nopersonastowhomsuchorderhasbeenenteredshallbeheld 98thereafterunderanyprovisionofanylawtobeguiltyofperjuryorotherwisegivinga 99falsestatementbyreasonofhisorherfailuretoreciteoracknowledgesucharrest,plea, 100trial,conviction,orexpungementinresponsetoanyinquirymadeofhimorherforany 101purposewhatsoever,andnosuchinquiryshallbemadeforinformationrelatingtoan 102expungementunderthissubsection. 103 9.Uponentryofacertificateofinnocence,thecourtshallorderthe 104expungementanddestructionoftheassociatedbiologicalsamplesauthorizedbyand 105giventotheMissouristatehighwaypatrol.Theordershallstatetheinformation 106requiredtobestatedinapetitiontoexpungeanddestroythesamplesandprofilerecord 107andshalldirecttheMissouristatehighwaypatroltoexpungeanddestroysuchsamples 108andprofilerecord.Theclerkofthecourtshallsendacertifiedcopyoftheordertothe 109Missouristatehighwaypatrol,whichshallcarryouttheorderandprovideconfirmation 110ofsuchactiontothecourt.NothinginthissubsectionshallrequiretheMissouristate HB1551 10 111highwaypatroltoexpungeanddestroyanysampleorprofilerecordassociatedwiththe 112claimantthatwasrelatedtoanyoffenseotherthantheoffenseforwhichthecourthas 113enteredacertificateofinnocence. 114 10.Thedecisiontograntordenyacertificateofinnocenceshallnothaveares 115judicataeffectonanyotherproceedings. 116 11.Nothinginthissectionshallprecludethedepartmentofcorrectionsfrom 117providingaclaimantreentryservicesthatareprovidedtootherpersonsincluding,but 118notlimitedto,financialassistance,housingassistance,mentoring,andcounseling.Such 119servicesshallbeprovidedwhileanactionunderthissectionispendingandafterany 120judgmentisentered,asappropriateforsuchclaimant. 121 12.Adecisionunderthissectionmaybeappealedtothesupremecourt. 506.403.1.Anyindividualawardedtuitionassistanceundersection506.400 2shallreceiveawaiveroftuitionandrequiredfeesforattendanceatapublicinstitution 3ofhighereducationforuptoonehundredtwentycredithours.Suchindividualmay 4attendapublicinstitutionofhighereducationeitherfull-timeorpart-time. 5 2.(1)Subjecttoappropriations,thedepartmentofhighereducationmaymake 6expenditurestoeachindividualawardedtuitionassistanceundersection506.400whois 7enrolledinapublicinstitutionofhighereducationforreimbursementofadditionalfees 8including,butnotlimitedto,feesforroomandboard,technicalequipment,andcourse- 9requiredbooks. 10 (2)Nopublicinstitutionofhighereducationshalldelayenrollmentofan 11individualwhoisawardedtuitionassistanceundersection506.400because 12appropriationsarenotavailableforanyadditionalfeesprovidedtosuchindividual. 13 3.Toremaineligibleforthetuitionandfeeswaiverunderthissection,an 14individualshallremainingoodstandingatthepublicinstitutionofhighereducation 15wheretheindividualisenrolled. 16 4.Individualsshallprovideawrittenorelectroniccopyofthecourtorder 17awardingreliefintheformoftuitionassistancetothepublicinstitutionofhigher 18educationorthedepartmentofhighereducation. 19 5.Thedepartmentofhighereducationshalladoptrulesandregulationsto 20administertheprovisionsofthissection.Anyruleorportionofarule,asthattermis 21definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection 22shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof 23chapter536and,ifapplicable,section536.028.Thissectionandchapter536are 24nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto 25chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare HB1551 11 26subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule 27proposedoradoptedafterAugust28,2025,shallbeinvalidandvoid. [650.058.1.Notwithstandingthesovereignimmunityofthestate,any 2 individualwhowasfoundguiltyofafelonyinaMissouricourtandwaslater 3 determinedtobeactuallyinnocentofsuchcrimesolelyasaresultofDNA 4 profilinganalysismaybepaidrestitution.Theindividualmayreceivean 5 amountofonehundreddollarsperdayforeachdayofpostconviction 6 incarcerationforthecrimeforwhichtheindividualisdeterminedtobe 7 actuallyinnocent.Thepetitionforthepaymentofsaidrestitutionshallbefiled 8 withthesentencingcourt.Forthepurposesofthissection,theterm"actually 9 innocent"shallmean: 10 (1)Theindividualwasconvictedofafelonyforwhichafinalorderof 11 releasewasenteredbythecourt; 12 (2)Allappealsoftheorderofreleasehavebeenexhausted; 13 (3)Theindividualwasnotservinganytermofasentenceforanyother 14 crimeconcurrentlywiththesentenceforwhichheorsheisdeterminedtobe 15 actuallyinnocent,unlesssuchindividualwasservinganotherconcurrent 16 sentencebecausehisorherparolewasrevokedbyacourtortheparoleboard 17 inconnectionwiththecrimeforwhichthepersonhasbeenexonerated. 18 Regardlessofwhetheranyotherbasismayexistfortherevocationofthe 19 person'sprobationorparoleatthetimeofconvictionforthecrimeforwhich 20 thepersonislaterdeterminedtobeactuallyinnocent,whenthecourt'sorthe 21 paroleboard'ssolestatedreasonfortherevocationinitsorderistheconviction 22 forthecrimeforwhichthepersonislaterdeterminedtobeactuallyinnocent, 23 suchordershall,forpurposesofthissectiononly,beconclusiveevidencethat 24 theirprobationorparolewasrevokedinconnectionwiththecrimeforwhich 25 thepersonhasbeenexonerated;and 26 (4)Testingorderedundersection547.035,ortestingbytheorderof 27 anystateorfederalcourt,ifsuchpersonwasexoneratedonorbeforeAugust 28 28,2004,ortestingorderedundersection650.055,ifsuchpersonwasoris 29 exoneratedafterAugust28,2004,demonstratesaperson'sinnocenceofthe 30 crimeforwhichthepersonisincustody. 31 32 Anyindividualwhoreceivesrestitutionunderthissectionshallbeprohibited 33 fromseekinganycivilredressfromthestate,itsdepartmentsandagencies,or 34 anyemployeethereof,oranypoliticalsubdivisionoritsemployees.This 35 sectionshallnotbeconstruedasawaiverofsovereignimmunityforany 36 purposesotherthantherestitutionprovidedforherein.Thedepartmentof 37 correctionsshalldeterminetheaggregateamountofrestitutionowedduringa 38 fiscalyear.Ifinsufficientmoneysareappropriatedeachfiscalyeartopay 39 restitutiontosuchpersons,thedepartmentshallpayeachindividualwhohas 40 receivedanorderawardingrestitutionaproratashareoftheamount 41 appropriated.Providedsufficientmoneysareappropriatedtothedepartment, 42 theamountsowedtosuchindividualshallbepaidonJunethirtiethofeach 43 subsequentfiscalyear,untilsuchtimeastherestitutiontotheindividualhas 44 beenpaidinfull.However,noindividualawardedrestitutionunderthis 45 subsectionshallreceivemorethanthirty-sixthousandfivehundreddollars HB1551 12 46 duringeachfiscalyear.Nointerestonunpaidrestitutionshallbeawardedto 47 theindividual.Noindividualwhohasbeendeterminedbythecourttobe 48 actuallyinnocentshallberesponsibleforthecostsofcareundersection 49 217.831. 50 2.IftheresultsoftheDNAtestingconfirmtheperson'sguilt,thenthe 51 personfilingforDNAtestingundersection547.035,shall: 52 (1)Beliableforanyreasonablecostsincurredwhenconductingthe 53 DNAtest,includingbutnotlimitedtothecostofthetest.Suchcostsshallbe 54 determinedbythecourtandshallbeincludedinthefindingsoffactand 55 conclusionsoflawmadebythecourt;and 56 (2)Besanctionedundertheprovisionsofsection217.262. 57 3.Apetitionforpaymentofrestitutionunderthissectionmayonlybe 58 filedbytheindividualdeterminedtobeactuallyinnocentortheindividual's 59 legalguardian.Noclaimorpetitionforrestitutionunderthissectionmaybe 60 filedbytheindividual'sheirsorassigns.Anindividual'srighttoreceive 61 restitutionunderthissectionisnotassignableorotherwisetransferrable.The 62 state'sobligationtopayrestitutionunderthissectionshallceaseuponthe 63 individual'sdeath.Anybeneficiarydesignationthatpurportstobequeath, 64 assign,orotherwiseconveytherighttoreceivesuchrestitutionshallbevoid 65 andunenforceable. 66 4.Anindividualwhoisdeterminedtobeactuallyinnocentofacrime 67 underthischaptershallautomaticallybegrantedanorderofexpungement 68 fromthecourtinwhichheorshepledguiltyorwassentencedtoexpunge 69 fromallofficialrecordsallrecordationsofhisorherarrest,plea,trialor 70 conviction.Upongrantingoftheorderofexpungement,therecordsandfiles 71 maintainedinanyadministrativeorcourtproceedinginanassociateorcircuit 72 divisionofthecourtshallbeconfidentialandonlyavailabletothepartiesor 73 byorderofthecourtforgoodcauseshown.Theeffectofsuchordershallbe 74 torestoresuchpersontothestatusheorsheoccupiedpriortosucharrest,plea 75 orconvictionandasifsucheventhadnevertakenplace.Nopersonasto 76 whomsuchorderhasbeenenteredshallbeheldthereafterunderanyprovision 77 ofanylawtobeguiltyofperjuryorotherwisegivingafalsestatementby 78 reasonofhisorherfailuretoreciteoracknowledgesucharrest,plea,trial, 79 convictionorexpungementinresponsetoanyinquirymadeofhimorherfor 80 anypurposewhatsoeverandnosuchinquiryshallbemadeforinformation 81 relatingtoanexpungementunderthissection.] ✔ HB1551 13
