Torepealsection571.070,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
unlawfulpossessionofafirearm,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section571.070,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection571.070,toreadasfollows:
571.070.1.Apersoncommitstheoffenseofunlawfulpossessionofafirearmifsuch
2personknowinglyhasanyfirearminhisorherpossessionand:
3 (1)Suchpersonhasbeenconvictedofafelonyunderthelawsofthisstate,orofa
4crimeunderthelawsofanystateoroftheUnitedStateswhich,ifcommittedwithinthisstate,
5wouldbeafelony;[or]
6 (2)Suchpersonisafugitivefromjustice,ishabituallyinanintoxicatedordrugged
7condition,oriscurrentlyadjudgedmentallyincompetent; or
8 (3)Suchpersonisundereighteenyearsofageandisonpublicproperty.
9However,possessionunderthissubdivisionisnotanoffenseifsuchpersonpossessesthe
10firearm:
11 (a)Whileaccompaniedbyapersontwenty-oneyearsofageorolder;
12 (b)Forthepurposesofaschool-sanctioned,firearm-relatedeventorclubevent;
13 (c)Forthelawfulpursuitofgame;or
14 (d)Asotherwiseauthorizedbylaw.
15 2.UnlawfulpossessionofafirearmisaclassCfelony,unlessapersonhasbeen
16convictedofadangerousfelonyasdefinedinsection556.061,orthepersonhasaprior
17convictionforunlawfulpossessionofafirearminwhichcaseitisaclassBfelony.
