2enactedinlieuthereof,tobeknownassections387.420,387.436,and575.121,toreadas

387.420.1.BeforeallowinganindividualtoaccepttriprequeststhroughaTNC's
2digitalnetwork,theTNCshall:
3 (1)RequiretheindividualtoregisterwiththeTNCbysubmittinginformation
4regardinghisorheraddress,age,driver'slicense,motorvehicleregistration,automobile
5liabilityinsurance,andotherinformationrequiredbytheTNC;
6 (2)Conduct,orhaveathirdpartyconduct,alocalandnationalcriminalbackground
7checkforeachapplicantthatshallinclude:
8 (a)Multistate/multijurisdictioncriminalrecordslocatororothersimilarcommercial
9nationwidedatabasewithvalidation,alsoknownasaprimarysourcesearch;and
10 (b)UnitedStatesDepartmentofJusticeNationalSexOffenderpublicwebsite;and
11 [(c)](3)Obtainandreview,orhaveathirdpartyobtainandreview,adrivinghistory
12researchreportforsuchindividual.
13 2.TheTNCshallnotpermitanindividualtoactasaTNCdriveronitsdigital
14networkwho:

21 (3)Hasbeenconvicted,withinthepastsevenyears,ofasecondorsubsequent
22violationofsection577.010or577.012,fraud,asexualoffense,resistingorinterferingwith
23arrestwheretheconvictionresultsinaclassEfelony,useofamotorvehicletocommita
24felony,anoffenseinvolvingpropertydamage,theft,anactofviolence,oranactofterror;
25 (4)IsamatchintheUnitedStatesDepartmentofJusticeNationalSexOffender
26publicwebsite;
27 (5)Doesnotpossessavaliddriver'slicense;
28 (6)Doesnotpossessproofofregistrationforthemotorvehicleorvehiclesusedto
29provideprearrangedrides;
30 (7)Doesnotpossessproofofautomobileliabilityinsuranceforthemotorvehicleor
31vehiclesusedtoprovideprearrangedrides;[or]
32 (8)Isnotatleastnineteenyearsofage;or
33 (9)IsnotaUnitedStatescitizenorauthorizedtoworkunderacurrent

35 3.ATNCdriverwhoisqualifiedtoaccepttriprequeststhroughaTNC'sdigital
36networkpursuanttothissectionshallnotberequiredtoobtainanyotherstateorlocallicense
37orpermittoprovideprearrangedrides.
387.436.1.UponreceiptofinformationthataTNCdriverhasbeenconvictedofa
2violationofsection577.010or577.012,fraud,asexualoffense,useofamotorvehicleto
3commitafelony,anoffenseinvolvingpropertydamage,theft,anactofviolence,oranactof
4terror,ornolongermaintainstheminimummotorvehiclefinancialresponsibilityrequiredto
5becarriedunderchapter303,aTNCshallimmediatelyrevokesuchdriver'sabilitytoaccept
6triprequeststhroughtheTNC'sdigitalplatform,andassoonaspracticable,notifythe
7departmentoftheTNCdriver'sname,licensenumber,andlicenseplatenumber.
8 2.UpontheexpirationofanemploymentauthorizationdocumentofaTNC
9driver,aTNCshallimmediatelyrevokesuchdriver'sabilitytoaccepttriprequests
10throughtheTNC'sdigitalplatform,andassoonaspracticable,notifythedepartmentof
11theTNCdriver'sname,licensenumber,andlicenseplatenumber.
12 3.UponreceiptofinformationthataTNCdriverhasbeeninvolvedinatraffic
13accidentorincidentthatresultsinseriousbodilyinjuryorafatality,aTNCshallnotifythe
14departmentofthedriver'sname,licensenumber,andlicenseplatenumber.

16informationreceivedundersubsections1and2ofthissectiontoallotherTNCslicensedin
17thisstate.
18 [4.]5.Notwithstandinganyotherprovisionoflaw,anyinformationprovidedtothe
19departmentunderthissectionshallbeexemptfromdisclosureunderchapter610.
575.121.1.Apersoncommitstheoffenseofimpersonatingatransportation
2networkcompanydriveriftheperson:
3 (1)Makesafalsestatement,usesafalsedisplayofdistinctivesignageor
4emblemsknownasatradedress,trademark,branding,orlogoofthetransportation
5networkcompany,oranyotheractthatfalselyrepresentsthatthepersonhasacurrent
6connectionwithatransportationnetworkcompany;or
7 (2)Falselyrepresentsthatthepersonisrespondingtoapassengerriderequest
8foratransportationnetworkcompany.
9 2.Exceptasprovidedinsubsections3and4ofthissection,theoffenseof
10impersonatingatransportationnetworkcompanydriverisaclassAmisdemeanor.
11 3.Theoffenseofimpersonatingatransportationnetworkcompanydriverisa
12classCfelonyifthepersonimpersonatesatransportationnetworkdriverduringthe
13commissionof:
14 (1)Anyfelonyoffenseandcausesgreatbodilyinjurytoanotherpersonother
15thantoanaccomplice;or
16 (2)Theoffenseofkidnappinginthefirstdegree,kidnappinginthesecond
17degree,kidnappinginthethirddegree,orchildkidnappingunderchapter565orany
18sexualoffenseunderchapter566.
19 4.Theoffenseofimpersonatingatransportationnetworkcompanydriverisa
20classAfelonyifthepersonimpersonatesatransportationnetworkdriverduringthe
21commissionofanyfelonyoffenseandcausesthedeathofanotherpersonotherthanto
22anaccomplice.
23 5.Nothinginthissectionshallprecludeprosecutionunderanyotherlaw.
