BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter21,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection21.950,toreadasfollows: 21.950.1.WhenaconventioniscalledtoproposeamendmentstotheUnited 2StatesConstitutionpursuanttoArticleVoftheUnitedStatesConstitution,theselection 3andparticipationofcommissionersfromMissouritosuchconventionshallbegoverned 4bythissection. 5 2.(1)Missourishallhaveanumberofcommissionersequaltothenumberof 6congressionaldistrictsinthestateatthetimewithonecommissionerfromeach 7congressionaldistrictandanumberofalternatecommissionersequaltothenumberof 8congressionaldistrictsinthestateatthetimewithonealternatecommissionerfrom 9eachcongressionaldistrict. 10 (2)CommissionersandalternatesshallbecitizensofthestateofMissouriand 11shallotherwisemeetthesamequalificationsnecessarytoholdofficeintheMissouri 12houseofrepresentatives.Commissionersandalternatesmayincludepersonsholding 13publicoffice,subjecttofurtherlimitsdescribedbelow,exceptthatnopersonshallbe 14eligiblewhois: 15 (a)AmemberoftheUnitedStatesHouseofRepresentativesorSenate; 16 (b)AnemployeeoftheUnitedStates; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (c)AnemployeeorotherrepresentativeofacontractorwiththeUnitedStates; 18or 19 (d)Anelectedofficialholdingastatewideoffice. 20 21Commissionersandalternatesarealsosubjecttothoseexistingethicsrulesthatapplyto 22membersofthegeneralassembly. 23 (3)Thehouseofrepresentativesandsenateshallselect,byadoptionofa 24concurrentresolution,thecommissionersandalternateswhomeettheeligibility 25requirementsdescribedinthissectionandwhoaresubmittedtothehouseof 26representativesandthesenatebythejointlegislativecommitteeasprovidedin 27subsection4ofthissection.Ofthecommissioners,atleastone-thirdshallnotbesitting 28membersofthegeneralassembly.Ofthealternatecommissioners,atleastone-third 29shallnotbesittingmembersofthegeneralassembly. 30 (4)Amajorityofthecommissionersshallconstituteaquorumforalldecisions 31madebythedelegation,andnocommissionermaygivehisorhervotebyproxyor 32otherwisetoanyothercommissioner.Thecommissionersshallselectachairto 33administertheworkofthecommissioners. 34 3.(1)Eachcommissionerandalternateshall,byoathoraffirmationasa 35conditionofparticipatingintheconvention,agreetofaithfullyandimpartially 36dischargeallthedutiesincumbentuponacommissioner,includingthedutytoabideby 37instructionsestablishedbyconcurrentresolutionofthegeneralassemblyfor 38participationintheconventionandthedutytoactonlywithinthescopeofthe 39generalassembly'sapplicationfortheconventionifMissouriappliedfortheconvention 40inwhichthecommissionersareparticipating.Eachcommissionerandalternateshall 41furtheragreetoimmediatelynotifythejointlegislativecommitteeifheorshebelieves 42thatanyMissouricommissioneroralternatehasviolatedhisorheroathorinstructions 43whileparticipatingintheconvention. 44 (2)PriortotheArticleVconvention,thegeneralassemblyshallconsider 45"RecommendedCommissionerInstructions"presentedtoitbythejointlegislative 46committeeasdiscussedfurtherinsubsection4ofthissectionandshallbyconcurrent 47resolutionprovidedulyapprovedinstructionstothecommissionersandalternates 48regardingthescopeofmattersthecommissionersmayconsiderandvoteonatthe 49convention,includingrulesofprocedureandproposedamendments.Suchinstructions 50maybechangedbythegeneralassemblypriortoorduringtheconvention.These 51instructionsshallinclude,butshallnotbelimitedto: 52 (a)Aninstructionthatthecommissionersshallnotsupportanyvotingruleother 53thantherulewherebyeachstateexercisesonevote;and HB166 2 54 (b)Aninstructionthatonallvotingmattersattheconvention,thedecisionofa 55simplemajorityoftheMissouricommissionersshallconstituteasinglevoteforthestate 56ofMissouri. 57 (3)AnyvotecastbyacommissioneroralternateatanArticleVconventionthat 58isoutsidethescopeofanyofthefollowingisanunauthorizedvoteandisthereforevoid: 59 (a)Theinstructionsestablishedbyanyconcurrentresolutionadoptedunderthis 60section;or 61 (b)AnylimitsidentifiedintheMissourigeneralassembly'sapplicationforthe 62convention. 63 4.(1)AfterornearthetimeanArticleVconventioniscalled,ajointlegislative 64committeeshallbedulyauthorizedbythegeneralassemblyforthepurposesdescribed 65inthissection.Thejointlegislativecommitteeshallbecomprisedoffivemembersofthe 66senateappointedbythepresidentprotemporeofthesenate,withthreemembersfrom 67themajoritypartyandtwomembersfromtheminorityparty,andfivemembersofthe 68houseofrepresentativesappointedbythespeakerofthehouseofrepresentatives,with 69threemembersfromthemajoritypartyandtwomembersfromtheminorityparty,and 70shallhavetheinitialtaskofrecommendingeligiblecommissionerstothehouseof 71representativesandthesenateforconsiderationofappointmentascommissioners.The 72jointlegislativecommitteeshallsubmitatleastthreepersonsfromeachcongressional 73districtwhoareeligible,asprovidedinthissection,toserveascommissionersandat 74leastthreedifferentpersonsfromeachcongressionaldistrictwhoareeligible,as 75providedinthissection,toserveasalternatecommissioners.Thehouseof 76representativesandthesenateshallselectacommissionerandalternatecommissioner 77fromeachcongressionaldistrictfromthenamessubmittedbythejointlegislative 78committee.Thejointlegislativecommitteeshallalsobechargedwithpresenting 79"RecommendedCommissionerInstructions"tothefullgeneralassemblyfor 80considerationleadingtoaconcurrentresolutionasdiscussedinsubdivision(2)of 81subsection3ofthissection.Suchcommissionerinstructionsshalldefinethescopeof 82mattersthecommissionersmayconsiderandvoteonattheArticleVconvention, 83includingrulesofprocedureandproposedamendmentsasdiscussedmorefullyin 84subsection3ofthissection.Allrecommendationsthatsecureasimplemajorityvoteof 85thememberspresentshallbedeemedapproved"RecommendedCommissioner 86Instructions"tobesubmittedtothefullgeneralassemblyforitsconsideration. 87 (2)Aftercommissionershavebeenselected,thejointlegislativecommitteemay 88recallanycommissionerandrevokesuchcommissioner'sauthority.However,thejoint 89legislativecommitteeshallrecallandrevoketheauthorityonlyintheeventthe 90commissionercastsorattemptstocastanunauthorizedvoteasdescribedinthissection. HB166 3 91Thejointlegislativecommitteeshallalsoappointoneoftheselectedalternatestotake 92theplaceofacommissionersorecalled.Thejointlegislativecommitteeshallpromptly 93investigateanynoticethatacommissioneroralternatehascastanunauthorizedvoteor 94otherwiseexceededthescopeofthegeneralassembly'sapplicationfortheconventionor 95thegeneralassembly'sinstructionstothecommissioners.Thejointlegislative 96committeeshallacttoensurethatthecommissionersremainfaithfultothetermsof 97theconventionapplicationandthegeneralassembly'sinstructions.Beforeorduring 98theArticleVconvention,thejointlegislativecommitteemayadvisethecommissioners 99onquestionsthatariseregardingthescopeoftheconventionandthelegislative 100instructionstocommissioners. 101 (3)Byconcurrentresolution,thegeneralassemblymaychangeorsupersedeany 102actionofthejointlegislativecommitteeorrecallcommissionersoralternatestothe 103convention,orappointnewcommissionersoralternates. 104 (4)Thejointlegislativecommitteeshallbeauthorizedtoconductitsbusinessvia 105telephoneorbyelectroniccommunication. 106 5.Iftheprovisionsofthissectionconflictwiththerulesorprocedures 107establishedbytheArticleVconvention,thegeneralassemblymay,byconcurrent 108resolution,conformtheseprovisionstosuchrulesorprocedures. ✔ HB166 4
