HB199 2 53 4.Nothinginthissectionshallbeconstruedtorequirea[memberoftheschoolboard 54ofanypublicschooldistrictofthisstate] publicofficialtoindependentlyconfirmthe 55existenceorsolvencyofanybondingcompanyifacontractorrepresentstothe[member] 56publicofficialthatthebondingcompanyissolventandthattherepresentationsmadeinthe 57purportedbondaretrueandcorrect.Thissubsectionshallnotrelievefromanyliabilityany 58[schoolboardmember] publicofficialwhohasanyactualknowledgeoftheinsolvencyof 59anybondingcompany,orany[schoolboardmember] publicofficialwhodoesnotactin 60goodfaithincomplyingwiththeprovisionsofsubsection2ofthissection. 61 5.Apublicentitymaydefend,saveharmlessandindemnifyanyofits[officersand 62employees] publicofficials, whether[electiveorappointive] elected,employed,or 63appointed, againstanyclaimordemand,whethergroundlessorotherwisearisingoutof 64anallegedactoromissionoccurringintheperformanceofadutyunderthissection.The 65provisionsofthissubsectiondonotapplyincaseofmalfeasanceinofficeorwillfulor 66wantonneglectofduty. 67 6.[Nothinginthissectionshallbedeemedtorequireanycontractorwhoprovides 68constructionservicesforapublicworksprojectusedfornongovernmentalpurposesandwho 69contractswithapublicentity'slessee,agent,designee,orrepresentativeonsuchpublicworks 70projectusedfornongovernmentalpurposestofurnishabondwhenthepublicentity'slessee, 71agent,designee,orrepresentativeisrequiredunderthissectiontofurnishabond] Ifconsent 72thatmeetstherequirementsofsubsection2ofsection513.455hasbeenexecutedand 73recordedasthereinrequired,nobondisrequiredtobefurnishedunderthissection. 74 7.Nothinginthissectionshallbedeemedtorequireanypublicentity'slessee, 75agent,designee,orrepresentativethatcontractswithacontractortoprovide 76constructionservicesforapublicworksprojectintendedbeleasedprimarilytoa 77privateentityfornongovernmentalusetofurnishabondwhenthecontractoris 78requiredtofurnishabondunderthissectionorinfactfurnishesacomplyingbond. 79 8.Theprovidingofabondunderthissectionshallprecludethefilingofamechanic's 80lienunderchapter429byanysubcontractororsupplier.Anymechanic'slienfiledin 81violationhereofshallbevoidandunenforceableandshallbesummarilydischargedbya 82judgeofthecountyinwhichthemechanic'slienisfiled. 513.455.1.(1)Asusedinthissection,"entity"meansthisstate,apublicbody 2corporateandpoliticofthisstate,acounty,acity,atown,atownship,amunicipality,a 3roaddistrict,awaterdistrict,asewerdistrict,afiredistrict,alibrarydistrict,ahospital 4district,aschooldistrict,oranyotherpoliticalsubdivisionofthisstate. 5 (2)All[courthouses,jails,clerks'officesandotherbuildingsownedbyanycountyor 6municipality,andthelotsonwhichtheystand,andallburialgrounds,] ofthefollowing HB199 3 7ownedbyanentitydefinedinsubdivision(1)ofthissubsectionshallbeexemptfrom 8attachmentandexecution: 9 (a)Courthouses; 10 (b)Jails; 11 (c)Clerks'offices; 12 (d)Otherbuildingsandimprovements; 13 (e)Lotsuponwhichstructureslistedinparagraphs(a)to(d)ofthissubdivision 14arelocated;and 15 (f)Burialgroundsandotherlands. 16 2.Ifanentitydefinedinsubdivision(1)ofsubsection1ofthissectionentersinto 17aleaseorotheragreementwithalessee,agent,designee,orrepresentativewhoisto 18provideorarrangeconstructionservicesonaprojectintendedbeleasedprimarilytoa 19privateentityfornongovernmentaluse,theentitymayconsenttothesubjectionofthe 20projectandthelanduponwhichitislocatedtotheattachmentofmechanics'liensfiled 21underchapter429.Anysuchconsentshallbeinwritingspecificallystatingsuch 22consent,shallcontainalegaldescriptionofthepropertytobesubjecttoattachment, 23shallbesignedandacknowledgedbyitsauthorizedofficialorofficerinaformsuitable 24forrecording,andshallberecordedintheofficeoftherecorderofdeedsforthecounty 25inwhichthepropertyislocated.Suchconsentmaybeincludedaspartofanyleaseor 26otheragreement,oramemorandumthereof,executedandrecordedinthesame 27manner.Uponsuchrecording,thepropertydescribedthereinshallbesubjecttothe 28provisionsofchapter429asifthepropertywereownedbyaprivateperson. ✔ HB199 4
